H0713|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 713 BY REVENUE AND TAXATION COMMITTEE 1 AN ACT 2 RELATING TO THE PUBLIC WORKS CONTRACTORS LICENSE BOARD; AMENDING SECTION 3 54-1905, IDAHO CODE, TO REPOSITION THE BOARD WITHIN THE DEPARTMENT OF 4 SELF-GOVERNING AGENCIES TO BE A PART OF THE DIVISION OF BUILDING SAFETY IN 5 THE DEPARTMENT OF SELF-GOVERNING AGENCIES; AMENDING SECTION 67-2601, IDAHO 6 CODE, TO REPOSITION THE BOARD WITHIN THE DEPARTMENT OF SELF-GOVERNING 7 AGENCIES TO BE A PART OF THE DIVISION OF BUILDING SAFETY IN THE DEPARTMENT 8 OF SELF-GOVERNING AGENCIES AND TO MAKE TECHNICAL CORRECTIONS. 9 Be It Enacted by the Legislature of the State of Idaho: 10 SECTION 1. That Section 54-1905, Idaho Code, be, and the same is hereby 11 amended to read as follows: 12 54-1905. PUBLIC WORKS CONTRACTORS LICENSE BOARD CREATED -- QUALIFICATIONS 13 OF APPOINTEES -- TERM -- REMOVALS. There is hereby created and made part of 14 the division of building safety in the department of self-governing agencies a 15 public works contractors license board to be composed of seven (7) members, 16 who shall be appointed by the governor. One (1) member of the board shall be a 17 "heavy construction" contractor, one (1) member shall be a "highway construc- 18 tion" contractor, two (2) members shall be "building construction" contrac- 19 tors, one (1) member shall be a "specialty construction" contractor, as such 20 construction terms are defined in this chapter, one (1) member shall be a 21 "construction manager," and one (1) member shall be a registered professional 22 engineer. All contractor members of the board shall be contractors holding a 23 current unrevoked license at the time of their appointment, actively engaged 24 in the contracting business and have been so engaged for a period of not less 25 than five (5) years preceding the date of their appointment, and who shall so 26 continue in the contracting business during their term of office. Each member 27 of the board next preceding his appointment shall have been a citizen and res- 28 ident of the state of Idaho for at least five (5) years. The governor shall 29 appoint a member to said board for a term of six (6) years. Each member shall 30 hold office after the expiration of their own term until their successor has 31 been duly appointed and qualified. Vacancies on the board for any cause shall 32 be filled by appointment by the governor for the balance of the unexpired 33 term. The governor may remove any member of the board for misconduct, incompe- 34 tence or neglect of duty. Each member of the board shall receive a certificate 35 of appointment from the governor, and before entering upon the discharge of 36 their duties, shall file with the secretary of state the constitutional oath 37 of office. 38 SECTION 2. That Section 67-2601, Idaho Code, be, and the same is hereby 39 amended to read as follows: 40 67-2601. DEPARTMENT CREATED -- ORGANIZATION -- DIRECTOR -- BUREAU OF 41 OCCUPATIONAL LICENSES CREATED. (1) There is hereby created the department of 2 1 self-governing agencies. The division administrator and 2 bureau chiefs shall be nonclassified employees exempt from the provisions 3 of chapter 53, title 67, Idaho Code. The administrator of the division 4 shall administer the provisions of chapter 40, title 39, Idaho Code, 5 relating to manufactured homes and recreational vehicles; chapter 41, 6 title 39, Idaho Code, relating to modular buildings; chapter 21, title 44, 7 Idaho Code, relating to manufactured home dealer and broker licensing; 8 chapter 10, title 54, Idaho Code, relating to electrical contractors and 9 journeymen; chapter 19, title 54, Idaho Code, relating to licensing of 10 public works contractors; chapter 26, title 54, Idaho Code, relating to 11 plumbing and plumbers; and shall perform such additional duties as are 12 imposed upon him by law. The division administrator shall cooperate with 13 the industrial commission and aid and assist the commission in its admin- 14 istration of sections 72-720, 72-721 and 72-723, Idaho Code, and at the 15 request of the commission shall make inspection of appliances, tools, 16 equipment, machinery, practices or conditions, and make a written report 17 to the commission. The administrator shall make recommendations to the 18 commission to aid the commission in its administration of sections 72-720, 19 72-721 and 72-723, Idaho Code, provided however, that nothing herein shall 20 be construed as transferring to the administrator any of the authority or 21 powers now vested in the industrial commission. 22 (3) The bureau of occupational licenses is hereby created within the 23 department of self-governing agencies.
