1 AN ACT
2 APPROPRIATING MONEYS TO THE DIVISION OF VETERANS SERVICES WITHIN THE DEPART-
3 MENT OF SELF-GOVERNING AGENCIES FOR FISCAL YEAR 2001; EXPRESSING LEGISLA-
4 TIVE INTENT WITH REGARD TO MAKING STATE VETERANS HOMES MEDICAID ELIGIBLE;
5 REAPPROPRIATING CERTAIN UNEXPENDED AND UNENCUMBERED BALANCES OF MONEYS;
6 AUTHORIZING THE EXPENDITURE OF ALL RECEIPTS COLLECTED; AND LIMITING THE
7 NUMBER OF FULL-TIME EQUIVALENT POSITIONS.
8 Be It Enacted by the Legislature of the State of Idaho:
9 SECTION 1. There is hereby appropriated to the Division of Veterans Ser-
10 vices within the Department of Self-Governing Agencies the following amount,
11 to be expended from the listed funds for the period July 1, 2000, through June
12 30, 2001:

20 SECTION 2. It is the intent of the Idaho Legislature that the Division of
21 Veterans Services and the Department of Health and Welfare take the steps nec-
22 essary to make state veterans homes providers of services under the state's
23 Medicaid Program on or before February 1, 2001. It is further the intent of
24 the Idaho Legislature that for the period July 1, 2000, through June 30, 2001,
25 the cost limits described in Section 56-102(7) and Section 56-102(11), Idaho
26 Code, shall not apply to state homes for veterans. In addition, the Department
27 of Health and Welfare is directed to provide a status report on making this
28 conversion to the Joint Finance-Appropriations Committee at each of their reg-
29 ularly scheduled interim committee meetings.
30 SECTION 3. There is hereby reappropriated to the Division of Veterans
31 Services within the Department of Self-Governing Agencies any unexpended and
32 unencumbered balances of the Cooperative Welfare Fund as appropriated for Vet-
33 erans Services for fiscal year 2000, to be used for nonrecurring expenditures
34 only for the period July 1, 2000, through June 30, 2001. The reappropriation
35 shall be computed by the Department of Health and Welfare from available
36 moneys.
37 SECTION 4. Notwithstanding the provisions of Section 67-3516(2), Idaho
38 Code, the Division of Veterans Services within the Department of Self-Govern-
39 ing Agencies is hereby authorized to expend all receipts collected within the
40 Division of Veterans Services as noncognizable funds for the period July 1,
41 2000, through June 30, 2001.

1 SECTION 5. In accordance with Section 67-3519, Idaho Code, the Division
2 of Veterans Services is authorized no more than two hundred fifty-five and
3 thirty-two hundredths (255.32) full-time equivalent positions at any point
4 during the period July 1, 2000, through June 30, 2001, unless specifically
5 authorized by the Governor. The Joint Finance-Appropriations Committee will be
6 notified promptly of any increased positions so authorized.
