  1                                        AN ACT
  2    RELATING TO OVERSIZED VEHICLES OR LOADS; AMENDING SECTION 49-1010, IDAHO CODE,
  3        TO AUTHORIZE CERTAIN SEMITRAILERS TO OPERATE  ON  STATE  HIGHWAYS  AS  SET
  4        FORTH  BY  POLICY  AND  APPROVED  BY  THE  IDAHO TRANSPORTATION BOARD; AND
  5        DECLARING AN EMERGENCY.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Section 49-1010, Idaho Code, be, and the same  is  hereby
  8    amended to read as follows:
                                                                        
  9        49-1010.  SIZE  OF  VEHICLES AND LOADS. No vehicle shall exceed the dimen-
 10    sions specified below, except that certain devices determined by the board  as
 11    necessary  for  the  safe and efficient operation of motor vehicles, including
 12    energy conservation devices, shall be excluded from the calculation  of  width
 13    or length.
 14        (1)  The  width  of a vehicle, including any load thereon, except as noted
 15    below, shall not exceed .......................................... 8 1/2 feet.
 16        (a)  The limitations as to size of vehicles stated in this  section  shall
 17        not  apply  to  farm tractors or to implements of husbandry, including any
 18        load thereon, and including all equipment used  in  land  leveling  opera-
 19        tions, when being incidentally operated upon the highway from one (1) farm
 20        operation to another during daylight hours.
 21        (b)  Notwithstanding the exemption from width limitation for farm tractors
 22        included  in  paragraph (a) of this subsection, the total outside width of
 23        any farm tractor being transported on the interstate system in this state,
 24        except as permitted by  section 49-1004,  Idaho  Code,  shall  not  exceed
 25        .................................................................. 9 feet.
 26        (c)  A  farm  tractor  or  implement of husbandry, when being incidentally
 27        transported upon the highway with a width in excess of the limits of para-
 28        graphs (a) and (b) of this subsection, must not  proceed  at  a  speed  in
 29        excess  of  twenty-five (25) miles per hour, must display one (1) eighteen
 30        (18) by eighteen (18) inch red flag on the outermost  left  projection  of
 31        the tractor or implement being transported, except that the speed restric-
 32        tion  of twenty-five (25) miles per hour shall not apply when such tractor
 33        or implement of husbandry is being hauled on legal width highway  vehicles
 34        equipped as required by law.
 35        (2)  The height of a vehicle, including the load thereon, shall not exceed
 36    ..................................................................... 14 feet.
 37        (3)  The  length  of  a  vehicle,  or vehicle combination, except as noted
 38    below shall not exceed:
 39        (a)  When a single motor vehicle ................................ 45 feet.
 40        (b)  When a trailer or semitrailer, except as noted below ....... 48 feet.
 41             1.  Semitrailers operating on routes determined by the board to  have
 42             severe  curvature,  deficient  width  and/or heavy traffic conditions
 43             shall be limited to an overall combination length   not  to    exceed

