HCR039|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE HOUSE OF REPRESENTATIVES HOUSE CONCURRENT RESOLUTION NO. 39 BY BUSINESS COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND AUTHORIZING THE LEGISLATIVE COUNCIL TO 3 APPOINT A COMMITTEE TO UNDERTAKE AND COMPLETE A STUDY OF THE FEASIBILITY 4 OF ADOPTING STATEWIDE BUILDING CODES, TO RECOMMEND A PROCESS FOR THE 5 REVIEW OF BUILDING PLANS AND SITE INSPECTIONS FOR COMPLIANCE WITH ACCESSI- 6 BILITY STANDARDS PRESCRIBED BY THE FEDERAL GOVERNMENT, TO PROVIDE FOR MAN- 7 DATORY CERTIFICATION OF INSPECTORS IF DEEMED ADVISABLE, TO INVESTIGATE 8 REVIEW OF SCHOOL BUILDING PLANS AND ENFORCEMENT OF INSPECTION FINDINGS AND 9 COMPLIANCE WITH APPLICABLE BUILDING CODES, TO REVIEW BIDDING PRACTICES FOR 10 FAIRNESS AND UNIFORMITY, AND TO REEXAMINE THE MEMBERSHIP OF ADVISORY AND 11 RULEMAKING BOARDS WITHIN THE DIVISION OF BUILDING SAFETY. 12 Be It Resolved by the Legislature of the State of Idaho: 13 WHEREAS, the Legislative Council Interim Committee on Construction Indus- 14 try Laws completed its charge to review laws and recommend reorganization of 15 government entities with authority for the regulation of construction industry 16 activities as directed by the provisions of House Concurrent Resolution No. 17 19, of the First Regular Session of the Fifty-fifth Idaho Legislature; and 18 WHEREAS, during the course of its meetings during the 1999 interim, the 19 committee became aware of additional issues which affect the general safety, 20 quality and uniformity of building construction in this state; and 21 WHEREAS, the 1999 interim committee was unable to address these related 22 issues because it was restricted by time and the terms of its resolution to 23 recommendations of a specific nature; and 24 WHEREAS, at the present time the state has no statewide, uniform building 25 codes; and 26 WHEREAS, there is a need to create a process by which building plans are 27 reviewed and site inspections are conducted for compliance with accessibility 28 standards as required by federal laws and regulations; and 29 WHEREAS, inspections of construction projects, and thereby the public 30 safety, is compromised by the absence of mandatory inspector certification; 31 and 32 WHEREAS, the safety of Idaho school students is an important priority and 33 the apparent lack of uniform and enforced review of school building plans and 34 inspections of school buildings should be investigated; and 35 WHEREAS, school building plans should be reviewed for compliance with 36 applicable building codes; and 37 WHEREAS, bidding practices are not uniform and often are not fair; and 38 WHEREAS, advisory and rulemaking boards within the Division of Building 39 Safety should be reexamined as to the number of members on the various boards 40 and the relevance of member positions to the scope of responsibilities and 41 expertise required of the various boards; and 42 WHEREAS, it is timely and advisable to continue the work of the 1999 43 Interim Committee on Construction Industry Laws by addressing these issues 44 which have been identified and are in need of legislative attention. 2 1 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses- 2 sion of the Fifty-fifth Idaho Legislature, the House of Representatives and 3 the Senate concurring therein, that the Legislative Council is authorized to 4 appoint an interim committee to undertake and complete a study of the feasi- 5 bility of adopting statewide building codes, to recommend a process for the 6 review of building plans and site inspections for compliance with accessibil- 7 ity standards prescribed by the federal government, to provide for mandatory 8 certification of inspectors if it is deemed advisable, to review bidding prac- 9 tices for fairness and uniformity, and to reexamine the membership of advisory 10 and rulemaking boards within the Division of Building Safety. The Legislative 11 Council shall determine the number of legislators and membership from each 12 house appointed to the committee and shall authorize the committee to receive 13 input, advice and assistance from interested and affected parties who are not 14 members of the legislature. 15 BE IT FURTHER RESOLVED that nonlegislative members of the committee may be 16 appointed by the cochairs of the committee who are appointed by the Legisla- 17 tive Council. Nonlegislative members of the advisory committee shall not be 18 reimbursed from legislative funds for per diem, mileage or other expenses and 19 shall not have voting privileges regarding the committee's recommendations or 20 proposed legislation. 21 BE IT FURTHER RESOLVED that the committee shall report its findings, rec- 22 ommendations and proposed legislation, if any, to the First Regular Session of 23 the Fifty-sixth Idaho Legislature.
STATEMENT OF PURPOSE RS 09406 This resolution would authorize the Legislative Council to appoint an interim committee to undertake and complete a study of statewide uniform building codes with emphasis on statewide school building code. FISCAL IMPACT If this resolution is adopted by the Legislature and the committee is appointed by Legislative Council, any necessary legislator travel and per diem expense could be paid from the existing legislative appropriation to the Senate and the House of Representatives. Funding for staff support and expenses would be provided from the existing appropriation to the Legislative Council for the Legislative Services Office. There would be no additional impact upon the state general fund as a result of this resolution.
