SCR131|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE SENATE SENATE CONCURRENT RESOLUTION NO. 131 BY FINANCE COMMITTEE 1 A CONCURRENT RESOLUTION 2 AUTHORIZING THE DEPARTMENT OF PARKS AND RECREATION AND THE DEPARTMENT OF LANDS 3 TO ENTER INTO AGREEMENTS WITH THE IDAHO STATE BUILDING AUTHORITY TO 4 FINANCE AND ACQUIRE PROPERTY TO EXCHANGE FOR ENDOWMENT LANDS ADJOINING 5 PONDEROSA PARK IN MCCALL, IDAHO. 6 Be It Resolved by the Legislature of the State of Idaho: 7 WHEREAS, the Department of Parks and Recreation has demonstrated the need 8 for expanded facilities at Ponderosa Park in McCall, Idaho, and the state of 9 Idaho owns certain endowment lands and improvements adjoining Ponderosa Park 10 suitable for expanded facilities at Ponderosa Park to enhance public services; 11 and 12 WHEREAS, the Board of Land Commissioners and the Department of Lands agree 13 to exchange existing state endowment lands and improvements adjoining 14 Ponderosa Park for other suitable property; and 15 WHEREAS, the Idaho State Building Authority is empowered to acquire, 16 finance and provide facilities to the state of Idaho. 17 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session 18 of the Fifty-fifth Idaho Legislature, the Senate and the House of Representa- 19 tives concurring therein, that the Legislature hereby authorizes and provides 20 approval for the Department of Parks and Recreation and the Department of 21 Lands to enter into an agreement or agreements with the Idaho State Building 22 Authority, under such terms and conditions as may be reasonable and necessary, 23 to provide financing, to the extent necessary after available state appropri- 24 ated funds are applied, to acquire and exchange property for endowment lands 25 and improvements adjoining Ponderosa Park, and to make such exchanged property 26 available for use by the Department of Parks and Recreation. 27 BE IT FURTHER RESOLVED that this Resolution constitutes authorization 28 required by the provisions of Section 67-6410, Idaho Code.
STATEMENT OF PURPOSE
RS 09153
This Concurrent Resolution authorizes the Department of Parks
and Recreation and the Department of Lands to enter into
agreements with the State Building Authority to finance and
acquire and exchange property for three endowment land parcels
adjacent to Ponderosa State Park. The three parcels total about
56 acres and have an estimated value of about $7.6 million. This
proposal was approved last year by the Legislature and funded in
the Parks and Recreation appropriation. The resolution is
required because the State Building Authority will be financing
the project.
FISCAL NOTE
The funds for this land exchange have already been appropriated
to the Department of Parks and Recreation in the amount of an
on-going $1,000,000 in General Eunds. Under an agreement with
the Department of Lands, the Department of Lands will identify
other property with like value to the endowment lands. The State
Building authority will finance the acquisition of that like-value property, and exchange that property for the endowment
lands adjacent to the park. Parks and Recreation will then repay
the State Building Authority over about nine years with their
annual appropriaton of $1,000,000 which is currently in their
appropriated budget.