  1             ............................................................ 65 feet.
  2             2.  The  length of a trailer tongue, or the length of the tongue of a
  3             converter gear used to convert a semitrailer to a trailer,  shall  be
  4             excluded from the calculation of a trailer length.
  5             3.  Semitrailers operating on routes which are a part of the national
  6             network  as  set  forth in the Code of Federal Regulations, Title 23,
  7             Part 658, and on routes providing access between the national network
  8             and terminals and facilities for food, fuel, repairs and  rest  which
  9             are  located  within  one  (1)  road mile of the national network and
 10             state highways as set forth by policy and approved by the transporta-
 11             tion board shall not exceed a length of .................... 53 feet.
 12        (c)  When a motor vehicle and one or more trailers,  except  as  noted  in
 13        (3)(b), (3)(d) and (3)(e) ....................................... 75 feet.
 14        (d)  When  a  combination  of semitrailer and trailer, or of two (2) semi-
 15        trailers the length in such combination, including the  connecting  tongue
 16        and excluding the truck tractor except as noted below ........... 61 feet.
 17             When  the  combination of semitrailer and trailer or of two (2) semi-
 18        trailers including the connecting tongues exceeds sixty-one (61) feet, the
 19        length of such combination including the truck tractor .......... 75 feet.
 20        (e)  When a combination of a semitrailer and trailer, or of two (2)  semi-
 21        trailers  operating  on routes on the national network as set forth in the
 22        Code of Federal Regulations, Title 23, Part 658, and on  routes  providing
 23        access between the national network and terminals and facilities for food,
 24        fuel,  repairs  and rest which are located within one (1) road mile of the
 25        national network, the length, including the connecting tongue and  exclud-
 26        ing the truck tractor, shall not exceed ......................... 68 feet.
 27        (f)  When  a dromedary tractor with semitrailer, stinger-steered by having
 28        the kingpin located five (5) feet to the rear of the centroid of the  rear
 29        axle(s) ......................................................... 75 feet.
 30        (g)  When  a  dromedary tractor with semitrailer, not meeting the stinger-
 31        steer requirement as defined in (f) above ....................... 65 feet.
 32        (h)  When  an  auto  transporter  or  boat  transporter,   stinger-steered
 33        as  defined  in (f)  above, excluding  front  and  rear overhang  of  load
 34        ................................................................. 75 feet.
 35        (i)  When  an  auto  transporter  or  boat  transporter,  not  meeting the
 36        stinger-steer requirement as defined in (f) above, excluding front and
 37        rear overhang of load ........................................... 65 feet.
 38        (j)  When a truck tractor with stinger-steered pole trailer or log  dolly,
 39        connected  by a reach or pole, or a combination used for transporting long
 40        loads such as poles, pipes, logs or structural members  generally  capable
 41        of  sustaining themselves as beams between supporting bunks or connections
 42        ................................................................. 75 feet.
 43        (4)  The overhang or extension of a load shall not extend:
 44        (a)  Beyond the front of a vehicle, more than .................... 4 feet.
 45        (b)  Beyond the last axle, more than ............................ 15 feet.
 46        (c)  Beyond the left fender of a passenger vehicle, more than .... 0 feet.
 47        (d)  Beyond  the  right  fender    of  a   passenger  vehicle,  more  than
 48        ................................................................ 6 inches.
 49        (e)  To the front and rear combined of an auto transporter or boat
 50        transporter, more than ........................................... 7 feet.
 51        (5)  Noncargo-carrying devices necessary for the safe and efficient opera-
 52    tion of the vehicle, as determined by the board, shall not be included in mea-
 53    surement for length.
 54        (6)  No combination shall include more than three (3) units except when  a
 55    saddlemount combination ............................................. 75 feet.

  1        (7)  Vehicle  combinations  consisting  of  not more than four (4) vehicle
  2    units with an overall length in excess of the limits of subsection (3) of this
  3    section and with an overall combination length not to exceed one  hundred  and
  4    five (105) feet, may be operated by permit on routes designated for such oper-
  5    ations by the public highway agency having jurisdiction over that highway sys-
  6    tem.
                                                                        
  7        SECTION  2.  An  emergency  existing  therefor,  which emergency is hereby
  8    declared to exist, this act shall be in full force and effect on and after its
  9    passage and approval.

Statement of Purpose / Fiscal Impact


     
     
                 STATEMENT OF PURPOSE
                       RS09483 
                           
     The purpose of this legislation is to provide authorization to the Idaho
     Transportation Board to specify routes where fifty-three foot semi-trailers may
     operate without being required to obtain a permit from the Idaho Department of
     Transportation. This bill will extend to Idaho shippers and receivers the savings
     and convenience presently enjoyed by foreign shippers and receivers whose
     freight passes through Idaho on National Network Highways.
     
                           
                     FISCAL NOTE 
     
     There is no fiscal impact to the General Fund. The cost of issuing the permit will
     be offset by the savings of each permit not required by the Idaho Department of
     Transportation.
