H0644|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 644 BY TRANSPORTATION AND DEFENSE COMMITTEE 1 AN ACT 2 RELATING TO SPECIAL MOTOR VEHICLE LICENSE PLATES; AMENDING SECTION 49-402, 3 IDAHO CODE, TO PROVIDE A CORRECT REFERENCE AND TO CLARIFY DEPOSIT OF CER- 4 TAIN FEES; AMENDING CHAPTER 4, TITLE 49, IDAHO CODE, BY THE ADDITION OF A 5 NEW SECTION 49-420A, IDAHO CODE, TO ESTABLISH AN IDAHO STATE CAPITOL COM- 6 MISSION LICENSE PLATE PROGRAM; AND PROVIDING AN EFFECTIVE DATE. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Section 49-402, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 49-402. ANNUAL REGISTRATION. (1) The annual fee for operating each pickup 11 truck and each other motor vehicle having a maximum gross weight not in excess 12 of eight thousand (8,000) pounds shall be: 13 Vehicles one (1) and two (2) years old ............................ $48.00 14 Vehicles three (3) and four (4) years old ......................... $36.00 15 Vehicles five (5) and six (6) years old ........................... $36.00 16 Vehicles seven (7) and eight (8) years old ........................ $24.00 17 Vehicles over eight (8) years old ................................. $24.00 18 There shall be twelve (12) registration periods, starting in January for 19 holders of validation registration stickers numbered 1, and proceeding consec- 20 utively through December for holders of validation registration stickers num- 21 bered 12, each of which shall start on the first day of a calendar month and 22 end on the last day of the twelfth month from the first day of the beginning 23 month. Registration periods shall expire midnight on the last day of the reg- 24 istration period in the year designated by the validation registration 25 sticker. The numeral digit on the validation registration stickers shall, as 26 does the registration card, fix the registration period under the staggered 27 plate system of Idaho for the purpose of reregistration and notice of expira- 28 tion. 29 A vehicle that has once been registered for any of the above designated 30 periods shall, upon reregistration, be registered for the period bearing the 31 same number, and the registration card shall show and be the exclusive proof 32 of the expiration date of registration and licensing. Vehicles may be ini- 33 tially registered for less than a twelve (12) month period, or for more than a 34 twelve (12) month period, and the fee prorated on a monthly basis if the frac- 35 tional registration tends to fulfill the purpose of the monthly series regis- 36 tration system. 37 (2) For all motorcycles and all-terrain vehicles the annual fee shall be 38 nine dollars ($9.00). For operation of an ATV off the public highways, the fee 39 specified in section 67-7122, Idaho Code, shall also be paid. Registration 40 exemptions provided in section 49-426(2), Idaho Code, apply to all-terrain 41 vehicles and motorcycles used for the purposes described in that subsection 42 (2). 43 (3) For all motor homes the fee shall be as specified in subsection (1) 2 1 of this section and shall be in addition to the fees provided for in section 2 49-445, Idaho Code. 3 (4) Registration fees shall not be subject to refund. 4 (5) A financial institution or repossession service contracted to a 5 financial institution repossessing vehicles under the terms of a security 6 agreement shall move the vehicle from the place of repossession to the finan- 7 cial institution's place of business on a repossession plate. The reposses- 8 sion plate shall also be used for demonstrating the vehicle to a prospective 9 purchaser for a period not to exceed ninety-six (96) hours. The registration 10 fees for repossession plates shall be as required in subsection (1) of this 11 section for a vehicle one (1) and two (2) years old. All other fees required 12 under chapter 4, title 49, Idaho Code, shall be in addition to the registra- 13 tion fee. The repossession plate shall be issued on an annual basis by the 14 department. 15 (6) In addition to the annual registration fee in this section, there 16 shall be an initial program fee of twenty-five dollars ($25.00) and an annual 17 program fee of fifteen dollars ($15.00) for all special license plate programs 18 for those license plates issued pursuant to sections 49-404A, 49-407, 49-408, 19 49-409, 49-414, 49-416 and 49-418, Idaho Code. For special plates issued pur- 20 suant to sections 49-406 and 49-406A, Idaho Code, there shall be an initial 21 program fee of twenty-five dollars ($25.00) but there shall be no annual 22 renewal fee. For special plates issued pursuant to sections 49-417, 49-417A, 23 49-417B, 49-418A, 49-419, 49-419A,and49-420 and 49-420A, Idaho Code, there 24 shall be an initial program fee of thirty-five dollars ($35.00) and an