SPEAKER Requested by: Public Employee Retirement System of Idaho 1 AN ACT 2 RELATING TO THE PUBLIC EMPLOYMENT RETIREMENT SYSTEM; AMENDING CHAPTER 13, 3 TITLE 59, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 59-1365, IDAHO 4 CODE, TO AUTHORIZE THE PUBLIC EMPLOYEE RETIREMENT SYSTEM BOARD TO ESTAB- 5 LISH AND ADMINISTER AN UNUSED SICK LEAVE POOL FOR THE VOLUNTARY PARTICIPA- 6 TION OF PERSI EMPLOYERS; AND PROVIDING AN EFFECTIVE DATE. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Chapter 13, Title 59, Idaho Code, be, and the same is 9 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 10 ignated as Section 59-1365, Idaho Code, and to read as follows: 11 59-1365. VOLUNTARY UNUSED SICK LEAVE POOL. The board is authorized to 12 establish and administer an unused sick leave pool for the voluntary partici- 13 pation of employer units not eligible to participate in other statutorily cre- 14 ated sick leave arrangements. The pool shall be funded entirely by the con- 15 tributions of participating employer units and the board may charge reasonable 16 administrative expenses for administration. The requirements, rates and 17 parameters for participation in the pool will be set forth by rules of the 18 board. 19 SECTION 2. This act shall be in full force and effect on and after July 20 1, 2000.
STATEMENT OF PURPOSE
RS09340
PERSI currently administers unused sick leave accounts for state employees pursuant
to Idaho Code 67-5339, for school district employees pursuant to Idaho Code 33-
1228, and for junior college district employees pursuant to Idaho Code 33-2109A.
These accounts are used to continue payment of insurance premiums after an employee
retires. There is currently no provision authorizing PERSI to administer unused
sick leave plans for other PERSI employers such as cities or counties. Some
political subdivisions have expressed interest in participating in an unused sick
leave pool administered by PERSI.
This new section of Idaho Code authorizes PERSI to administer an unused sick
leave pool, similar to those currently authorized for state employees and
public school employees, for political subdivisions wishing to participate
on a voluntary basis. Many entities currently pay these accrued amounts
directly to retirees upon separation. This will offer local governmental
entities a vehicle to make the payments tax-free to retirees. The PERSI
board is given authority to design and administer the program through
rulemaking.
FISCAL IMPACT
Costs associated with initial start-up of the program are estimated at
$50,000. This includes staff time, rulemaking costs, system changes, and
other miscellaneous costs. After initial start-up, ongoing administrative
costs are estimated to start at $4,000 per year, with annual increases
depending on the level of participation.
