  1                                        AN ACT
  2    RELATING TO STATE CHARITABLE INSTITUTIONS;  AMENDING  SECTION  66-1106,  IDAHO
  3        CODE,  TO  PROVIDE  A  CORRECT REFERENCE TO THE STATE JUVENILE CORRECTIONS
  4        INSTITUTIONS FUND; AND PROVIDING AN EFFECTIVE DATE.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  That Section 66-1106, Idaho Code, be, and the same  is  hereby
  7    amended to read as follows:
                                                                        
  8        66-1106.  CHARITABLE  INSTITUTIONS  FUND -- TRANSFER OF MONEYS TO SEPARATE
  9    FUNDS. Any and all moneys hereafter accruing to said  charitable  institutions
 10    fund  shall  be forthwith transferred and credited to the following designated
 11    funds in the following proportions, respectively, to wit:
 12        To the Idaho State University fund, four-fifteenths (4/15) thereof;
 13        To  the  State  Juvenile  Corrections  Center  Institutions  fund,   four-
 14    fifteenths (4/15) thereof;
 15        To the State Hospital North fund, four-fifteenths (4/15) thereof;
 16        To the Veterans Home fund, five-thirtieths (5/30) thereof;
 17        To the School for the Deaf and Blind fund, one-thirtieth (1/30) thereof.
                                                                        
 18        SECTION  2.  This  act shall be in full force and effect on and after July
 19    1, 2000.

Statement of Purpose / Fiscal Impact


                      STATEMENT OF PURPOSE
RS09328

66-1103, Idaho Code, states that the Charitable Institutions Endowment Fund
is for " state charitable, educational, penal and reformatory institutions " 
66-1106 specifies that " the State Juvenile Corrections Center fund " is one
of its recipients. Since the Department of Juvenile Corrections was created by
the legislature in 1995, additional state juvenile correctional institutions
have been built. As a result, this language should be corrected to read " the
State Juvenile Correctional Institutions fund, "   to clarify that this fund
is to serve all State Juvenile Correctional institutions. This change would
also be consistent with the terminology and intention of 66-1103 and its
reference to "penal and reformatory institutions."

                         FISCAL IMPACT

This legislative idea would actually free up more state general funds by
clearly allowing use of this designated endowment fund to be used to fund all
juvenile correctional facilities, rather than just JCC-St. Anthony, which is
now one of three state facilities.
