  1                                        AN ACT
  2    RELATING TO THE STATE PERSONNEL SYSTEM; AMENDING SECTION 67-5309C, IDAHO CODE,
  3        TO ALLOW TEMPORARY PAY GRADES TO BE USED TO  RETAIN  QUALIFIED  EMPLOYEES;
  4        AND PROVIDING AN EFFECTIVE DATE.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION  1.  That Section 67-5309C, Idaho Code, be, and the same is hereby
  7    amended to read as follows:
                                                                        
  8        67-5309C.  PAY GRADES AND MERIT  INCREASES.  (a)  The  following  schedule
  9    establishes  the  pay  grades for all positions classified pursuant to chapter
 10    53, title 67, Idaho Code.

 27        (b)  It is hereby declared to be the intent of  the  legislature  that  an
 28    employee may expect to advance in the salary range to the labor market average
 29    rate  for the pay grade assigned to a classification. Advancement in pay shall
 30    be based solely on performance, including factors such as productivity,  reli-
 31    ability, effectiveness, and the ability to achieve the goals and objectives of
 32    the  particular  position. No employee shall advance in a salary range without
 33    performance evaluation by the employee's immediate supervisor, approved by the
 34    departmental director or the director's designee certifying that the  employee
 35    meets the performance criteria of the assigned position.
 36        (i)   When necessary to obtain or retain qualified personnel in a particu-
 37        lar  classification,  upon  petition  of  the  appointing authority to the
 38        administrator containing acceptable reasons therefor, a  higher  temporary
 39        pay  grade may be authorized by the administrator which, if granted, shall
 40        be reviewed annually to determine the need for continuance.
 41        (ii)  Each employee's work performance shall be evaluated after one  thou-
 42        sand  forty  (1,040) hours of credited state service from the date of ini-
 43        tial appointment or promotion and after each two thousand  eighty  (2,080)

  1        hours  of credited state service thereafter by his or her immediate super-
  2        visor. Employees may be eligible for advancement in pay, if  certified  as
  3        meeting  the  performance  requirements of subsection (b) of this section;
  4        however, such in-grade advancement shall not  be  construed  as  a  vested
  5        right.  The  department  director shall designate, upon agreement with the
  6        employee, whether  such in-grade advancement is temporary, conditional  or
  7        permanent.  It  shall be the specific responsibility of the supervisor and
  8        the departmental director to effect the evaluation prescribed  in  subsec-
  9        tion (b) of this section on an evaluation form approved by the administra-
 10        tor for that purpose.
 11        (iii) In  addition  to  pay increases authorized in paragraph (ii) of this
 12        subsection, the department director may grant a classified employee  hold-
 13        ing  permanent  status a lump sum bonus not to exceed one thousand dollars
 14        ($1,000) in any given fiscal year  based  upon  excellent  performance  as
 15        indicated  by  the performance evaluation as outlined in subsection (b) of
 16        this section. Exceptions to the one thousand dollar  ($1,000)  limit  pro-
 17        vided  in  this section may be granted if approved in advance by the state
 18        board of examiners.
                                                                        
 19        SECTION 2.  This act shall be in full force and effect on and  after  July
 20    1, 2000.

                      STATEMENT OF PURPOSE

This bill would provide agencies with a tool to address temporary 
labor fluctuations to retain qualified employees through the use 
of temporary pay grades.

                          FISCAL IMPACT 

The fiscal impact of this bill is indeterminate.  Funding would come 
from agency salary savings or specific Legislative appropriations.
