                                   SENATE BILL NO. 1067

                             BY HEALTH AND WELFARE COMMITTEE

 1                                        AN ACT
 2    RELATING TO THE IDAHO BOARD OF NURSING HOME ADMINISTRATORS;  AMENDING  SECTION
 3        54-1605,  IDAHO  CODE, TO PROVIDE A SUNSET DATE FOR PROVISIONS AUTHORIZING
 4        EXPERIENCE IN LIEU OF FOUR YEAR DEGREE LICENSING REQUIREMENTS AND TO  MAKE
 5        TECHNICAL CORRECTIONS.

 6    Be It Enacted by the Legislature of the State of Idaho:

 7        SECTION  1.  That  Section 54-1605, Idaho Code, be, and the same is hereby
 8    amended to read as follows:

 9        54-1605.  QUALIFICATIONS FOR EXAMINATION FOR LICENSE. (1) The board  shall
10    admit  to examination for licensure as a nursing home administrator any candi-
11    date who pays a fee as determined by the board,  and  submits  evi-
12    dence  of  good moral character and suitability prescribed by the board, 
13    and  is at least twenty-one (21) years old except:
14        (a)  That on and after July 1, 1970, no applicant for license as a nursing
15        home administrator shall be admitted to  such  licensing  examination  nor
16        shall  such  applicant be entitled to or be granted a license as a nursing
17        home administrator unless such applicant shall submit written evidence, on
18        forms provided for such purpose by the board,  that  he  has  successfully
19        completed  a  course  of  study  and has been graduated from a high school
20        approved and recognized by the educational authorities  of  the  state  in
21        which  such school is located, or a political division thereof or has sub-
22        mitted a certificate indicating that he has obtained high school  or  sec-
23        ondary  school  equivalency,  such  certificate  being duly certified by a
24        state educational authority or a political division  thereof,  and  except
25        that  he shall have complied with the provisions of subsection (2) of this
26        section.
27        (b)  That on or after January 1, 1975, no applicant for license as a nurs-
28        ing home administrator shall be admitted to  such  licensing  examination,
29        nor shall such applicant be entitled to or be granted a license as a nurs-
30        ing  home  administrator,  unless such applicant shall submit written evi-
31        dence, on forms provided for such purpose by the board, that he  has  suc-
32        cessfully completed two (2) years of college level study after high school
33        study  in  an accredited institution of higher learning and except that he
34        shall have complied with the provisions of subsection (2) of this section.
35        (c)  That on or after January 1, 1980, no applicant for license as a nurs-
36        ing home administrator shall be admitted to such licensing examination nor
37        shall such applicant be entitled to or be granted a license as  a  nursing
38        home administrator unless such applicant shall submit written evidence, on
39        forms  provided  for  such  purpose by the board, that he has successfully
40        completed a course of study  for  a  baccalaureate  degree  and  has  been
41        awarded  such  degree from an accredited institution of higher learning or
42        its equivalent as provided in subsection (3) of this section,  and  except
43        that  he shall have complied with the provisions of subsection (2) of this

 1        section.
 2        (2)  On and after July 1, 1970, each applicant who  has  not  completed  a
 3    regular  course  of  study  or  program in an accredited institution of higher
 4    learning, which course of study or program shall have  been  approved  by  the
 5    board  as being adequate academic preparation for nursing home administration,
 6    shall in addition to meeting the requirements of  subsection  (1)(a)  of  this
 7    section  submit  evidence  satisfactory  to the board that he has successfully
 8    completed specialized courses or a program of study in  the  area  of  nursing
 9    home administration  as required and approved by the rules of the board.
10        (3)  A candidate who applies for examination under and pursuant to subsec-
11    tion  (1)(b)  or  (c) of this section, in lieu of the educational requirements
12    provided for therein, may submit evidence satisfactory to the board that  such
13    applicant  has  obtained two (2) years of satisfactory practical experience in
14    nursing home administration or in a related  health  administration  area  for
15    each  year of required posthigh school education.  Upon implementation of
16    the omnibus budget reconciliation act (OBRA), 42 USC sec. 1396, but  no  later
17    than  January  1,  2000, subsection (3) of this section shall be null and void
18    and of no further force and effect.

Amend existing statute to eliminate 54-1605(3)upon implementation
of the Omnibus Budget Reconciliation Act but no later than January
1, 2000. Eliminates experience in lieu of four year degree route to
satisfy educational requirement.






                             FISCAL IMPACT
