                                   SENATE BILL NO. 1193

 1                                        AN ACT
 2    RELATING TO ISSUANCE OF ANNUAL CONTRACTS TO SCHOOL DISTRICT EMPLOYEES;  AMEND-
 3        ING SECTION 33-514, IDAHO CODE, TO SPECIFY CERTAIN CRITERIA FOR EVALUATION
 4        OF CERTIFICATED EMPLOYEES.

 5    Be It Enacted by the Legislature of the State of Idaho:

 6        SECTION  1.  That  Section  33-514, Idaho Code, be, and the same is hereby
 7    amended to read as follows:

 8        33-514.  ISSUANCE OF ANNUAL CONTRACTS. The board of trustees shall  estab-
 9    lish  criteria  and  procedures for the supervision and evaluation of certifi-
10    cated employees who are not employed on a renewable contract, as provided  for
11    in  section 33-515, Idaho Code. Such procedures shall require at least one (1)
12    evaluation prior to the beginning of the second semester of  the  school  year
13    and the results of any such evaluation shall be made a matter of record in the
14    employee's  personnel  file.    Such evaluation criteria for certificated
15    employees shall include, but  not  be  limited  to,  the  student  achievement
16    results  for  the  students in the charge of the certificated employee. 
17    When any such employee's work is found  to  be  unsatisfactory  a   reasonable
18    period of probation shall be established by the board after which action shall
19    be  taken  by  the board as to whether the employee is to be retained, immedi-
20    ately discharged, discharged upon termination of the current contract or reem-
21    ployed at the end of the contract term under a continued probationary  status.
22    Notwithstanding  the provisions of sections 67-2344 and 67-2345, Idaho Code, a
23    decision to place certificated personnel on probationary status may be made in
24    executive session and the employee shall not be named in the  minutes  of  the
25    meeting.  A record of the decision shall be placed in the employee's personnel
26    file. This procedure shall not preclude recognition of unsatisfactory work  at
27    a subsequent evaluation and the establishment of a reasonable period of proba-
28    tion.  In all instances, the employee shall be duly notified in writing of the
29    areas of work which are deficient,  including  the  conditions  of  probation.
30    Through  the  third year of continuous employment by the same school district,
31    including any specially chartered district, each  such  certificated  employee
32    shall  be  given  notice, in writing, whether he or she will be reemployed for
33    the next ensuing year. Such notice shall be given by the board of trustees  no
34    later  than  the  fifteenth  day  of  June  of each such year. If the board of
35    trustees has decided not to  reemploy  the  certificated  employee,  then  the
36    notice  must contain a statement of reasons for such decision and the employee
37    shall, upon request, be given the opportunity for an informal review  of  such
38    decision by the board of trustees.

The purpose of this legislation is to specify that one component of
a certificated employees evaluation must include the achievement of
the students under the supervision of the certificated employee.
