                           SENATE CONCURRENT RESOLUTION NO. 132

                             BY JUDICIARY AND RULES COMMITTEE

 1                               A CONCURRENT RESOLUTION
 2    STATING FINDINGS OF THE LEGISLATURE AND CHARGING THE DIRECTOR OF  THE  DEPART-
 3        MENT  OF HEALTH AND WELFARE AND THE ADMINISTRATOR OF THE DIVISION OF ENVI-
 4        RONMENTAL QUALITY TO REFRAIN FROM COMMITMENTS PURSUANT TO THE KYOTO PROTO-
 5        COL.

 6    Be It Resolved by the Legislature of the State of Idaho:

 7        WHEREAS, it is appropriate that the Legislature express the intent of  the
 8    state   of  Idaho  concerning  new  regulatory  programs  intended  to  reduce
 9    greenhouse gas emissions pursuant to the terms of the Kyoto Protocol; and
10        WHEREAS, the Protocol has not yet received Senate ratification nor  imple-
11    menting legislation from the Congress of the United States; and
12        WHEREAS,  we conclude that action by the state of Idaho at this time would
13    be premature.
14        NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
15    of the Fifty-fifth Idaho Legislature, the Senate and the House of  Representa-
16    tives  concurring  therein,  that  we charge the Director of the Department of
17    Health and Welfare and the Administrator  of  the  Division  of  Environmental
18    Quality  to  refrain from proposing or promulgating any new rules intended, in
19    whole or in part, to reduce emissions of greenhouse gases, as such  gases  are
20    defined  by  the Kyoto Protocol, from the residential, commercial, industrial,
21    utility or transportation sectors.
22        BE IT FURTHER RESOLVED that in the absence of legislative authorization to
23    do so, the Director of the Department of Health and Welfare and  the  Adminis-
24    trator of the Division of Environmental Quality shall not submit to the United
25    States  Environmental  Protection Agency or to any other agency of the Federal
26    Government any legally enforceable commitments related  to  the  reduction  of
27    greenhouse gases, as such gases are defined by the Kyoto Protocol.
28        BE  IT FURTHER RESOLVED that nothing in this resolution shall be construed
29    to limit or to impede state or private participation in any ongoing  voluntary
30    initiatives to reduce emissions of greenhouse gases including, but not limited
31    to,  the United States Environmental Protection Agency's Green Lights program,
32    the United States Department of Energy's Climate Challenge program, and  simi-
33    lar state and federal initiatives relying on voluntary participation, provided
34    however, that such participation does not involve any allocation or other dis-
35    tribution  of  greenhouse gas emission entitlements pursuant to or under color
36    of the Kyoto Protocol.
