H0672|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 672 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO FISH AND GAME; AMENDING SECTION 36-409, IDAHO CODE, TO PROVIDE FOR 3 AN IDAHO NURSING HOME FACILITY RESIDENT FISHING PERMIT AND TO PROVIDE WHAT 4 FACILITIES ARE ELIGIBLE TO PURCHASE THE PERMIT; AND AMENDING CHAPTER 4, 5 TITLE 36, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 36-416, IDAHO CODE, 6 TO PROVIDE A FEE FOR THE IDAHO NURSING HOME FACILITY RESIDENT FISHING PER- 7 MIT. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 36-409, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 36-409. GAME TAGS -- ARCHERY PERMITS -- FEES -- PENALTY. (a) Resident 12 Game Tags. A resident who has obtained a permit to hunt, as provided in sec- 13 tion 36-401, Idaho Code, or has purchased or obtained a license to hunt, as 14 provided in section 36-406, Idaho Code, upon payment of the fees provided 15 herein shall be eligible to receive a resident game tag to hunt and kill a 16 moose, bighorn sheep, mountain goat, elk, deer, antelope, mountain lion, bear, 17 or turkey in accordance with the laws of this state and rules promulgated by 18 the commission; provided further, that any person seventy (70) years of age or 19 older who holds a senior resident combination license, may be issued a bear, 20 deer or elk tag without charge; provided further, that resident game tags may 21 be issued only to those persons who meet residency requirements of subsection 22 (s) of section 36-202, Idaho Code. 23 (b) Nonresident Game Tags. A nonresident who has purchased a hunting 24 license, as provided in section 36-407(a), Idaho Code, or has obtained a 25 license to hunt, as provided in section 36-406(e), Idaho Code, upon payment of 26 the fees provided herein, shall be eligible to receive a nonresident tag to 27 hunt and kill a moose, bighorn sheep, mountain goat, elk, deer, antelope, 28 mountain lion, bear or turkey in accordance with the laws of this state and 29 rules promulgated by the commission. 30 (c) Schedule of Game Tag Fees. 31 Game Resident Nonresident 32 Moose $60.00 $900.00 33 Bighorn Sheep 60.00 900.00 34 Mountain Goat 60.00 900.00 35 Elk 21.00 331.00 36 Deer 15.00 231.00 37 Antelope 26.50 225.00 38 Mountain Lion 25.00 225.00 39 Bear 6.00 225.00 40 Turkey 6.00 35.00 41 Deer, Elk and Bear "Pak" 41.00 not applicable 42 (d) Game Tags Required. The appropriate tag must be had for the hunting 43 or taking of each and every one (1) of the aforementioned wildlife. Provided, 2 1 however, that the requirements for a mountain lion tag or a bear tag, as to 2 different periods of time and areas of the state, shall be determined and 3 specified by the commission. All of said tags are to bear and have serial num- 4 bers. 5 (e) Game Tag to Be Validated and Attached to Carcass. As soon as any per- 6 son kills any wildlife for which a tag is required, said tag, belonging to 7 him, must be validated and attached to said wildlife in a manner provided by 8 commission regulation. 9 (f) Archery Permits. In addition to meeting the license and tag require- 10 ments provided in this chapter, any persons participating in any controlled or 11 general game season which has been specifically designated as an archery hunt 12 must have in his possession an archery hunt permit which may be purchased at a 13 fee of seven dollars and fifty cents ($7.50). 14 (g) Muzzleloader Permit. In addition to meeting the license and tag 15 requirements provided in this chapter, any person participating in any con- 16 trolled or general game season which has been specifically designated as a 17 muzzleloader hunt must have in his possession a muzzleloader permit which may 18 be purchased at a fee of seven dollars and fifty cents ($7.50). 19 (h) Upland Game Bird Stamp. The commission may, under rules as it may 20 prescribe, issue an upland game bird stamp that must be purchased by all per- 21 sons over sixteen (16) years of age prior to hunting upland game birds, pro- 22 vided that a stamp shall not be required to hunt forest grouse (blue, ruffed 23 or spruce), sharp-tailed grouse, sage grouse, or turkey. The fee for such a 24 stamp shall be five dollars ($5.00) and the proceeds from the sale of such 25 stamps shall be utilized for the acquisition of state and federal lands or 26 interests of less than fee simple in private lands and the development, man- 27 agement, improvement, sale or exchange of upland game bird habitat in accor- 28 dance with Idaho fish and game commission order number 95-07. This subsection 29 shall be null and void and of no force and effect on and after July 1, 2000. 30 (i) Hound Hunter Permit. Any person using a dog for the purpose of hunt- 31 ing or for taking, as defined in section 36-202, Idaho Code, big game or 32 furbearing animals must have in his possession a valid hound hunter permit 33 which may be purchased for a fee of ten dollars ($10.00). 34 (j) Nonresident Bird of Prey Capture Permit. The commission may, under 35 rules as it may prescribe, issue a nonresident bird of prey capture permit. 36 This capture permit may be purchased by any licensed, nonresident falconer for 37 capturing birds of prey in Idaho. The fee for the permit shall be one hundred 38 dollars ($100) and the permit shall be issued under the condition that the 39 nonresident's home state allows reciprocal raptor capturing privileges for 40 Idaho falconers. Any funds in excess of those required to issue and administer 41 nonresident capture permits shall be used to issue and administer any resident 42 falconry program established by the commission. 43 (k) Wildlife Management Area (WMA) Pheasant Permit. The commission may, 44 under rules as it may prescribe, issue a wildlife management area pheasant 45 permit that must be purchased by all persons over sixteen (16) years of age 46 prior to hunting pheasants on state wildlife management areas designated by 47 the commission. The fee for the permit shall be ten dollars ($10.00). 48 (l) Idaho Nursing Home Facility Resident Fishing Permit. The commission 49 may, under rules as it may prescribe, issue an Idaho nursing home facility 50 resident fishing permit that must be purchased by an Idaho nursing home facil- 51 ity to allow residents of its facility to fish during the open season. Facil- 52 ities eligible to purchase this permit are: intermediate care facilities pro- 53 viding twenty-four (24) hour skilled nursing care, assisted living facilities 54 providing twenty-four (24) hour extensive assistance and skilled nursing 55 facilities providing twenty-four (24) hour skilled nursing. By purchasing 3 1 this permit the facility assumes full responsibility for and control over the 2 facility residents while using the permit. All laws, rules and proclamations 3 apply to the use of this permit and it is the responsibility of the facility 4 to assure compliance with the same. In case of a violation the facility shall 5 be held accountable and any citation(s) shall be issued to the facility. The 6 permit may be purchased for a fee as specified in section 36-416, Idaho Code. 7 SECTION 2. That Chapter 4, Title 36, Idaho Code, be, and the same is 8 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 9 ignated as Section 36-416, Idaho Code, and to read as follows: 10 36-416. STATEMENT OF PURPOSE RS 10143 The purpose of this bill is to allow a nursing home facility resident fishing permit to be purchased by the nursing home facility for $25.00 per year to allow all its residents to fish during the open season. This would correct the present situation which requires each participant to appear at the Department of Fish and Game to purchase an individual license, which is unreasonable, given the physical conditions of the residents.
