                                   SENATE BILL NO. 1093

                               BY TRANSPORTATION COMMITTEE

 1                                        AN ACT
 2    RELATING TO TITLING AND  REGISTRATION  OF  MOTOR  VEHICLES;  AMENDING  SECTION
 3        49-205, IDAHO CODE, TO PROVIDE THAT COUNTY ASSESSORS MAY APPOINT AGENTS TO
 4        PERFORM  DUTIES RELATED TO TITLING AND REGISTRATION OF MOTOR VEHICLES; AND
 5        PROVIDING AN EFFECTIVE DATE.

 6    Be It Enacted by the Legislature of the State of Idaho:

 7        SECTION 1.  That Section 49-205, Idaho Code, be, and the  same  is  hereby
 8    amended to read as follows:

 9        49-205.  DUTIES  OF LOCAL OFFICERS. (1) The assessors of the various coun-
10    ties of the state shall be agents of the department and shall  perform  duties
11    prescribed  in  this  title.    With the concurrence of the department, a
12    county assessor may appoint one (1) or more agents to perform the duties  pre-
13    scribed  in  chapters 4 and 5 of title 49, Idaho Code. Such agent shall post a
14    faithful performance bond in an amount and form acceptable to the  department.
15    The  assessor  may  negotiate  for  reasonable reimbursement of expenses to an
16    agent for any duties performed by the agent under terms of agreement with  the
17    county assessor. 
18        (2)  The county assessors shall receive and file in their respective offi-
19    ces  all  instruments required by chapter 5 of this title to be filed with the
20    county assessors, and shall maintain in their respective offices  indices  for
21    certificates  of title issued by the department which shall be kept alphabeti-
22    cally by the name of the owner.
23        (3)  It shall be the duty of peace officers within the state of  Idaho  to
24    enforce  and  make  arrests  for the violation of the provisions of this title
25    without the necessity of procuring a warrant. It shall be the duty  of  autho-
26    rized  employees  of  the  department  to  enforce compliance with the laws in
27    accordance with section 40-511, Idaho Code.

28        SECTION 2.  This act shall be in full force and effect on and after  Janu-
29    ary 1, 2000.

Statement of Purpose / Fiscal Impact


                         STATEMENT OF PURPOSE

                              RS08772

The purpose of this legislation is to allow County Assessors to
appoint agents such as vehicle dealerships, to perform vehicle
registration duties provided there is approval from the
department. This change will open the opportunity for expansion
of auto license services without the expense of new buildings
and personnel, while maintaining county assessor offices as
primary providers of auto license services in the State of
Idaho.

                            FISCAL NOTE

No fiscal impact is anticipated with this legislation. Minor
programming development would be completed by departmental
programming staff. Equipment costs would be assumed by agents
seeking to perform registration services.
