1 AN ACT
2 RELATING TO THE SOCIAL WORK ACT; AMENDING SECTION 54-3215, IDAHO CODE, TO PRO-
3 VIDE AN EXEMPTION FROM THE SOCIAL WORK LICENSING ACT FOR EMPLOYEES OF CER-
4 TAIN HEALTH FACILITIES; REPEALING SECTION 54-3215, IDAHO CODE; AMENDING
5 CHAPTER 32, TITLE 54, IDAHO CODE, BY THE ADDITION OF A NEW SECTION
6 54-3215, IDAHO CODE, TO PROVIDE FOR EXEMPTIONS FROM THE SOCIAL WORK
7 LICENSING ACT; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE.
8 Be It Enacted by the Legislature of the State of Idaho:
9 SECTION 1. That Section 54-3215, Idaho Code, be, and the same is hereby
10 amended to read as follows:
11 54-3215. EXEMPTIONS. Nothing within this act shall be construed to pre-
12 vent any person from doing work within the standards and ethics of their
13 respective professions or calling provided they do not hold themselves out to
14 the public by title or description of service as being engaged in social work
15 practice. Students enrolled in a recognized program of social work leading to
16 a degree may practice only under the direct supervision of a certified social
17 worker or social worker licensed under this act. This act shall not apply to
18 any employee of any facility licensed under section 39-1301(a), Idaho Code,
19 section 39-1301(b), Idaho Code, or section 39-1301(c), Idaho Code, who is des-
20 ignated in writing to be responsible for that facility's social services pro-
21 gram and who receives regular consultation from a qualified social worker.
22 SECTION 2. That Section 54-3215, Idaho Code, be, and the same is hereby
23 repealed.
24 SECTION 3. That Chapter 32, Title 54, Idaho Code, be, and the same is
25 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
26 ignated as Section 54-3215, Idaho Code, and to read as follows:
27 54-3215. EXEMPTIONS. Nothing within this act shall be construed to pre-
28 vent any person from doing work within the standards and ethics of their
29 respective professions or calling provided they do not hold themselves out to
30 the public by title or description of service as being engaged in social work
31 practice. Students enrolled in a recognized program of social work leading to

34 SECTION 4. An emergency existing therefor, which emergency is hereby
35 declared to exist, Section 1 of this act shall be in full force and effect on
36 and after its passage and approval; and Sections 2 and 3 of this act shall
37 become effective on and after July 2, 2001.

2 On page 1 of the printed bill, delete lines 19 through 21 and insert:

19 CORRECTIONS TO TITLE
20 On page 1, in line 3, following "WORK" insert: "LICENSING"; in line 4,
21 delete "AND" and insert: "REPEALING SECTION 54-3215, IDAHO CODE; AMENDING
22 CHAPTER 32, TITLE 54, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 54-3215,
23 IDAHO CODE, TO PROVIDE FOR EXEMPTIONS FROM THE SOCIAL WORK LICENSING ACT;" and
24 also in line 4, following "EMERGENCY" insert: "AND PROVIDING AN EFFECTIVE
25 DATE".
STATEMENT OF PURPOSE

The purpose of this legislation is to clearly exempt from the law relating to social
work, employees of health care facilities who are designated in writing to be
responsible for that facility's social services program and who receive regular
consultation from a qualified social worker. By clearly exempting social services
designees, this legislation will allow a practice to continue in Idaho which has
been permitted by Department of Health and Welfare rules since 1988.
FISCAL NOTE
There is no fiscal impact on the General Fund. By permitting health care
facilities to continue using social services designees, this legislation has the
potential to help health care facilities keep their costs relating to social services
down which will have a beneficial fiscal impact on the Medicaid program in the
future.
