                                   SENATE BILL NO. 1063

                             BY JUDICIARY AND RULES COMMITTEE

 1                                        AN ACT
 2    RELATING TO COUNTY JAILS; AMENDING SECTION 20-601, IDAHO CODE, TO PROVIDE  FOR
 3        THE AUTHORITY FOR JAIL PERSONNEL TO HOLD A PERSON IN THE COUNTY JAIL UNTIL
 4        THE  BOOKING  PROCESS  IS COMPLETED, TO PROVIDE THE BOOKING PROCESS AND TO
 5        PROVIDE PROCEDURES.

 6    Be It Enacted by the Legislature of the State of Idaho:

 7        SECTION 1.  That Section 20-601, Idaho Code, be, and the  same  is  hereby
 8    amended to read as follows:

 9        20-601.  COUNTY  JAILS  -- BY WHOM KEPT AND FOR WHAT USE. The common jails
10    in the several counties of this state are kept by the sheriffs of the counties
11    in which they are respectively situated, and are used as follows:
12        1.  For the detention of persons committed in order to secure their atten-
13    dance as witnesses in criminal cases.
14        2.  For the detention of persons charged  with  crime  and  committed  for
15    trial.
16        3.  For  the  confinement of persons committed for contempt, or upon civil
17    process, or by other authority of law.
18        4.  For the confinement of persons sentenced to imprisonment therein  upon
19    a conviction for crime.
20         5.  Any person who is arrested and taken to a county jail shall sub-
21    mit  to  the entire booking process, to include, but not be limited to, having
22    his or her photograph taken and his or her fingerprints recorded.  Any  person
23    who refuses to submit to the entire booking process will be held in the county
24    jail until the process is completed, or until ordered to be released by a mag-
25    istrate  or  district  judge.  A person held under this section shall be taken
26    before a magistrate at the next scheduled first appearance time, but shall not
27    be released until either the entire booking process is completed or the  judge
28    orders the release. 

Statement of Purpose / Fiscal Impact


                        STATEMENT OF PURPOSE

The purpose of this bill is to streamline the entire
booking process and help reduce the workload for judges,
prosecutors and other court personnel by completing the booking
process. There is an increase in persons brought to jail who
claim allegiance to anti-government groups and therefore refuse
to complete the booking process. There is no sure way of
confirming their identity nor recording their identity for
future reference.

                           FISCAL IMPACT

No impact on the state general fund nor its political
subdivisions. There could be a slight savings for counties.
