  1                                        AN ACT
  2    RELATING TO THE PUBLIC  WORKS  CONTRACTORS  LICENSE  BOARD;  AMENDING  SECTION
  3        54-1905,  IDAHO  CODE,  TO  REPOSITION  THE BOARD WITHIN THE DEPARTMENT OF
  4        SELF-GOVERNING AGENCIES TO BE A PART OF THE DIVISION OF BUILDING SAFETY IN
  5        THE DEPARTMENT OF SELF-GOVERNING AGENCIES; AMENDING SECTION 67-2601, IDAHO
  6        CODE, TO REPOSITION THE BOARD  WITHIN  THE  DEPARTMENT  OF  SELF-GOVERNING
  7        AGENCIES TO BE A PART OF THE DIVISION OF BUILDING SAFETY IN THE DEPARTMENT
  8        OF SELF-GOVERNING AGENCIES AND TO MAKE TECHNICAL CORRECTIONS.
                                                                        
  9    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 10        SECTION  1.  That  Section 54-1905, Idaho Code, be, and the same is hereby
 11    amended to read as follows:
                                                                        
 12        54-1905.  PUBLIC WORKS CONTRACTORS LICENSE BOARD CREATED -- QUALIFICATIONS
 13    OF APPOINTEES -- TERM -- REMOVALS. There is hereby created and  made  part  of
 14    the division of building safety in the department of self-governing agencies a
 15    public  works  contractors  license board to be composed of seven (7) members,
 16    who shall be appointed by the governor. One (1) member of the board shall be a
 17    "heavy construction" contractor, one (1) member shall be a "highway  construc-
 18    tion"  contractor,  two  (2) members shall be "building construction" contrac-
 19    tors, one (1) member shall be a "specialty construction" contractor,  as  such
 20    construction  terms  are  defined  in  this chapter, one (1) member shall be a
 21    "construction manager," and one (1) member shall be a registered  professional
 22    engineer.  All  contractor members of the board shall be contractors holding a
 23    current unrevoked license at the time of their appointment,  actively  engaged
 24    in  the contracting business and have been so engaged for a period of not less
 25    than five (5) years preceding the date of their appointment, and who shall  so
 26    continue  in the contracting business during their term of office. Each member
 27    of the board next preceding his appointment shall have been a citizen and res-
 28    ident of the state of Idaho for at least five (5) years.  The  governor  shall
 29    appoint  a member to said board for a term of six (6) years. Each member shall
 30    hold office after the expiration of their own term until their  successor  has
 31    been  duly appointed and qualified. Vacancies on the board for any cause shall
 32    be filled by appointment by the governor for  the  balance  of  the  unexpired
 33    term. The governor may remove any member of the board for misconduct, incompe-
 34    tence or neglect of duty. Each member of the board shall receive a certificate
 35    of  appointment  from  the governor, and before entering upon the discharge of
 36    their duties, shall file with the secretary of state the  constitutional  oath
 37    of office.
                                                                        
 38        SECTION  2.  That  Section 67-2601, Idaho Code, be, and the same is hereby
 39    amended to read as follows:
                                                                        
 40        67-2601.  DEPARTMENT CREATED -- ORGANIZATION  --  DIRECTOR  --  BUREAU  OF
 41    OCCUPATIONAL  LICENSES  CREATED. (1) There is hereby created the department of

