That Section 49-401A, Idaho Code, be, and the same is hereby 16 amended to read as follows: 17 49-401A. OWNER TO SECURE REGISTRATION FROM A COUNTY ASSESSOR OR THE 18 DEPARTMENT. (1) Every owner of a motor vehicle, trailer or semitrailer who 19 intends to operate the vehicle upon any highway in this state shall before the 20 same is so operated, apply to a county assessor and obtain registration for 21 vehicles in sections 49-402(1) through (53 ), 22 49-402A, 49-402B and 49-422, Idaho Code. All others shall be obtained from the 23 department except as provided in subsection (2) of this section. Owners of 24 vehicles specified in section 49-426, Idaho Code, are exempt from the provi- 25 sions of this section. Owners of vehicles operating on a temporary basis as 26 provided in sections 49-431(3), 49-432 and 49-433, Idaho Code, are exempt from 27 the provisions of this section to the extent that the temporary permits in use 28 are unexpired. 29 (2) Commercial vehicles in excess of twenty-six thousand (26,000) pounds 30 gross weight, farm and noncommercial vehicles in excess of sixty thousand 31 (60,000) pounds gross weight and all vehicles registered under section 49-435, 32 Idaho Code, shall be registered by the department. All other commercial, farm 33 and noncommercial vehicles and the vehicles in paragraphs (a), (b), and (c) of 34 this subsection, shall be registered by the county assessor. 35 (a) Motor vehicles equipped primarily to haul passengers on a commercial 36 basis, doing strictly an intrastate business, and having gross weights of 37 twenty-six thousand (26,000) pounds or less. 38 (b) Any farm vehicle or combination of vehicles where each vehicle or 39 combination of vehicles shall not exceed a gross weight of sixty thousand 40 (60,000) pounds. 41 (c) Nonresident vehicles or combination of vehicles owned by transient 42 labor used in hauling unprocessed agricultural products for hire and not 43 exceeding sixty thousand (60,000) pounds gross weight shall register their 2 1 vehicle for the appropriate gross weight scale for the annual fee if reg- 2 istered on or before June 30, and for one-half (1/2) the annual fee if not 3 registered until on or after July 1 of any year, with the assessor of the 4 county in which the owner resides. 5 (3) Commercial, farm and noncommercial vehicles of any weight doing 6 strictly an intrastate business may be registered by the county assessor by 7 mutual agreement between the department and the county. 8 SECTION 2. That Section 49-402, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 49-402. ANNUAL REGISTRATION. (1) The annual fee for operating each pickup 11 truck and each other motor vehicle having a maximum gross weight not in excess 12 of eight thousand (8,000) pounds, designed for the purpose of carrying13passengers and not used for hireshall be: 14 Vehicles one (1) and two (2) years old ............................ $48.00 15 Of the registration fees collected for vehicles one (1) and two (2) years 16 old, $36.48 shall be deposited to the highway distribution account and 17 $11.52 shall be deposited to the restricted highway fund. 18 Vehicles three (3) and four (4) years old ......................... $36.00 19 Of the registration fees collected for vehicles three (3) and four (4) 20 years old, $33.48 shall be deposited to the highway distribution account 21 and $2.52 shall be deposited to the restricted highway fund. 22 Vehicles five (5) and six (6) years old ........................... $36.00 23 Of the registration fees collected for vehicles five (5) and six (6) years 24 old, $26.28 shall be deposited to the highway distribution account and 25 $9.72 shall be deposited to the restricted highway fund. 26 Vehicles seven (7) and eight (8) years old ........................ $24.00 27 Of the registration fees collected for vehicles seven (7) and eight (8) 28 years old, $22.68 shall be deposited to the highway distribution account 29 and $1.32 shall be deposited to the restricted highway fund. 30 Vehicles over eight (8) years old ................................. $24.00 31 Of the registration fees collected for vehicles over eight (8) years old, 32 $16.08 shall be deposited to the highway distribution account and $7.92 33 shall be deposited to the restricted highway fund. 34 There shall be twelve (12) registration periods, starting in January for 35 holders of validation registration stickers numbered 1, and proceeding consec- 36 utively through December for holders of validation registration stickers num- 37 bered 12, each of which