                                   SENATE BILL NO. 1073

                             BY HEALTH AND WELFARE COMMITTEE

 1                                        AN ACT
 2    RELATING TO LIENS; AMENDING CHAPTER 7, TITLE 45, IDAHO CODE, BY  THE  ADDITION
 3        OF  A NEW SECTION 45-704C, IDAHO CODE, TO PROVIDE FOR LIENS FOR CHIROPRAC-
 4        TIC CARE AND TO PROVIDE PROCEDURES FOR PERFECTING THE LIEN.

 5    Be It Enacted by the Legislature of the State of Idaho:

 6        SECTION 1.  That Chapter 7, Title 45, Idaho Code,  be,  and  the  same  is
 7    hereby  amended  by  the addition thereto of a  NEW SECTION , to be
 8    known and designated as Section 45-704C, Idaho Code, and to read as follows:

 9        45-704C.  LIENS FOR CHIROPRACTIC CARE.  Every  individual  or  association
10    licensed or incorporated under the laws of the state of Idaho to practice chi-
11    ropractic  (hereinafter  "physician") shall be entitled to a lien for the rea-
12    sonable charges for chiropractic care and treatment rendered an injured person
13    upon any and all causes of action, suits,  claims,  counterclaims  or  demands
14    accruing  to  the  person to whom such care and treatment was furnished, or to
15    the legal representative of such person, on account of injuries giving rise to
16    such causes of action and which necessitate such chiropractic care and  treat-
17    ment.  In  order to perfect the lien, the physician or his agent shall, before
18    or within ninety (90) days after the last date of  chiropractic  services  for
19    the  injury,  file the lien in the same general form and manner as provided in
20    section 45-702, Idaho Code, in the office of the recorder  of  the  county  in
21    which  the  physician  rendered  the  services. The lien shall be recorded and
22    indexed in the manner provided in section 45-703, Idaho Code. The  lien  shall
23    be  enforced  or  released  or  both in the manner provided in section 45-704,
24    Idaho Code.  If the claimant of the lien shall prevail in an action to enforce
25    the lien, the court may allow reasonable attorney's fees and disbursements.

                       STATEMENT OF PURPOSE

To confer the same right to lien on licensed chiropractic
physicians for care services rendered as the Idaho Code now
authorizes for hospital care, nursing care and medical care.








                           FISCAL NOTE

This bill has no fiscal impact on the General Fund of the State of
Idaho.
