APPROPRIATIONS - STATE TREASURER - Appropriates $1,848,500 to the State
Treasurer for fiscal year 2001; provides that moneys assessed for State
Treasurer banking services be placed in the Indirect Cost Recovery Fund and
provides for transfers of moneys from the fund; provides that $341,400 is
to be used only for the payment of bank service fees; reappropriates
unexpended and unencumbered fund balance to be used for nonrecurring
expenditures;  provides that $1,000 may be used to defray expenses
resulting from the discharge of the State Treasurer's official duties;
provides that the State Treasurer shall not pay for personnel costs from
any other funding sources outside of moneys appropriated for that purpose;
limits the number of full-time equivalent positions to 18; and appropriates

  1                                        AN ACT
  2    APPROPRIATING MONEYS TO THE STATE TREASURER FOR FISCAL  YEAR  2001;  PROVIDING
  3        FOR  THE RECOVERY OF BANKING SERVICES COSTS TO THE GENERAL FUND; AUTHORIZ-
  4        ING AN AMOUNT FOR PAYMENT OF BANK SERVICE  FEES;  REAPPROPRIATING  CERTAIN
  5        UNEXPENDED  AND  UNENCUMBERED  BALANCES TO THE STATE TREASURER; EXPRESSING
  6        LEGISLATIVE INTENT WITH RESPECT TO CERTAIN EXPENDITURES;  PROHIBITING  THE
  7        USE  OF UNAPPROPRIATED FUNDS FOR PAYING PERSONNEL COSTS; LIMITING THE NUM-
  8        BER OF FULL-TIME EQUIVALENT POSITIONS; APPROPRIATING ADDITIONAL MONEYS  TO
  9        THE  STATE  TREASURER FOR FISCAL YEAR 2000; AND DECLARING AN EMERGENCY FOR
 10        SECTION 8 OF THIS ACT.
                                                                        
 11    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 12        SECTION 1.  There is hereby appropriated to the State Treasurer  the  fol-
 13    lowing  amounts,  to  be  expended according to the designated expense classes
 14    from the listed funds, for the period July 1, 2000, through June 30, 2001:

 28        SECTION 2.  The moneys assessed by the Division of Financial Management in
 29    accordance with Section 67-3531, Idaho Code, for State Treasurer banking  ser-
 30    vices  shall  be  placed in the Indirect Cost Recovery Fund. On June 30, 2001,
 31    the State Controller shall transfer the moneys in the Indirect  Cost  Recovery
 32    Fund, up to a maximum of $1,301,400 to the state General Fund.
                                                                        
 33        SECTION  3.  Of the amount appropriated for Operating Expenditures in Sec-
 34    tion 1 of this act, $341,400, or so much thereof as is  necessary,  is  to  be
 35    used  solely and only for the payment of bank service fees for the period July
 36    1, 2000, through June 30, 2001, any other provisions of law notwithstanding.
                                                                        
 37        SECTION 4.  There is hereby reappropriated  to  the  State  Treasurer  the
 38    unexpended  and  unencumbered  balance  of any appropriation made to the State
 39    Treasurer from the State Treasurer LGIP Fund or the Treasurer's Office -  Pro-
 40    fessional  Services  Fund  for  fiscal  year 2000, to be used for nonrecurring
 41    expenditures only for the period July 1, 2000, through June 30, 2001.

  1        SECTION 5.  It is legislative intent that an amount, not to exceed  $1,000
  2    of  the  amount appropriated in Section 1 of this act, may be used at the dis-
  3    cretion of the State Treasurer to assist in defraying expenses relating to  or
  4    resulting  from  the  discharge of the State Treasurer's official duties. Such
  5    moneys shall be accounted for according to the provisions of Chapter 36, Title
  6    67, Idaho Code, and Section 67-3516, Idaho Code.
                                                                        
  7        SECTION 6.  The State Treasurer shall not pay for personnel costs from any
  8    other funding sources outside of the appropriations  made  for  that  purpose.
  9    This  provision shall be in force and valid in perpetuity, unless specifically
 10    repealed.
                                                                        
 11        SECTION 7.  In accordance with Section 67-3519, Idaho Code, the Office  of
 12    the State Treasurer is authorized no more than eighteen (18) full-time equiva-
 13    lent  positions  at any point during the period July 1, 2000, through June 30,
 14    2001, for the program specified in Section 1 of this act, unless  specifically
 15    authorized by the Governor. The Joint Finance-Appropriations Committee will be
 16    notified promptly of any increased positions so authorized.
                                                                        
 17        SECTION  8.  In  addition  to the appropriation made in Section 1, Chapter
 18    94, Laws of 1999, there is hereby appropriated to the State Treasurer the fol-
 19    lowing amount to be expended according to the designated  expense  class  from
 20    the listed funds for the period July 1, 1999, through June 30, 2000:

The Fiscal Year 2001 appropriation for the State Treasurer includes three enhancements. The first provides additional operating funds for the Local Government Investment Pool program. The second provides the funds necessary to hire a computer programmer position. The State Treasurer does not currently have a computer programmer position on staff. The third provides $15,000 for staff training. This training relates to the equity investments the State Treasurer will be making in managing the assets of the Idaho Millennium Fund.

This budget also includes Fiscal Year 2000 supplemental funding for legal fees and the cost of maintaining the State Treasurer’s cash management software. This bill removes standard classification controls for the State Treasurer’s dedicated funds by granting these funds as a lump sum budget. This bill also grants the State Treasurer carryover spending authority for dedicated funds.
