S1061|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE SENATE SENATE BILL NO. 1061 BY FINANCE COMMITTEE 1 AN ACT 2 APPROPRIATING ADDITIONAL MONEYS TO THE OFFICE OF THE STATE APPELLATE PUBLIC 3 DEFENDER FOR FISCAL YEAR 1999; AND DECLARING AN EMERGENCY. 4 Be It Enacted by the Legislature of the State of Idaho: 5 SECTION 1. In addition to the appropriation made in Section 1, Chapter 6 402, Laws of 1998, there is hereby appropriated to the Office of the State 7 Appellate Public Defender the following amount to be expended according to the 8 designated standard classification from the listed fund for the period July 1, 9 1998, through June 30, 1999: 10 FOR: 11 Operating Expenditures $100,000 12 FROM: 13 General Fund $100,000 14 SECTION 2. An emergency existing therefor, which emergency is hereby 15 declared to exist, this act shall be in full force and effect on and after its 16 passage and approval.
STATEMENT OF PURPOSE
SB 1061
This is a FY 1999 supplemental appropriation for the Office of the State Appellate Public
Defender. The Office of the State Appellate Public Defender was created during the 1998
legislative session and was first appropriated General Funds in FY 1999.

The State Appellate Public Defender anticipates at least three capital litigation cases before
June 30,1999. In order to defend these cases the agency will need to hire litigation experts that
include: forensic experts, mental health experts, mitigation experts and investigators. Included
in this $100,000 supplemental appropriation is the funding to pay for these services plus the
expected additional costs of travel and miscellaneous expenses of the experts. This funding is
ongoing.
