S1142|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE SENATE SENATE BILL NO. 1142 BY COMMERCE AND HUMAN RESOURCES COMMITTEE 1 AN ACT 2 RELATING TO INSURANCE BENEFITS FOR FAMILY PLANNING SERVICES; AMENDING CHAPTER 3 18, TITLE 41, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 41-1845, IDAHO 4 CODE, TO PROVIDE FOR INSURANCE BENEFITS FOR PRESCRIPTION CONTRACEPTIVE 5 DRUGS AND DEVICES AND FOR SURGICAL STERILIZATION PROCEDURES AND TO DEFINE 6 PRESCRIPTION CONTRACEPTIVE DRUGS AND DEVICES; AND TO PROVIDE APPLICATION 7 OF THIS ACT TO CONTRACTS, AGREEMENTS, POLICIES AND CERTIFICATES EXECUTED, 8 DELIVERED, ISSUED FOR DELIVERY, CONTINUED OR RENEWED IN THIS STATE ON AND 9 AFTER JULY 1, 1999, AND TO PROVIDE WHEN RENEWAL OCCURS. 10 Be It Enacted by the Legislature of the State of Idaho: 11 SECTION 1. That Chapter 19, Title 41, Idaho Code, be, and the same is 12 hereby amended by the addition thereto of a NEW SECTION , to be 13 known and designated as Section 41-1845, Idaho Code, and to read as follows: 14 41-1845. BENEFITS FOR FAMILY SERVICES PLANNING. For the purposes of chap- 15 ters 21, 22, 28, 32, 34, 39, 40, 47 and 52 of this title and notwithstanding 16 any other provision of law, cost-sharing requirement, benefit or service limi- 17 tation for outpatient or inpatient programs, any contract, agreement, policy 18 or certificate providing for reimbursement or payment to an insurance sub- 19 scriber, policyholder, insured or certificate holder or to any other person 20 for medical goods or services, or for reimbursement or payment provided under 21 any contract, agreement, policy or certificate for the payment of prescription 22 drugs shall include a provision for payment of FDA approved prescription con- 23 traceptive drugs and devices. 24 Additionally, a contract, agreement, policy or certificate which provides 25 payment for an uncomplicated pregnancy shall also include a provision for 26 payment for surgical sterilization procedures and FDA approved contraceptive 27 devices and services including methods which are injectable or implantable and 28 which are used to prevent unwanted pregnancy. 29 SECTION 2. APPLICATION. Except as otherwise provided, the requirements of 30 Section 41-1845, Idaho Code, apply to all contracts, agreements, policies and 31 certificates executed, delivered, issued for delivery, continued or renewed in 32 this state on and after July 1, 1999. For purposes of this act all contracts, 33 agreements, policies and certificates are deemed renewed no later than the 34 next yearly anniversary of the contract, agreement, policy or certificate 35 date.
STATEMENT OF PURPOSE RS08555 This bill requires insurance policies which provide for payment of prescription drugs to include coverage for contraceptive drugs and devices.This bill would also require policies which provide for payment of uncomplicated pregnancies to include contraceptive devices and services. "Contraception" means the prevention of pregnancy. FISCAL IMPACT An industry estimate of $2.00 to $3.00 per month per policy is projected.
