HJR002|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE HOUSE OF REPRESENTATIVES HOUSE JOINT RESOLUTION NO. 2 BY STATE AFFAIRS COMMITTEE 1 A JOINT RESOLUTION 2 PROPOSING AN AMENDMENT TO ARTICLE XX OF THE CONSTITUTION OF THE STATE OF 3 IDAHO, BY THE ADDITION OF A NEW SECTION 5, ARTICLE XX OF THE CONSTITUTION 4 OF THE STATE OF IDAHO, RELATING TO QUALIFICATIONS FOR CONSTITUTIONAL 5 OFFICE, TO PROVIDE THAT QUALIFICATIONS FOR CONSTITUTIONAL OFFICES ARE 6 EXCLUSIVE AND THE LEGISLATURE SHALL NOT HAVE THE POWER TO CHANGE, ADD TO 7 OR DIMINISH SUCH QUALIFICATIONS EXCEPT BY AMENDMENT TO THE CONSTITUTION OF 8 THE STATE OF IDAHO OR BY CONSTITUTIONAL CONVENTION WHEREBY THE PROPOSED 9 REVISION SHALL BE SUBMITTED TO, AND ADOPTED BY, THE PEOPLE; STATING THE 10 QUESTION TO BE SUBMITTED TO THE ELECTORATE; DIRECTING THE LEGISLATIVE 11 COUNCIL TO PREPARE THE STATEMENTS REQUIRED BY LAW; AND DIRECTING THE SEC- 12 RETARY OF STATE TO PUBLISH THE AMENDMENT AND ARGUMENTS AS REQUIRED BY LAW. 13 Be It Resolved by the Legislature of the State of Idaho: 14 SECTION 1. That Article XX of the Constitution of the State of Idaho be, 15 and the same is hereby amended by the addition thereto of a NEW SECTION, to be 16 known and designated as Section 5, Article XX of the Constitution of the State 17 of Idaho and to read as follows: 18 SECTION 5. SUBMISSION TO THE PEOPLE REQUIRED FOR REVISIONS OF 19 QUALIFICATIONS FOR CONSTITUTIONAL OFFICE. Qualifications for consti- 20 tutional offices are exclusive and the legislature shall not have the 21 power to change, add to or diminish such qualifications except by 22 amendment to this Constitution or by constitutional convention 23 whereby the proposed revision shall be submitted to, and adopted by, 24 the people. 25 SECTION 2. The question to be submitted to the electors of the State of 26 Idaho at the next general election shall be as follows: 27 "Shall Article XX, of the Constitution of the State of Idaho be amended 28 by the addition of a new Section 5, Article XX, to provide that qualifications 29 for constitutional offices are exclusive and the legislature shall not have 30 the power to change, add to or diminish such qualifications except by amend- 31 ment to the Constitution of the State of Idaho or by constitutional convention 32 whereby the proposed revision shall be submitted to, and adopted by, the peo- 33 ple?". 34 SECTION 3. The Legislative Council is directed to prepare the statements 35 required by Section 67-453, Idaho Code, and file the same. 36 SECTION 4. The Secretary of State is hereby directed to publish this pro- 37 posed constitutional amendment and arguments as required by law.
STATEMENT OF PURPOSE RS09517 This legislation proposes an amendment to Article Y-X of the Constitution of the State of Idaho relating to qualifications for constitutional office. The legislation provides that qualifications for constitutional office are "exclusive" and that accordingly the legislature shall not have the power to change, add to, or diminish such qualifications except by amendment to the Constitution of the State of Idaho, or by constitutional convention whereby the proposed revision shall be submitted to, and adopted by, the people of Idaho. FISCAL IMPACT The fiscal impact of the proposed legislation will be the cost of the question as presented to the people of Idaho by ballot at the next general election. The Office of Secretary of State estimatesthe cost to print and publish the question to be approximately $25,000.
