H0487|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 487 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO STATE PROPERTY; AMENDING CHAPTER 3, TITLE 58, IDAHO CODE, BY THE 3 ADDITION OF A NEW SECTION 58-330, IDAHO CODE, TO PROVIDE THAT THE DEPART- 4 MENT OF LANDS SHALL MAINTAIN A DATABASE TO CENTRALIZE THE DEEDS OF ALL FEE 5 SIMPLE PROPERTY AND ENCUMBRANCES THAT ARE OWNED BY THE STATE, TO PROVIDE 6 FOR STATE OWNED BUILDINGS TO BE INTEGRATED INTO THE DATABASE AND TO PRO- 7 VIDE FOR RULES; AND DECLARING AN EMERGENCY. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Chapter 3, Title 58, Idaho Code, be, and the same is 10 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 11 ignated as Section 58-330, Idaho Code, and to read as follows: 12 58-330. INTEGRATED PROPERTY RECORDS SYSTEM. (1) The department of lands 13 shall maintain a database to centralize the deeds of all fee simple property 14 and encumbrances that are owned by the state in the department's central 15 office. As deeds are collected by the employees or contractors of the depart- 16 ment, the deeds will be platted, errors and discrepancies will be identified, 17 researched and resolved and the clean records and plats shall be integrated 18 into a comprehensive geographic information system (GIS) database. The system 19 shall include all property rights, leases and easements for endowment, public 20 trust and other state lands. 21 (2) State owned buildings shall be integrated into the database enumer- 22 ated in subsection (1) of this section in necessary supplemental files. State 23 building leases shall be integrated into the database enumerated in subsection 24 (1) of this section in participation with the division of public works of the 25 department of administration. The department of lands shall integrate various 26 easements, rights-of-way and other nonfee simple property rights except those 27 held and administered by the Idaho transportation department. 28 (3) The department may promulgate necessary rules to implement the provi- 29 sions of this section. 30 SECTION 2. An emergency existing therefor, which emergency is hereby 31 declared to exist, this act shall be in full force and effect on and after its 32 passage and approval.
STATEMENT OF PURPOSE RS09742 STATE BUILDINGS MANAGEMENT REFORM - This is the fifth in a package of six bills needed to improve cost-control and efficiency over management of state building facilities. At the present time the state does not have enterprise-wide knowledge of the real property it owns. Each agency maintains independent property records and the quality and existence of legal documentation is not certain. This legislation establishes a central registry or "integrated property records system" for all state-owned and leased real estate. The records, to the extent not already done, will be researched, documented and cataloged by the Department of Lands (DOL) and integrated into a comprehensive Geographic Information System (GIS) database. The database will include state-owned buildings and leases administered by the Department of Administration - Division of Public Works, institutions of higher education and all other state agencies. The following information will be available for free over the Internet: Ownership of land by primary classification (Federal, state, county, city and private), topographical maps, road-street maps, air photographs, site location of state owned and leased buildings and general information about those buildings. (Air photographs of Idaho is now near completion.) This information will, among other things, facilitate many state agency decisions regarding real estate as well as prove valuable to the public. FISCAL IMPACT DOL estimates this work will require 2 FTEs beginning in FY2001, total budgeted costs of $112,000 and 3-5 years to research, catalogue and legally document and perfect all of the state's real estate records. Offsetting this cost will be cost savings realized by state agencies. However, the amount of such savings cannot be determined.
