SCHOOL FACILITIES - Amends existing law relating to local land use planning
by requiring that any permit application submitted to a zoning commission
or a planning and zoning commission which relates to public school
facilities shall receive priority consideration and shall be reviewed by
the commission or the governing board at the earliest reasonable time,
regardless of the timing of its submission relative to other applications

  1                                        AN ACT
  2    RELATING TO LOCAL LAND USE PLANNING; AMENDING SECTION 67-6519, IDAHO CODE,  TO
  3        REQUIRE  THAT ANY PERMIT APPLICATION SUBMITTED TO A ZONING COMMISSION OR A
  4        PLANNING AND ZONING COMMISSION WHICH RELATES TO PUBLIC  SCHOOL  FACILITIES
  5        SHALL  RECEIVE PRIORITY CONSIDERATION AND SHALL BE REVIEWED BY THE COMMIS-
  6        SION OR THE GOVERNING BOARD AT THE EARLIEST REASONABLE TIME REGARDLESS  OF
  7        THE  TIMING OF ITS SUBMISSION RELATIVE TO OTHER APPLICATIONS WHICH ARE NOT
  8        RELATED TO PUBLIC SCHOOL FACILITIES AND TO MAKE TECHNICAL CORRECTIONS.
                                                                        
  9    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 10        SECTION 1.  That Section 67-6519, Idaho Code, be, and the same  is  hereby
 11    amended to read as follows:
                                                                        
 12        67-6519.  PERMIT  GRANTING  PROCESS.  As  part  of  ordinances required or
 13    authorized under this chapter, a procedure shall be established for processing
 14    in a timely manner applications for permits for which a reasonable fee may  be
 15    charged. Each application for a permit required or authorized under this chap-
 16    ter  shall  first be submitted to the zoning or planning and zoning commission
 17    for its recommendation or decision. The commission  shall  have  a  reasonable
 18    time  fixed  by the governing board to examine the application before the com-
 19    mission makes its decision on the permit or makes its  recommendation  to  the
 20    governing  board. Each commission or governing board shall establish by rule a
 21    time period within which a recommendation or decision must be  made.  Provided
 22    however,  any  permit  application  which  relates to a public school facility
 23    shall receive priority consideration  and  shall  be  reviewed  for  approval,
 24    denial  or recommendation by the commission or the governing board at the ear-
 25    liest reasonable time, regardless of the timing of its submission relative  to
 26    other applications which are not related to public school facilities. Whenever
 27    a governing board or zoning or planning and zoning commission grants or denies
 28    a permit, it shall specify:
 29        (a)  tThe ordinance and standards used in evaluating the application;
 30        (b)  tThe reasons for approval or denial; and
 31        (c)  tThe  actions, if any, that the applicant could take to obtain a per-
 32    mit.
 33        An applicant denied a permit or aggrieved by a decision may within twenty-
 34    eight (28) days after all remedies have been exhausted under  local  ordinance
 35    seek  judicial  review  under the procedures provided by chapter 52, title 67,
 36    Idaho Code.

                  STATEMENT OF PURPOSE
                       RS 10188

A need exists to provide priority consideration for a 
permit application on a public school facility. The local 
commission or governing board will hear at the earliest 
reasonable time regardless of the date of submission.