shall start on the first day of a calendar month and 38 end on the last day of the twelfth month from the first day of the beginning 39 month. Registration periods shall expire midnight on the last day of the reg- 40 istration period in the year designated by the validation registration 41 sticker. The numeral digit on the validation registration stickers shall, as 42 does the registration card, fix the registration period under the staggered 43 plate system of Idaho for the purpose of reregistration and notice of expira- 44 tion. 45 A vehicle that has once been registered for any of the above designated 46 periods shall, upon reregistration, be registered for the period bearing the 47 same number, and the registration card shall show and be the exclusive proof 48 of the expiration date of registration and licensing. Vehicles may be ini- 49 tially registered for less than a twelve (12) month period, or for more than a 50 twelve (12) month period, and the fee prorated on a monthly basis if the frac- 51 tional registration tends to fulfill the purpose of the monthly series regis- 52 tration system. 53 (2)For all motor vehicles equipped to carry passengers and oper-3 1ated primarily for hire exclusively within the limits of an incorporated city2and adjacent thereto, when the service outside the city is a part of a regular3service rendered inside the city, and for school buses operated either by a4nonprofit, nonpublic school or operated pursuant to a service contract with a5school district for transporting children to or from school or in connection6with school approved activities, the annual fee shall be twelve dollars and7forty-eight cents ($12.48).89(3) For all hearses, ambulances and wreckers the annual fee shall10be twenty-nine dollars and forty cents ($29.40), and these vehicles shall11bear passenger car plates. No operator of a hearse, ambulance, or wrecker12shall be entitled to operate them by virtue of any dealer's license that may13have been issued under the provisions of this chapter.1415(4)For all motorcycles and all-terrain vehicles the annual 16 fee shall be nine dollars ($9.00). For operation of an ATV off the public 17 highways, the fee specified in section 67-7122, Idaho Code, shall also be 18 paid. Registration exemptions provided in section 49-426(2), Idaho Code, apply 19 to all-terrain vehicles and motorcycles used for the purposes described in 20 that subsection (2). 21 (53 ) For all motor homes the fee shall be as 22 specified in subsection (1) of this section and shall be in addition to the 23 fees provided for in section 49-445, Idaho Code. 24 (64 ) Registration fees shall not be subject to 25 refund. 26 (75 ) A financial institution or repossession 27 service contracted to a financial institution repossessing vehicles under the 28 terms of a security agreement shall move the vehicle from the place of repos- 29 session to the financial institution's place of business on a repossession 30 plate. The repossession plate shall also be used for demonstrating the vehicle 31 to a prospective purchaser for a period not to exceed ninety-six (96) hours. 32 The registration fees for repossession plates shall be as required in subsec- 33 tion (1) of this section for a vehicle one (1) and two (2) years old. All 34 other fees required under chapter 4, title 49, Idaho Code, shall be in addi- 35 tion to the registration fee. The repossession plate shall be issued on an 36 annual basis by the department. 37 (86 ) In addition to the annual registration fee 38 in this section, there shall be an initial program fee of twenty-five dollars 39 ($25.00) and an annual program fee of fifteen dollars ($15.00) for all special 40 license plate programs for those license plates issued pursuant to sections 41 49-404A, 49-407, 49-408, 49-409, 49-414, 49-416 and 49-418, Idaho Code. For 42 special plates issued pursuant to sections 49-406 and 49-406A, Idaho Code, 43 there shall be an initial program fee of twenty-five dollars ($25.00) but 44 there shall be no annual renewal fee. For special plates issued pursuant to 45 sections 49-417 ,and49-417A, 49-419 and 46 49-420, Idaho Code, there shall be an initial program fee of thirty- 47 five dollars ($35.00) and an annual program fee of twenty-five dollars 48 ($25.00). For special plates issued pursuant to section 49-418A, Idaho 49 Code, the initial program fee and the annual renewal fee shall be fifty dol- 50 lars ($50.00). The fees contained in this subsection shall be applica- 51 ble to all new special plate programs. The initial program fee and the annual 52 program fee shall be depositedin the state highway account and shall be53used to fund the cost of administration of special license plate programs54which are provided to the public as a personal alternative to the standard55license plate requirementsas specified by law for each program 4 1 . 