 1                                        AN ACT
 2    APPROPRIATING MONEYS FOR VOCATIONAL EDUCATION FOR FISCAL YEAR  2000;  REAPPRO-
 3        PRIATING  ANY  UNEXPENDED  AND UNENCUMBERED GENERAL FUND BALANCES; SETTING
 4        FORTH CONDITIONS FOR THE REAPPROPRIATION;  EXPRESSING  LEGISLATIVE  INTENT
 5        WITH  RESPECT  TO  BOARD  POLICY;  AND  EXPRESSING LEGISLATIVE INTENT WITH
 6        RESPECT TO COOPERATIVE SERVICE  AGENCIES  QUALIFYING  AND  FUNCTIONING  AS
 7        PROFESSIONAL-TECHNICAL SCHOOLS.

 8    Be It Enacted by the Legislature of the State of Idaho:

 9        SECTION 1.  There is hereby appropriated to the State Board for Vocational
10    Education  the following amounts, to be expended by the Division of Vocational
11    Education for the designated programs  according  to  the  designated  expense
12    classes  from  the  listed funds for the period July 1, 1999, through June 30,

16        SECTION 2.  There is hereby reappropriated to the State  Board  for  Voca-
17    tional Education for the Division of Vocational Education, subject to the pro-
18    visions  of  Section 3 of this act, the unexpended and unencumbered balance of
19    any General Fund appropriation contained in Section 1, Chapter  323,  Laws  of
20    1998,  to  be  used for nonrecurring expenditures for the period July 1, 1999,
21    through June 30, 2000.

22        SECTION 3.  The reappropriation granted in Section 2 of this act shall  be
23    subject to the following provisions:
24        (1)  If  the  unexpended  and  unencumbered balance in the General Fund on
25    June 30, 1999, is zero, the reappropriation in Section 2 of this act is hereby
26    declared to be null and void.
27        (2)  If the unexpended and unencumbered balance in  the  General  Fund  on
28    June  30,  1999, is greater than zero but less than the total General Fund re-
29    appropriation authority granted to all state agencies, the amount  reappropri-
30    ated in Section 2 of this act shall be in the proportion that the reappropria-
31    tion  for the Division of Vocational Education bears to the total General Fund
32    reappropriation authority granted to all state agencies.

33        SECTION 4.  It is legislative intent that the State Board  for  Vocational
34    Education  evaluate board policy on allocation of state appropriations for new
35    and existing vocational programs. The evaluation shall consider the issues  of
36    retention of quality instructors and market demands for vocational training.

37        SECTION  5.  A  cooperative  service agency as provided in Section 33-317,
38    Idaho Code, may qualify and function as a professional-technical  school  pro-
39    vided  that  the criteria outlined in Section 33-1002G, Idaho Code, and by the
40    State Board for Vocational Education for approval of vocational-technical pro-
41    grams have been met. A cooperative service agency  operating  a  professional-
42    technical  school meeting requirements of subsections (1), (2) and (3) of Sec-
43    tion 33-1002G, Idaho Code, would also be deemed  as  meeting  requirements  of
44    subsections (4) and (5) of Section 33-1002G, Idaho Code.

This appropriation includes carry-over authority for any unexpended and unencumbered FY
1999 funds.  It also provides lump sum spending authority for Postsecondary Programs
only.  Section 4 contains legislative intent language directing the State Board for
Vocational Education to evaluate the allocation of funds for new and existing vocational
programs.  Section 5 contains legislative intent language regarding cooperative service
agencies operating professional-technical schools.