annual 25 program fee of twenty-five dollars ($25.00).For special plates issued pursu-26ant to section 49-418A, Idaho Code, the initial program fee and the annual27renewal fee shall be fifty dollars ($50.00).The fees contained in this sub- 28 section shall be applicable to all new special plate programs. The initial 29 program fee and the annual program fee shall be depositedasin the state 30 highway account and shall be used to fund the cost of administration of spe- 31 cial license plate programs, unless otherwise specified by law.for each pro-32gram.33 SECTION 2. That Chapter 4, Title 49, Idaho Code, be, and the same is 34 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 35 ignated as Section 49-420A, Idaho Code, and to read as follows: 36 49-420A. IDAHO STATE CAPITOL COMMISSION PLATES. (1) On and after January 37 1, 2001, any person who is the owner of a vehicle registered under the provi- 38 sions of section 49-402, Idaho Code, or registered under any other section of 39 law for which the purchase of special plates is allowed, may apply for and 40 upon department approval receive special Idaho state capitol commission plates 41 in lieu of regular license plates. The provisions of this section shall not 42 apply to any vehicle with a registered maximum gross weight over twenty-six 43 thousand (26,000) pounds. Availability of Idaho state capitol commission 44 plates for other vehicles shall be subject to the rules, policies and proce- 45 dures of the department. 46 (2) In addition to the regular registration fee required in chapter 4, 47 title 49, Idaho Code, the applicant shall be charged a fee of thirty-five dol- 48 lars ($35.00) for the initial issuance of plates, and twenty-five dollars 49 ($25.00) upon each succeeding annual registration. Ten dollars ($10.00) of the 50 initial fee and ten dollars ($10.00) of the renewal fee shall be deposited in 51 the state highway account and shall be used to fund the cost of administration 52 of this special license plate program. Twenty-five dollars ($25.00) of each 53 initial fee and fifteen dollars ($15.00) of each renewal fee shall be depos- 3 1 ited by the state treasurer in the Idaho capitol endowment income fund estab- 2 lished pursuant to section 67-1611, Idaho Code, and shall be used exclusively 3 for the purposes of chapter 16, title 67, Idaho Code. 4 (3) Whenever title or interest in a vehicle registered under the provi- 5 sions of this section is transferred or assigned, the owner may transfer the 6 special plates to another vehicle upon payment of the required transfer fees. 7 The owner may only display the plates on another vehicle upon receipt of the 8 new registration from the department. 9 (4) Notwithstanding the provisions of section 49-402C, Idaho Code, the 10 Idaho state capitol commission license plate shall be of a color and design 11 acceptable to the Idaho state capitol commission, except that the word "Idaho" 12 shall appear on each plate and the county designator shall be omitted to pro- 13 vide for distinguishing designs and slogans. The design shall be approved by 14 the department, utilizing a numbering system as determined by the department. 15 Initial costs of the plate program, including costs of plate design, shall be 16 paid by the Idaho state capitol commission. 17 (5) Sample Idaho state capitol commission license plates may be purchased 18 for a fee of thirty dollars ($30.00), ten dollars ($10.00) of which shall be 19 deposited in the state highway account and twenty dollars ($20.00) of which 20 shall be deposited in the Idaho capitol endowment income fund. No additional 21 fee shall be charged for personalizing sample plates. 22 SECTION 3. This act shall be in full force and effect on and after Janu- 23 ary 1, 2001.
STATEMENT OF PURPOSE RS10116 The Idaho State Capitol Building was constructed from 1905-1920. There never has been a comprehensive restoration of the Capitol. The Idaho State Capitol Commission is attempting to complete the restoration of Idaho's Capitol Building in time for its centennial celebration on July 3, 2005. In addition to other private fund-raising efforts being pursued by the commission, this legislation would allow the creation of a special Capitol restoration license plate to help pay for Capitol renovations. A Capitol license plate would allow Idaho citizens to contribute funding to the restoration of their Capitol, and would help spread awareness throughout the state of the Capitol restoration effort. FISCAL NOTE This bill has no fiscal impact on the general fund. Based on previous experience with the Timber and Wildlife special plate programs, it is estimated that a specially designed Capitol license plate would raise between $100,000 and $150,000 per year for Capitol restoration efforts.
