HCR050|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE HOUSE OF REPRESENTATIVES HOUSE CONCURRENT RESOLUTION NO. 50 BY STATE AFFAIRS COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND AUTHORIZING THE LEGISLATIVE COUNCIL TO 3 APPOINT A COMMITTEE TO UNDERTAKE AND COMPLETE A STUDY OF THE ANNEXATION 4 LAWS AND THE LOCAL PLANNING ACT. 5 Be It Resolved by the Legislature of the State of Idaho: 6 WHEREAS, the Idaho House of Representatives considered House Bill No. 538, 7 As Amended, which would have provided for an election by a city under certain 8 circumstances if residents of the area proposed to be annexed voiced a certain 9 level of opposition; and 10 WHEREAS, representatives of the Association of Idaho Cities agreed to meet 11 and confer regarding this important issue of annexation during the legislative 12 interim; and 13 WHEREAS, annexation, along with the planning process contained in Chapter 14 65, Title 67, Idaho Code, deserves to be studied as the Comprehensive Plan- 15 ning Act is over 25 years old and could stand to be reviewed to modernize it 16 so that it is a vital, useful tool for the future; and 17 WHEREAS, the subject of city annexation and areas of city impact has been 18 a topic of discussion throughout the state and has generated great contro- 19 versy; and 20 WHEREAS, other states have innovative ways of planning and ways of manag- 21 ing growth and also have alternative forms of government that are innovative 22 and modern and deserve review. 23 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses- 24 sion of the Fifty-fifth Idaho Legislature, the House of Representatives and 25 the Senate concurring therein, that the Legislative Council is authorized to 26 appoint a committee to undertake and complete a study of the state's annex- 27 ation laws as well as the Local Planning Act and a review of other state's 28 laws and mechanisms for planning, annexation and alternative forms of local 29 government. The Legislative Council shall determine the number of legislators 30 and membership from each house appointed to the committee and shall authorize 31 the committee to receive input, advice and assistance from interested and 32 affected parties who are not members of the Legislature. 33 BE IT FURTHER RESOLVED that nonlegislative members of the committee may be 34 appointed by the cochairs of the committee who are appointed by the Legisla- 35 tive Council. Nonlegislative members of the advisory committee shall not be 36 reimbursed from legislative funds for per diem, mileage or other expenses and 37 shall not have voting privileges regarding the committee's recommendations or 38 proposed legislation. 39 BE IT FURTHER RESOLVED that the Legislature recommends that no city shall 40 begin forced annexation proceedings until the committee completes its study 41 and deliberations. 42 BE IT FURTHER RESOLVED that the committee shall report its findings, rec- 43 ommendations and proposed legislation, if any, to the First Regular Session of 44 the Fifty-sixth Idaho Legislature.
STATEMENT OF PURPOSE RS10279 To authorize the legislative council to appoint a committee to study the annexation laws and the local planning act. FISCAL IMPACT If this resolution is adopted by the legislature and the committee is appointed by legislative council, any necessary legislator travel and per diem expenses would be paid from the existing leg. appropriation to the Senate and House of Representatives. Funding for staff support and expenses would be provided from the existing appropriation to the legislative council for the legislative services office. There would be no additional impact upon the state general fund as a result of this resolution.
