S1070|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE SENATE SENATE BILL NO. 1070 BY COMMERCE AND HUMAN RESOURCES COMMITTEE 1 AN ACT 2 RELATING TO THE REAL ESTATE APPRAISER BOARD; AMENDING SECTION 54-4106, IDAHO 3 CODE, TO INCREASE THE TERMS OF BOARD MEMBERS TO STAGGER EXPIRATION OF 4 TERMS AND TO MAKE A TECHNICAL CORRECTION. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 54-4106, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 54-4106. REAL ESTATE APPRAISERS -- REAL ESTATE APPRAISER BOARD -- POWERS 9 AND DUTIES -- COMPENSATION. (1) There is hereby created in the department of 10 self-governing agencies, a real estate appraiser board, hereinafter referred 11 to as the "board," which shall administer the provisions of this chapter. The 12 board shall consist of five (5) members to be appointed by the governor as 13 follows: 14 (a) One (1) from the northern district consisting of the counties of 15 Idaho, Lewis, Nez Perce, Clearwater, Latah, Benewah, Boundary, Shoshone, 16 Kootenai and Bonner; one (1) from the southeastern district consisting of 17 the counties of Lemhi, Butte, Clark, Fremont, Jefferson, Madison, Teton, 18 Bonneville, Bingham, Caribou, Bear Lake, Franklin, Oneida, Power and Ban- 19 nock; one (1) from the southwestern district consisting of the counties of 20 Owyhee, Elmore, Ada, Canyon, Boise, Gem, Payette, Washington, Adams and 21 Valley; one (1) from the south central district consisting of the counties 22 of Blaine, Camas, Cassia, Custer, Gooding, Jerome, Lincoln, Minidoka and 23 Twin Falls; and one (1) from the state at large; 24 (b) On July 1, 1990, the governor shall appoint the members of the board, 25 each of whom shall be a real estate appraiser with not less than five (5) 26 years ' experience in the real estate appraisal business in 27 Idaho.The initial appointments shall be for a term of three (3)28years. After July 1, 1991, appointments to the board shall be made so as29to appoint a board member from the northern district for a three (3) year30term and a board member from the south central district for a four (4)31year termAs of July 1, 1999, the board appointment from the 32 state at large is extended for a period of two (2) years and the board 33 appointment from the south central district is extended for a period of 34 one (1) year . Each regular appointment thereafter, other than an 35 appointment to fill an unexpired term, shall be for a term of four (4) 36 years and each board member shall hold office until a successor is 37 appointed and qualified. Upon the death, resignation or removal of any 38 member of the board, the governor shall appoint a state licensed or state 39 certified real estate appraiser to fill the unexpired term. Appointments 40 to fill any vacancy other than that resulting from the expiration of a 41 term shall be made for the unexpired term. After July 1, 1991, new board 42 members shall be required to be state licensed or certified real estate 43 appraisers with not less than five (5) years experience in the real estate 2 1 appraisal business in Idaho; 2 (c) Within fifteen (15) days after the appointment of the members of the 3 board, the board shall call a meeting and organize by the election of a 4 chairman. Thereafter the chairman may call meetings of the board whenever 5 he deems it advisable but if he refuses to call a meeting upon written 6 demand of the other four (4) members of the board, then such members may 7 call such meeting. Reasonable notice shall be given in writing by mail of 8 such meeting. 9 (2) The board shall have, in addition to the powers conferred elsewhere 10 in this chapter, the following powers and duties: 11 (a) To authorize, by written agreement, the bureau of occupational 12 licenses to act as its agent in its interest; 13 (b) To adopt, pursuant to the administrative procedure act, such rules as 14 the board, in its discretion, deems necessary for the administration and 15 enforcement of this chapter, and any such rules deemed necessary by the 16 board to keep the Idaho real estate appraisers act in compliance with fed- 17 eral law, rule, regulation or policy; 18 (c) To conduct investigations into violations of the provisions of this 19 chapter; 20 (d) To receive applications for and issue licenses or certificates to 21 real estate appraisers pursuant to this chapter; 22 (e) To hold meetings, hearings and examinations at such places and at 23 such times as it shall designate; 24 (f) To collect, deposit and disburse application and other fees, as 25 required by this chapter or federal law; 26 (g) To maintain a register of all state licensed or certified residential 27 and state certified general real estate appraisers; and 28 (h) To censure a state licensed or certified appraiser or suspend or 29 revoke appraisal licenses or certificates as provided in this chapter, 30 subject to the provisions of the Idaho administrative procedure act, chap- 31 ter 52, title 67, Idaho Code. 32 (3) Each member of the board of real estate appraisers shall be compen- 33 sated as provided in section 59-509(m), Idaho Code.