  1    self-governing agencies. The department shall, for the purposes of section 20,
  2    article IV of the constitution of the state of Idaho, be an executive  depart-
  3    ment of the state government.
  4        (2)  The department shall consist of the following:
  5        (a)  aAgricultural  commodity commissions: Idaho apple commission, as pro-
  6        vided by chapter 36, title 22, Idaho Code; Idaho bean commission, as  pro-
  7        vided by chapter 29, title 22, Idaho Code; Idaho beef council, as provided
  8        by  chapter 29, title 25, Idaho Code; Idaho cherry commission, as provided
  9        by chapter 37, title 22, Idaho Code; Idaho dairy products  commission,  as
 10        provided by chapter 31, title 25, Idaho Code; Idaho pea and lentil commis-
 11        sion,  as  provided by chapter 35, title 22, Idaho Code; Idaho potato com-
 12        mission, as provided by chapter 12, title 22, Idaho Code; Idaho prune com-
 13        mission, as provided by chapter 30, title 22, Idaho Code;  and  the  Idaho
 14        wheat commission, as provided by chapter 33, title 22, Idaho Code; and,
 15        (b)  pProfessional and occupational licensing boards: Idaho state board of
 16        certified  public  accountancy,  as provided by chapter 2, title 54, Idaho
 17        Code; board of architectural examiners, as provided by  chapter  3,  title
 18        54,  Idaho  Code;  office  of  the state athletic director, as provided by
 19        chapter 4, title 54, Idaho Code; board of barber examiners, as provided by
 20        chapter 5, title 54, Idaho Code; board of commissioners of the Idaho state
 21        bar, as provided by chapter 4, title 3, Idaho Code; board of  chiropractic
 22        physicians, as provided by chapter 7, title 54, Idaho Code; Idaho board of
 23        cosmetology,  as  provided by chapter 8, title 54, Idaho Code; Idaho coun-
 24        selor licensing board, as provided by chapter 34, title  54,  Idaho  Code;
 25        state  board of dentistry, as provided by chapter 9, title 54, Idaho Code;
 26        state board of denturitry, as provided by  chapter  33,  title  54,  Idaho
 27        Code;  state  board  of  engineering examiners, as provided by chapter 12,
 28        title 54, Idaho Code; board of environmental health specialists examiners,
 29        as provided by chapter 24, title 54, Idaho Code; state board for registra-
 30        tion of professional geologists, as provided  by  chapter  28,  title  54,
 31        Idaho Code; board of hearing aid dealers and fitters, as provided by chap-
 32        ter  29,  title 54, Idaho Code; Idaho state board of landscape architects,
 33        as provided by chapter 30, title 54, Idaho Code; state board of  medicine,
 34        as provided by chapter 18, title 54, Idaho Code, and its associated physi-
 35        cal  therapist  advisory board, as provided by chapter 22, title 54, Idaho
 36        Code; state board of morticians, as provided  by  chapter  11,  title  54,
 37        Idaho  Code;  board  of nurses, as provided by chapter 14, title 54, Idaho
 38        Code; board of examiners of nursing home administrators,  as  provided  by
 39        chapter 16, title 54, Idaho Code; state board of optometry, as provided by
 40        chapter  15,  title  54, Idaho Code; Idaho outfitters and guides board, as
 41        provided by chapter 21, title 36, Idaho Code; board of pharmacy,  as  pro-
 42        vided  by  chapter  17,  title 54, Idaho Code; state board of podiatry, as
 43        provided by chapter 6, title 54, Idaho Code; Idaho state board of psychol-
 44        ogist examiners, as provided by chapter 23, title 54, Idaho  Code;  public
 45        works  contractors  licensing  board, as provided by chapter 19, title 54,
 46        Idaho Code; Idaho real estate commission, as provided by chapter 20, title
 47        54, Idaho Code; real estate appraiser board, as provided  by  chapter  41,
 48        title 54, Idaho Code; board of social work examiners, as provided by chap-
 49        ter  32,  title  54, Idaho Code; the board of veterinary medicine, as pro-
 50        vided by chapter 21, title 54, Idaho Code; and the board of  examiners  of
 51        residential care facility administrators, as provided by chapter 42, title
 52        54, Idaho Code.
 53        (c)  tThe board of examiners, pursuant to section 67-2001, Idaho Code.
 54        (d)  tThe  division of building safety, to be headed by a division  admin-
 55        istrator and comprised of four (4) bureaus: plumbing,  electrical,  build-

  1        ings,  and  logging  and industrial safety. The division administrator and
  2        bureau chiefs shall be nonclassified employees exempt from the  provisions
  3        of  chapter  53,  title  67, Idaho Code. The administrator of the division
  4        shall administer the provisions of  chapter  40,  title  39,  Idaho  Code,
  5        relating  to  manufactured  homes  and  recreational vehicles; chapter 41,
  6        title 39, Idaho Code, relating to modular buildings; chapter 21, title 44,
  7        Idaho Code, relating to manufactured home  dealer  and  broker  licensing;
  8        chapter  10,  title 54, Idaho Code, relating to electrical contractors and
  9        journeymen; chapter 19, title 54, Idaho Code,  relating  to  licensing  of
 10        public  works  contractors;  chapter 26, title 54, Idaho Code, relating to
 11        plumbing and plumbers; and shall perform such  additional  duties  as  are
 12        imposed  upon  him by law. The division administrator shall cooperate with
 13        the industrial commission and aid and assist the commission in its  admin-
 14        istration  of  sections  72-720, 72-721 and 72-723, Idaho Code, and at the
 15        request of the commission shall  make  inspection  of  appliances,  tools,
 16        equipment,  machinery,  practices or conditions, and make a written report
 17        to the commission. The administrator shall  make  recommendations  to  the
 18        commission to aid the commission in its administration of sections 72-720,
 19        72-721 and 72-723, Idaho Code, provided however, that nothing herein shall
 20        be  construed as transferring to the administrator any of the authority or
 21        powers now vested in the industrial commission.
 22        (3)  The bureau of occupational licenses  is  hereby  created  within  the
 23    department of self-governing agencies.