2 SECTION 3. That Section 49-404A, Idaho Code, be, and the same is hereby 3 amended to read as follows: 4 49-404A. MEMBERS OF THE ARMED FORCES RESERVE -- SPECIAL PLATES. (1) Any 5 active member of the armed forces reserves of the United States who is the 6 owner of a vehicle registered under section 49-402(1) or section 49-434(1), 7 Idaho Code, may, upon application to the department, register not more than 8 two (2) motor vehicles and receive for each vehicle special license plates in 9 lieu of regular numbered plates. The provisions of this section shall not 10 apply to any vehicle with a registered maximum gross weight over sixteen thou- 11 sand (16,000) pounds. The special license plates shall be designated by the 12 department with the word "RESERVIST" centered along the bottom edge and be 13 numbered in sets of two (2) with a different number following appropriate let- 14 ters as follows: United States Army Reserve: Army (number); United States Navy 15 Reserve: Navy (number); United States Marine Corps Reserve: USMC (number); 16 United States Air Force Reserve: USAF (number); and United States Coast Guard 17 Reserve: USCG (number). Proof of being an active member in the United States 18 armed forces reserves must be furnished to the department before special 19 plates will be issued. Special license plates issued under this section shall 20 be issued under the staggered registration process provided for in section 21 49-402(1), Idaho Code, or the annual registration in section 49-434(1), Idaho 22 Code. 23 (2) Any branch of the armed forces reserves of the United States shall, 24 prior to an individual's discharge from duty in that branch of the armed 25 forces reserve, require that the special armed forces reserve license plates 26 either be turned back to the department or exchanged for other proper license 27 plates as a condition of discharge. 28 (3) In addition to the regular registration fees required in section 29 49-402(1) or 49-434(1), Idaho Code, the applicant shall pay the initial pro- 30 gram fee and the annual program fee specified in section 49-402(8)31, Idaho Code. The initial program fee and the annual program fee shall 32 be deposited in the state highway account and shall be used to fund the cost 33 of administration of this special license plate program which is provided to 34 the public as a personal alternative to the standard license plate require- 35 ment. When a plate holder transfers or assigns his title or interest in the 36 vehicle registered under this section, the registration shall expire, but the 37 special plates may be transferred to another vehicle upon payment of the 38 required transfer fee. Special plates shall only be displayed after receipt of 39 the new registration. 40 (4) The design and numbering scheme of the military reservist special 41 plate shall be coordinated by the department with representatives of the armed 42 forces reserves. However, the department shall have the final approval of the 43 plate design and numbering scheme to ensure conformity within existing issues 44 of plates and to contain costs within the limit of the fees received from 45 applicants. 46 SECTION 4. That Section 49-407, Idaho Code, be, and the same is hereby 47 amended to read as follows: 48 49-407. YEAR OF MANUFACTURE PLATE. Pursuant to rules of the department, 49 any person who is the owner of a motor vehicle thirty (30) years or older 50 which is registered under section 49-402(1) ,or (2),51 Idaho Code, or section 49-434(1), Idaho Code, may display on the rear of the 5 1 vehicle an authentic Idaho plate manufactured in the same year as the vehicle. 2 The provisions of this section shall not apply to any vehicle with a regis- 3 tered maximum gross weight over sixteen thousand (16,000) pounds. 4 In addition to the regular registration fees required in sections 5 49-402(1) ,and (2),and 49-434(1), Idaho Code, the 6 applicant shall pay the initial program fee and the annual program fee speci- 7 fied in section 49-402(8), Idaho Code. 8 SECTION 5. That Section 49-408, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 49-408. STREET ROD. (1) Any motor vehicle manufactured prior to the year 11 1949, or designed and manufactured to resemble such a vehicle and which has 12 been certified as a street rod may be registered as a street rod under the 13 provisions of this section. However, the provisions of this section shall not 14 apply to any vehicle with a registered maximum gross weight over sixteen thou- 15 sand (16,000) pounds. 