PUBLIC EMPLOYEE RETIREMENT SYSTEM - Amends existing law relating to the
Public Employee Retirement System to provide that an active member is
eligible for disability retirement if disabled after five years of
membership service; and to provide that a general member not eligible for
service retirement is eligible for disability retirement if the member is
disabled on or after the first day of employment as a result of bodily

  2    RELATING TO THE PUBLIC EMPLOYEE RETIREMENT SYSTEM; AMENDING  SECTION  59-1352,
  3        IDAHO  CODE,  TO  PROVIDE THAT AN ACTIVE MEMBER IS ELIGIBLE FOR DISABILITY
  4        RETIREMENT IF DISABLED AFTER FIVE YEARS OF MEMBERSHIP SERVICE AND TO  PRO-
  5        VIDE THAT A GENERAL MEMBER NOT ELIGIBLE FOR SERVICE RETIREMENT IS ELIGIBLE
  6        FOR  DISABILITY RETIREMENT IF THE MEMBER IS DISABLED ON OR AFTER THE FIRST
  7        DAY OF EMPLOYMENT AS A RESULT OF BODILY INJURY OR OCCUPATIONAL DISEASE.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION 1.  That Section 59-1352, Idaho Code, be, and the same  is  hereby
 10    amended to read as follows:
                                                                        
 11        59-1352.  ELIGIBILITY  FOR  DISABILITY RETIREMENT. (1) An active member is
 12    eligible for disability retirement if the member  becomes  disabled  after  at
 13    least  ten  five  (105)  years of credited service including six (6) months of
 14    membership service.
 15        (2)  A police officer member, general member or a paid  firefighter  hired
 16    on or after July 1, 1993, who is not eligible for service retirement is eligi-
 17    ble  for  disability retirement if the member becomes disabled, as provided in
 18    section 59-1302(12), Idaho Code, on or after the first day of employment as  a
 19    result of bodily injury or disease from an occupational cause.

Statement of Purpose / Fiscal Impact


                   STATEMENT OF PURPOSE
                       RS 09880

Since the inception of PERSI in 1965, eligibility for disability 
retirement has been limited only to active members with at least 
ten (10) years of credited service. This bill decreases the service 
requirement for PERSI disability retirement from ten (10) years to 
five (5) years. Also, currently certain police and firefighter 
members enjoy an exception to this "years of service" requirement 
only for disabilities that result from duty related injuries. In 
those cases eligibility begins from the first day of employment. 
This bill extends the same exception to general members.

                    FISCAL IMPACT

This would increase the normal cost of the benefits by 0.08% of pay. 
Because of minimal past service cost there is negligible affect on 
the unfunded liability.
