S1416|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE SENATE SENATE BILL NO. 1416 BY JUDICIARY AND RULES COMMITTEE 1 AN ACT 2 RELATING TO THE LAWS CONCERNING SALE OF ALCOHOLIC BEVERAGES; AMENDING CHAPTER 3 6, TITLE 23, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 23-614A, IDAHO 4 CODE, TO PROVIDE CERTAIN PROHIBITED ACTS FOR DANCERS-ENTERTAINERS, TO PRO- 5 VIDE EXCEPTIONS AND TO DEFINE THE TERM "DANCER-ENTERTAINER." 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Chapter 6, Title 23, Idaho Code, be, and the same is 8 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 9 ignated as Section 23-614A, Idaho Code, and to read as follows: 10 23-614A. PROHIBITED ACTS -- DANCERS-ENTERTAINERS. (1) Subject to the pro- 11 visions of section 23-614, Idaho Code, it shall be unlawful to permit any 12 dancer-entertainer to perform on the licensed premises except when removed at 13 least six (6) feet from the nearest patron. 14 (2) This section shall not be applied to performances of traditional eth- 15 nic dancing such as belly dancing, flamenco dancing, Hawaiian or Tahitian 16 dancing performed in a licensed premises. 17 (3) The term "dancer-entertainer" is intended to have a broad and general 18 meaning so as to include any person performing a dance in or on a retail 19 liquor, beer or wine premises and whose work is under some control or direc- 20 tion, or both, of the licensee.
STATEMENT OF PURPOSE RS-09823 This legislation is one of three bills that the Department of Law Enforcement - Alcohol Beverage Control recommends to cure defects in the law or eliminate ambiguities that cause confusion to the regulated public and citizens and unnecessarily consumes time of police officers. Specifically, this legislation applies to those few licensee's who employ dancer-entertainers who perform dance or other acts with patrons that is considered in violation to state law but difficult to prove and explain. State law needs a more objective measure that allows licensee's, their employee dancer-entertainers, patrons and state police to more easily know the limits. This legislation provides a reasonable objective standard to clarify the existing ambiguity. FISCAL IMPACT No negative fiscal impact. Should allow law enforcement to be more efficient.