16 (2) Any street rod shall have all equipment in operating condition which 17 was specifically required by law as a condition for its first sale after manu- 18 facture. No law requiring any particular equipment or specifying any standards 19 to be met by motor vehicles shall apply to street rods unless it so specifi- 20 cally states. 21 (3) Upon receipt of an application on a form prescribed by the department 22 for a special street rod automobile plate, accompanied by other documentation 23 required in this section, the department shall issue to the applicant a spe- 24 cial street rod automobile plate which shall be displayed on the rear of the 25 vehicle. The registration certificate need not specify the weight of the 26 street rod, and the plate issued shall bear no date but shall bear the 27 inscription "Street Rod," "Idaho," a picture of a 1929 highway roadster, and 28 the registration number issued for the street rod, and the plate shall be 29 valid upon annual renewal under section 49-402 or 49-434(1), Idaho Code, as 30 long as the vehicle is in existence. The plate will be issued for the 31 applicant's use only for the particular vehicle, and in the event of a trans- 32 fer of title, the transferor may hold the plate and transfer it to another 33 qualifying street rod. 34 (4) In addition to the regular registration fees required in section 35 49-402(1) or 49-434(1), Idaho Code, the applicant shall pay the initial pro- 36 gram fee and the annual program fee specified in section 49-402(8)37, Idaho Code. 38 (5) The department has the power to revoke any registration issued under 39 this section for cause shown for failure of the applicant to comply with the 40 provisions of this section. 41 SECTION 6. That Section 49-409, Idaho Code, be, and the same is hereby 42 amended to read as follows: 43 49-409. PERSONALIZED LICENSE PLATES. (1) Any person who is the owner of a 44 vehicle registered under section 49-402 or 49-434(1), Idaho Code, may apply to 45 the department for personalized license plates in lieu of regular numbered 46 plates except that this provision shall not apply to a vehicle registered 47 under section 49-434(1), Idaho Code, with a maximum gross weight over sixteen 48 thousand (16,000) pounds or any vehicle registered under section 49-435, Idaho 49 Code. In addition to the regular registration fees required in section 50 49-402(1), (2), (3)and (42 ), section 51 49-422, and section 49-434(1), Idaho Code, the applicant shall pay the initial 6 1 program fee and the annual program fee specified in section 49-402(8)2, Idaho Code. The personalized license plates shall be of the same color 3 and design as other license plates, and shall consist of numbers or letters, 4 or any combination thereof, not exceeding seven (7) positions. No more than 5 one (1) particular combination of letters and numbers shall be in existence at 6 any one (1) time. The form for application of the plates will be as prescribed 7 by the directorand, inwho, at his discretion, may 8 refuse to issue the plates. 9 (2) When personalized license plates are issued for a vehicle, the regu- 10 lar license plates for that vehicle belong to the registrant and may be trans- 11 ferred to another vehicle owned by the personalized plate applicant. 12 SECTION 7. That Section 49-414, Idaho Code, be, and the same is hereby 13 amended to read as follows: 14 49-414. LEGISLATIVE LICENSE PLATES -- FEES. (1) Special legislative 15 license plates shall be issued by the department upon application and payment 16 of the required fees. Each legislator is eligible to register and receive spe- 17 cial license plates for one (1) vehicle whose registered maximum gross weight 18 does not exceed sixteen thousand (16,000) pounds. The registration period 19 shall be for one (1) year, from January 1 through December 31, and may be 20 renewed, as long as the legislator holds office. The plates shall bear either 21 the inscription "House" or "Senate , ",shall contain 22 a consecutive numbering from one (1) through the maximum number of members in 23 each body with the numbers to be assigned by the speaker of the house of rep- 24 resentatives and the president pro tempore of the senate, and shall otherwise 25 comply with the provisions of