S1351|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE SENATE SENATE BILL NO. 1351 BY RESOURCES AND ENVIRONMENT COMMITTEE 1 AN ACT 2 RELATING TO THE COMPREHENSIVE STATE WATER PLAN PART A; RATIFYING AND APPROVING 3 POLICY 4A OF THE COMPREHENSIVE STATE WATER PLAN PART A, RELATING TO AGENCY 4 RESPONSIBILITIES, AS ADOPTED BY THE IDAHO WATER RESOURCE BOARD ON JANUARY 5 4, 2000; AND DECLARING AN EMERGENCY. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That pursuant to Section 42-1734B(6), Idaho Code, Policy 4A of 8 the Comprehensive State Water Plan Part A, adopted by resolution of the Idaho 9 Water Resource Board on January 4, 2000, is ratified and approved. The Compre- 10 hensive State Water Plan Part A, Policy 4A, shall read as follows: 11 4A. AGENCY RESPONSIBILITIES. It is the policy of Idaho that the 12 responsibilities for administration and regulation of water quantity 13 allocations be discharged by the Department of Water Resources sepa- 14 rate from the state agency primarily responsible for the administra- 15 tion and regulation of water quality. However, planning for water use 16 and water quality should be integrated among state agencies by the 17 Idaho Water Resource Board to the extent such integrated planning 18 does not compromise the responsibilities of the individual state 19 agencies, or state sovereignty over water allocation and use. 20 SECTION 2. An emergency existing therefor, which emergency is hereby 21 declared to exist, this act shall be in full force and effect on and after its 22 passage and approval.
STATEMENT OF PURPOSE RS 09640 The responsibilities for administering and regulating water quantity allocations and water quality standards are presently divided between state agencies. The Department of Water Resources administers and regulates water allocation and use, while the Division of Environmental Quality is primarily responsible for administering and regulating water quality. This separation of responsibilities provides significant advantages to Idaho in maintaining regulatory and administrative authorities at the. state level. Policy 4A, as amended, supports the continued separation of these regulatory responsibilities. FISCAL IMPACT The amendment supports the existing separation of regulatory authorities between the Department of Water Resources and the Division of Environmental Quality.
