  1                                        AN ACT
  2    RELATING TO  MASTER  ELECTRICIANS;  AMENDING  SECTIONS  54-1002,  54-1006  AND
  3        54-1017,  IDAHO CODE, TO DELETE JOURNEYMAN IN REFERENCE TO MASTER ELECTRI-
  4        CIANS; AND PROVIDING AN EFFECTIVE DATE.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  That Section 54-1002, Idaho Code, be, and the same  is  hereby
  7    amended to read as follows:
                                                                        
  8        54-1002.  LICENSE  ESSENTIAL  TO ENGAGE IN BUSINESS -- LICENSURE AUTHORITY
  9    EXCLUSIVE TO THE STATE. (1) It shall be unlawful for any person,  partnership,
 10    company,  firm,  association  or corporation, to act, or attempt to act, as an
 11    electrical contractor or special electrical contractor  in  this  state  until
 12    such  person,  partnership,  company,  firm, association or corporation, shall
 13    have received a license as an electrical contractor, as herein defined, issued
 14    pursuant to the provisions of this chapter by the administrator of  the  divi-
 15    sion of building safety.
 16        (2)  It  shall  be unlawful for any person to act as a journeyman electri-
 17    cian in this state until such person shall have received a license as a  jour-
 18    neyman  electrician,  as  herein defined, issued pursuant to the provisions of
 19    this act, by the administrator of the division of building  safety,  provided,
 20    however,  that  any  person who has been issued a master electrician's license
 21    pursuant to this chapter may act as a journeyman electrician.
 22        (3)  It shall be unlawful for any person to act as a specialty electrician
 23    in this state until such person shall have received a license as  a  specialty
 24    electrician, as herein defined, issued pursuant to the provisions of this act,
 25    by  the  administrator  of  the division of building safety, provided however,
 26    that any person who has been issued a master journeyman electrician's  license
 27    or  a  journeyman electrician's license pursuant to this act may act as a spe-
 28    cialty electrician.
 29        (4)  Licensure of electrical contractors, journeyman electricians,  master
 30    journeyman electricians, specialty electricians, specialty electrical contrac-
 31    tors and registration of apprentice electricians shall be within the exclusive
 32    jurisdiction  of  the state pursuant to this chapter and no local jurisdiction
 33    shall have the authority to require additional licensure or to issue  licenses
 34    to  persons licensed under this chapter which are inconsistent with the provi-
 35    sions of this chapter or rules promulgated by the division of building safety.
 36    The state shall investigate all local infractions and state violations of this
 37    chapter and prosecute the same. The local jurisdictions will assist the  state
 38    by requesting investigations within their jurisdictions. Nothing in this chap-
 39    ter  shall  restrict  a  city  or  county from imposing stricter public safety
 40    rules, notwithstanding any provision of Idaho Code.
                                                                        