section 49-443, Idaho Code. 26 (2) In addition to the regular registration fees required in section 27 49-402(1) or 49-434(1), Idaho Code, the applicant shall pay the initial pro- 28 gram fee and the annual program fee as specified in section 49-402(8)29, Idaho Code. 30 SECTION 8. That Section 49-416, Idaho Code, be, and the same is hereby 31 amended to read as follows: 32 49-416. STATEHOOD CENTENNIAL LICENSE PLATES. (1) Statehood centennial 33 license plates are available to owners of motor vehicles required to be regis- 34 tered under section 49-402(1) orsection 49-402(3) orsection 35 49-434(1), Idaho Code, upon application at a county assessor's office or at 36 the department. The provisions of this section shall not apply to any vehicle 37 with a registered maximum gross weight over sixteen thousand (16,000) pounds. 38 Availability of statehood centennial plates for other classes of vehicle reg- 39 istrations shall be as authorized by rule of the department. In addition to 40 the regular registration fees required in section 49-402(1) or 49-434(1), 41 Idaho Code, the applicant shall pay the initial program fee and the annual 42 program fee as specified in section 49-402(8), Idaho Code. All 43 revenues from such initial registration and annual renewal fees shall be 44 deposited in the highway distribution account. 45 (2) The statehood centennial license plates shall be of a color and 46 design approved by the department, utilizing a numbering system approved by 47 the board. The statehood centennial license plates must be surrendered upon 48 failure to pay the annual special fee and renewal fees. 49 (3) Any person who applies for statehood centennial license plates, may 50 also apply for personalized numbers and/or letters on those plates, as pro- 51 vided for in section 49-409, Idaho Code. 7 1 SECTION 9. That Section 49-418, Idaho Code, be, and the same is hereby 2 amended to read as follows: 3 49-418. VETERANS PLATES. (1) Any person who is the owner of a vehicle 4 registered under the provisions of section 49-402 or 49-434(1), Idaho Code, 5 may apply for and upon department approval receive special veterans license 6 plates in lieu of regular license plates. The provisions of this section shall 7 not apply to any vehicle with a registered maximum gross weight over sixteen 8 thousand (16,000) pounds. Availability of veterans plates for other vehicles 9 shall be subject to the rules, policies and procedures of the department. 10 (2) Proof of being a current or former member of the United States armed 11 forces must be furnished to the department before special veterans plates will 12 be issued. Acceptable proof shall be a copy of form DD214 or an equivalent 13 document or statement from the department of veterans affairs. 14 (3) In addition to the regular registration fees required in section 15 49-402(1) or 49-434(1), Idaho Code, the applicant shall pay the initial pro- 16 gram fee and the annual program fee specified in section 49-402(8)17, Idaho Code, and the plate fee specified in section 49-450, Idaho Code. 18 (4) Whenever title or interest in a vehicle registered under the provi- 19 sions of this section is transferred or assigned, the owner may transfer the 20 special plates to another vehicle upon payment of the required transfer fees. 21 The owner may only display the plates on another vehicle upon receipt of the 22 new registration from the department. 23 (5) The veterans license plate design shall include the colors red, white 24 and blue, shall designate one (1) of the five (5) branches of military ser- 25 vice, and display either: 26 (a) The word "VETERAN" or 27 (b) The name of a conflict or war period recognized by the United States 28 department of veterans affairs for the purpose of awarding federal vet- 29 erans benefits as defined in 38 U.S.C. 101(11). 30 The license plate design shall comply with all applicable rules of the depart- 31 ment, and shall include a separate and distinct numbering system. The design, 32 color, and numbering system shall be subject to approval of the department. 33 SECTION 10. This act shall be in full force and effect on and after Janu- 34 ary 1, 2000.
STATEMENT OF PURPOSE RS08958 This legislation increases registration fee's on vehicles over looked in registration adjustment. For these special plates issued, annual renewal fee shall be $50.00. FISCAL NOTE This legislation would collect approximately $19,000 additional registration fees annually. Approximately 26% ($5,000) of these fees would go into the Restricted Highway Fund.
