H0722|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 722 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO THE STATE DISASTER PREPAREDNESS ACT; AMENDING SECTION 46-1019, 3 IDAHO CODE, TO ADD A MEMBER TO THE EMERGENCY RESPONSE COMMISSION AND TO 4 MAKE TECHNICAL CORRECTIONS; AMENDING CHAPTER 10, TITLE 46, IDAHO CODE, BY 5 THE ADDITION OF A NEW SECTION 46-1025, IDAHO CODE, TO PROVIDE FOR PREPARA- 6 TION AND DISTRIBUTION OF A SUMMARY OF FEDERAL FUNDS GRANTED TO THE STATE 7 FOR DISASTER PREPAREDNESS AND TO PROVIDE FOR DISTRIBUTION OF FUNDS. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 46-1019, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 46-1019. EMERGENCY RESPONSE. (1) There is hereby created an emergency 12 response commission in the office of the governor. The commission shall con- 13 sist of the following state and local officials, industry representatives, or 14 their designees: the adjutant general of the Idaho national guard; the direc- 15 tor of the department of health and welfare; the state fire marshal; the 16 director of the department of law enforcement; the director of the Idaho 17 transportation department; the director of the department of agriculture; the 18 director of the department of lands; the director of the Idaho geological sur- 19 vey; the director of the department of water resources; the coordinator for 20 INEEL oversight; one (1) member representing Idaho cities; one (1) member of 21 an organization representing farmers or ranchers; one (1) member representing 22 Idaho counties; one (1) member representing the hazardous waste or materials 23 transportation industry; one (1) member representing a user of hazardous mate- 24 rials; one (1) member representing the Idaho state fire chief's association; 25 one (1) member representing the Idaho county sheriff's association; one (1) 26 member of the Idaho police chief's association; one (1) member representing 27 the Idaho emergency management association; and one (1) member at-large repre- 28 senting the citizens of the state of Idaho. The lastnineten (910) members 29 shall be appointed by the governor to serve staggered three (3) year terms. 30 The manager of the bureau of disaster services and the manager of the bureau 31 of hazardous materials shall be nonvoting members of the commission. All mem- 32 bers shall serve without compensation, except that members who are not state 33 officers or employees shall be compensated as provided in section 59-509(g), 34 Idaho Code. The governor shall appoint a chairman from the appointees. The 35 attorney general shall provide legal counsel to the commission. 36 (2) The commission shall act as an all-hazards advisory and coordinating 37 body to the governor for all types of disasters and emergencies which could 38 affect the citizens of Idaho. They shall review, evaluate, report and advise 39 the governor on state and local plans and programs to prepare for, respond to, 40 and recover from all types of disaster emergencies. 41 SECTION 2. That Chapter 10, Title 46, Idaho Code, be, and the same is 42 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 2 1 ignated as Section 46-1025, Idaho Code, and to read as follows: 2 46-1025. FEDERAL FUNDS TO POLITICAL SUBDIVISIONS. (1) Annually, the 3 chief of the Idaho bureau of disaster services shall prepare a written summary 4 of all grants received from the federal emergency management agency to be dis- 5 tributed to the forty-four (44) county commission chairmen. The summary shall 6 list those federal funds that are eligible for direct assistance to local 7 disaster agencies in accordance with section 46-1009(2), Idaho Code, and those 8 funds that are limited to use by the state and not eligible for direct assis- 9 tance to local disaster agencies. 10 (2) Not less than thirty-four percent (34%) of the eligible direct assis- 11 tance funds shall be subgranted by the Idaho bureau of disaster services to 12 the local disaster agencies. Funds shall be distributed to the local disaster 13 agencies subject to the provisions and regulations of the Idaho bureau of 14 disaster services, the federal emergency management agency through the Robert 15 T. Stafford Act, title 44 of the code of federal regulations, and pertinent 16 circulars published by the United States office of management and budget. 17 (3) Direct financial assistance to the local disaster agencies is not an 18 entitlement. Subgrants are awarded through the Idaho bureau of disaster ser- 19 vices for the purpose of assisting counties to achieve goals and objectives 20 outlined in an approved county grant proposal.
STATEMENT OF PURPOSE RS10139Cl This legislation amends Section 46-1019, Idaho Code, to add one member, representing the Idaho Emergency Management Association, to the Emergency Response Commission; and adds a new Section 46-1025, Idaho Code, which sets requirements for the Idaho Bureau of Disaster Services to distribute not less than thirty-four percent of eligible direct assistance funds from the Federal Emergency Management Agency (FEMA) to local disaster agencies. FISCAL NOTE No impact to state general fund. Funds are matched by local government. No impact to other state funds.
