APPROPRIATIONS - DEPARTMENT OF ENVIRONMENTAL QUALITY - Appropriates
$36,561,700 to the Department of Environmental Quality for fiscal year
2001; reappropriates unexpended and unencumbered fund balances of the
Cooperative Welfare Fund; limits the number of full-time equivalent
positions to 357.55; directs the transfer of $520,000 to the Environmental
Remediation Fund; provides intent regarding Bunker Hill remediation;
provides for the transfer of $500,000 from the Water Pollution Control Fund
to the General Fund; provides intent with regard to transfers of moneys
between programs; and appropriates an additional $150,000 to the Department
of Health and Welfare for the Division of Environmental Quality for fiscal
year 2001.

1 AN ACT
2 APPROPRIATING MONEYS TO THE DEPARTMENT OF ENVIRONMENTAL QUALITY FOR FISCAL
3 YEAR 2001; REAPPROPRIATING CERTAIN UNEXPENDED AND UNENCUMBERED BALANCES OF
4 MONEYS; LIMITING THE NUMBER OF FULL-TIME EQUIVALENT POSITIONS; PROVIDING
5 THAT THE STATE CONTROLLER SHALL MAKE TRANSFERS TO THE ENVIRONMENTAL
6 REMEDIATION FUND; EXPRESSING LEGISLATIVE INTENT REGARDING THE ENVIRONMEN-
7 TAL REMEDIATION FUND AND REQUIRING AN ANNUAL REPORT; TRANSFERRING MONEYS
8 FROM THE WATER POLLUTION CONTROL FUND TO THE GENERAL FUND; EXEMPTING THE
9 DEPARTMENT OF ENVIRONMENTAL QUALITY FROM THE TEN PERCENT TRANSFER BETWEEN
10 PROGRAMS LIMITATION; APPROPRIATING ADDITIONAL MONEYS TO THE DEPARTMENT OF
11 HEALTH AND WELFARE FOR THE DIVISION OF ENVIRONMENTAL QUALITY FOR FISCAL
12 YEAR 2000; AND DECLARING AN EMERGENCY FOR SECTION 8 OF THIS ACT.
13 Be It Enacted by the Legislature of the State of Idaho:
14 SECTION 1. There is hereby appropriated to the Department of Environmen-
15 tal Quality the following amounts to be expended for the designated programs
16 according to the designated expense classes from the various funds listed for
17 the period July 1, 2000, through June 30, 2001:

23 SECTION 2. There is hereby reappropriated to the Department of Environ-
24 mental Quality any unexpended and unencumbered balances of the Cooperative
25 Welfare DEQ Fund as appropriated for the Division of Environmental Quality for
26 fiscal year 2000, to be used for nonrecurring expenditures only for the period
27 July 1, 2000, through June 30, 2001. The Department of Environmental Quality
28 shall adjust the amount of reappropriation so as not to exceed available
29 moneys.
30 SECTION 3. In accordance with Section 67-3519, Idaho Code, the Department
31 of Environmental Quality is authorized no more than three hundred fifty-seven
32 and fifty-five hundredths (357.55) full-time equivalent positions at any point
33 during the period July 1, 2000, through June 30, 2001, unless specifically
34 authorized by the Governor. The Joint Finance-Appropriations Committee will be
35 notified promptly of any increased positions so authorized.
36 SECTION 4. Notwithstanding the provisions of Section 39-3630, Idaho Code,
37 the State Controller is hereby directed to transfer $520,000 from the Water
38 Pollution Control Fund to the Environmental Remediation Fund for the period
39 July 1, 2000, through June 30, 2001.
40 SECTION 5. It is legislative intent that moneys deposited into the Envi-
41 ronmental Remediation Fund are to be used solely for Bunker Hill remediation
42 within the site and that in accordance with the Bunker Hill Remedial Action
43 Management Plan, an annual report shall be filed no later than January 1 of
44 each year with the Governor, the Legislature, and the Bunker Hill Superfund
45 Task Force on the remediation progress and the expenditures involved.
46 SECTION 6. Notwithstanding the provisions of Section 39-3630, Idaho Code,
47 the State Controller is hereby directed to transfer $5,000,000 from the Water
48 Pollution Control Fund to the General Fund for the period July 1, 2000,
49 through June 30, 2001.

1 SECTION 7. To provide maximum flexibility, the Department of Environmen-
2 tal Quality is hereby exempted from the provisions of Section 67-3511(2),
3 Idaho Code, for all moneys appropriated to it for the period July 1, 2000,
4 through June 30, 2001. Transfers of moneys between the programs in this act
5 are still subject to the approval of the Division of Financial Management and
6 the Board of Examiners.
7 SECTION 8. In addition to the appropriation made in Section 1, Chapter
8 270, Laws of 1999, there is hereby appropriated to the Department of Health
9 and Welfare for the Division of Environmental Quality, the following amount to
10 be expended according to the designated expense class from the listed fund for
11 the period July 1, 1999, through June 30, 2000:

16 SECTION 9. An emergency existing therefor, which emergency is hereby
17 declared to exist, Section 8 of this act shall be in full force and effect on

This appropriation contains $65,000 to study the re-categorization of the Pocatello Aquifer from a general resource aquifer to a sensitive resource aquifer. The bill contains name changes resulting from the passage of S1426a which changed the Division of Environmental Quality to the Department of Environmental Quality and the Cooperative Welfare/DEQ Fund to the Department of Environmental Quality Fund. This legislation also contains a fund detail breakout by program for the Public Water System Supervision Fund as established by H602.
