amount of sick leave that may be counted for determining the monetary value
of unused sick leave for retirement purposes for state employees with ten

                        BY COMMERCE AND HUMAN RESOURCES COMMITTEE

 1                                        AN ACT
 2    RELATING TO USE OF UNUSED SICK LEAVE  BY  STATE  EMPLOYEES;  AMENDING  SECTION
 3        67-5339, IDAHO CODE, TO INCREASE THE MAXIMUM AMOUNT OF SICK LEAVE THAT MAY
 4        BE  COUNTED  FOR  DETERMINING  THE MONETARY VALUE OF UNUSED SICK LEAVE FOR
 5        RETIREMENT PURPOSES FOR EMPLOYEES WITH A CERTAIN  LONGEVITY  AND  TO  MAKE
 6        TECHNICAL CORRECTIONS; AND PROVIDING AN EFFECTIVE DATE.

 7    Be It Enacted by the Legislature of the State of Idaho:

 8        SECTION  1.  That  Section 67-5339, Idaho Code, be, and the same is hereby
 9    amended to read as follows:

10        67-5339.  USE OF UNUSED SICK LEAVE. (1) Upon separation from state employ-
11    ment by retirement in accordance with chapter 13, title 59 or chapter 1, title
12    33, Idaho Code, an employee's unused sick leave shall be determined  based  on
13    accumulated  sick  leave  earned  subsequent  to  July  1,  1976, and shall be
14    reported by the employer to the public employee retirement system. A sum equal
15    to one-half (1/2), or the maximum  amount  allowed  by  subsection  (2)  
16    hereof      of this section , whichever is the lesser, of the
17    monetary value of such unused sick leave, calculated at the rate  of  pay  for
18    such  employee  at  the time of retirement, shall be transferred from the sick
19    leave account provided by subsection (3) of this section and shall be credited
20    to such employee's retirement account. Such sums shall be used  by  the  Idaho
21      P   p ublic  E  e mployee s
22      R  r etirement  B  b oard
23    to pay premiums for such group health, accident, and life  insurance  programs
24    as  may be maintained by the state, to the extent of the funds credited to the
25    employee's account pursuant to this section. Upon  an  employee's  death,  any
26    unexpended  sums  remaining  in  the  account  shall  revert to the sick leave
27    account.
28        (2)  For the purposes of determining the monetary  value  of  unused  sick
29    leave, the maximum unused sick leave which may be considered, shall be:
30        (a)  During the first ten thousand four hundred (10,400) hours of credited
31        state service, the maximum unused sick leave which may be considered shall
32        be  one   two  hundred  ninety-two  
33        forty  ( 19 2 40 ) hours;
34        (b)  During  the  second ten thousand four hundred (10,400) hours of cred-
35        ited state service, the maximum unused sick leave which may be  considered
36        shall  be    two   three  hundred  forty 
37        ( 24  30 0) hours;
38        (c)  During the third ten thousand four hundred (10,400) hours of credited
39        state service, the maximum unused sick leave which may be considered shall
40        be  two   three  hundred   eighty-eight  
41         sixty  ( 288  360 )  hours; and
42        (d)  Thereafter,  the  maximum  unused  sick leave which may be considered
43        shall be  three   four    hundred    thirty-six

 1          twenty  ( 336  420 ) hours.
 2        (3)  Each  employer  in  state government shall contribute to a sick leave
 3    account maintained by the public employee retirement  system  exclusively  for
 4    the  purpose  of the provisions of this section. The rate of such contribution
 5    each pay period shall consist of a percentage of employees' salaries as deter-
 6    mined by the board, and such rate shall remain in effect until next determined
 7    by the board. Any excess balance in the sick leave account shall be  invested,
 8    and  the  earnings therefrom shall accrue to the sick leave account except the
 9    amount required by the board to defray  administrative  expenses.  All  moneys
10    payable  to  the sick leave account are hereby perpetually appropriated to the
11    board, and shall not be included in its departmental budget.

12        SECTION 2.  This act shall be in full force and effect on and  after  July
13    1, 2000.

Statement of Purpose / Fiscal Impact


                       STATEMENT OF PURPOSE

This legislation increase unused sick leave benefit from a
maximum of 336 hours to 420 hours which may be considered upon
retirement. A sum equal to 1/2 of the monetary value of such
unused sick leave is used to pay premiums for health insurance.








                            FISCAL NOTE

It is estimated that raising the limits will increase the normal
cost of the program by 0.05% of pay (from .37% to .42% of pay)
and the amortization payments by .06% of pay (from .08% to .14%
of pay) for a total increase in the cost of the program of .11
of pay (from .45% to .56% of pay). The amount of employer
contributions for this program has been established at .658 of
pay. The difference between the minimum cost (currently
projected to be .45% of pay and estimated to be .56% of pay
under this bill) and the actual contribution rate has been
allocated to pay off the unfunded actuarial liability.

By allocating the difference between the minimum cost and the
actual cost to pay for additional benefit, the amount of time to
pay off the unfunded liability will increase by about 3.1 years
(from 6.1 years to 9.2 years) and because of the increased
benefits the amount of the unfunded liability will increase by
$4 million (from $5.6 million to $9.6 million).

By incorporating the cost of the additional benefit within the
existing rate structure and extending the amortization period
there will be no required increase in the percentage of pay
appropriated for this program.
