notified; to provide consequences if a nonschool district does not comply

  1                                        AN ACT
  2    RELATING TO NOTICE OF BUDGET HEARINGS BY TAXING DISTRICTS;  AMENDING  SECTIONS
  3        63-802A,  IDAHO  CODE,  TO PROVIDE IF NO BUDGET HEARING IS REQUIRED BY LAW
  4        THE COUNTY CLERK SHALL BE SO NOTIFIED, TO PROVIDE CONSEQUENCES IF  A  NON-
  5        SCHOOL DISTRICT DOES NOT COMPLY WITH STATUTE BEGINNING IN 2003, TO PROVIDE
  6        CONSEQUENCES  IF  A SCHOOL DISTRICT DOES NOT COMPLY WITH STATUTE REGARDING
  7        BUDGET HEARINGS AND TO PROVIDE FOR PUBLICATION OF A  CHANGE  OF  TIME  AND
  8        LOCATION OF A BUDGET HEARING.
                                                                        
  9    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 10        SECTION  1.  That  Section 63-802A, Idaho Code, be, and the same is hereby
 11    amended to read as follows:
                                                                        
 12        63-802A.  NOTICE OF BUDGET HEARING. (1) Not later than April  30  of  each
 13    year,  each  taxing district shall set and notify the county clerk of the date
 14    and location set for the budget hearing of the district. If no budget  hearing
 15    will be held is required by law, the county clerk shall be so notified.
 16        (2)  Beginning  in  2003,  a  nonschool district that fails to comply with
 17    subsection (1) of this section shall be prohibited from including in its  bud-
 18    get  any  budget  increase  otherwise permitted by either subsection (1)(a) or
 19    (1)(e) of section 63-802, Idaho Code.
 20        (3)  Beginning in 2003, a school district that fails to comply  with  sub-
 21    section  (1) of this section shall be prohibited, in the year of such failure,
 22    from increasing the portion of its property tax budget  raised  under  section
 23    33-802 2., Idaho Code, over the amount of the immediately preceding year.
 24        (4)  If  a  taxing district wishes to change the time and location of such
 25    budget hearing as stated on the assessment notice,  they  shall  publish  such
 26    change of time and location in advance of such hearing as provided by law.

                STATEMENT OF PURPOSE 
                       RS09937 
                           
     Under current law, Taxing Districts are required to give notice of Budget
     Hearings to the County Clerk. These notices are printed or tax notices are sent to
     each property owner. This legislation gives Taxing Districts until 2002 to comply
     with the law without penalty. Beginning in 2003, penalty for non-compliance to
     the law is provided. 
     
     
     
     
     
                     FISCAL NOTE 
     
     There is no impact on General Fund. Taxing districts who ignore the law will face