 41        SECTION 2.  That Section 54-1006, Idaho Code, be, and the same  is  hereby
 42    amended to read as follows:

  1        54-1006.  IDAHO  ELECTRICAL BOARD. (1) The Idaho electrical board, herein-
  2    after known as the board, is hereby created and made a part of the division of
  3    building safety. It shall be the responsibility and duty of the  administrator
  4    of the division of building safety to administer and enforce the provisions of
  5    this  act, to serve as secretary to the Idaho electrical board, and to appoint
  6    the chief electrical inspector.
  7        (2)  The board shall consist of nine (9) members to be  appointed  by  the
  8    governor  with  power  of removal for cause. Two (2) members shall be licensed
  9    journeymen or master electricians; two (2) members shall be employees or offi-
 10    cers of licensed electrical contractors; one (1) member shall  be  a  licensed
 11    specialty  journeyman  or  contractor;  one (1) member shall be an employee or
 12    officer of an electrical power provider; one (1) member shall be  an  employee
 13    or  officer of a manufacturing plant or other large power user; one (1) member
 14    shall be an employee or director of a manufacturer or distributor of  electri-
 15    cal  supplies  or  materials;  and  one (1) member shall be from the public at
 16    large not directly associated with  the  electrical  industry.  Board  members
 17    shall  be  appointed  for a term of four (4) years. Whenever a vacancy occurs,
 18    the governor shall appoint a qualified person to  fill  the  vacancy  for  the
 19    unexpired portion of the term.
 20        (3)  All members of the board shall be citizens of the United States, res-
 21    idents of this state for not less than two (2) years and shall be qualified by
 22    experience,  knowledge and integrity in formulating rules for examinations, in
 23    passing on the fitness and qualifications of applicants  for  electrical  con-
 24    tractor  and journeyman electrician licenses and in establishing standards for
 25    electrical products to be used in electrical installations  coming  under  the
 26    provisions of this act.
 27        (4)  The  members  of the board shall, at their first regular meeting fol-
 28    lowing the effective date of this act and  every  two  (2)  years  thereafter,
 29    elect  by majority vote of the members of the board, a chairman who shall pre-
 30    side at meetings of the board. In the event the chairman is not present at any
 31    board meeting, the board may by majority vote of the members present appoint a
 32    temporary chairman. A majority of the members of the board shall constitute  a
 33    quorum.
 34        (5)  The  board  is  authorized  and directed to prescribe and amend rules
 35    consistent with this act for the administration of this chapter and to  effec-
 36    tuate the purpose thereof, and for the examination and licensing of electrical
 37    contractors,  journeyman  electricians,  master  journeyman electricians, spe-
 38    cialty electricians, specialty electrical  contractors,  specialty  electrical
 39    trainees and apprentice electricians. The board shall also establish the clas-
 40    sifications  for  specialty  electrician  and  specialty electrical contractor
 41    licensing and the fees to be charged for permits and inspections of electrical
 42    systems. The board shall establish by administrative rule the fines to be paid
 43    for citations issued for violations of this act and the  rules  of  the  Idaho
 44    electrical board.
 45        (6)  Each  member  of the board not otherwise compensated by public moneys
 46    shall be compensated as provided by section 59-509(g), Idaho Code.
                                                                        
 47        SECTION 3.  That Section 54-1017, Idaho Code, be, and the same  is  hereby
 48    amended to read as follows:
                                                                        
 49        54-1017.  VIOLATIONS  OF  ACT A MISDEMEANOR. Any person, partnership, com-
 50    pany, firm, association or corporation who shall engage in the trade, business
 51    or calling of an electrical contractor, journeyman electrician,  master  jour-
 52    neyman  electrician,  specialty  electrician, specialty electrical contractor,
 53    specialty electrical trainee or apprentice electrician without  a  license  or

  1    required registration as provided for by this act, or who shall violate any of
  2    the  provisions  of this act, or the rules of the Idaho electrical board or of
  3    the administrator of the division of building safety herein provided  for,  or
  4    who  shall refuse to perform any duty lawfully enjoined upon him by the admin-
  5    istrator within the prescribed time; or who shall fail, neglect, or refuse  to
  6    obey  any lawful order given or made by the administrator shall be guilty of a
  7    misdemeanor and shall be subject to the civil penalties established by  admin-
  8    istrative  rule  but  not to exceed one thousand dollars ($1,000). Each day of
  9    such violation shall constitute a separate offense. A violation will  be  con-
 10    sidered  a  second or additional offense only if it occurs within one (1) year
 11    from the first violation.
                                                                        
 12        SECTION 4.  This act shall be in full force and effect on and  after  July
 13    1, 2000.

Statement of Purpose / Fiscal Impact


                      STATEMENT OF PURPOSE

House Bill 25 of the 1999 Idaho Legislature amended Idaho Code
Title 54 Chapter 10 revising the term "Master Journeyman
Electrician" to "Master Electrician".  However, other legislation
of Idaho Code Title 54 Chapter 10 was in progress which contained
the old term in the text, though not related to this issue.  This
bill would ensure that the correct term is utilized throughout the
text.
