S1470|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE SENATE SENATE BILL NO. 1470 BY COMMERCE AND HUMAN RESOURCES COMMITTEE 1 AN ACT 2 RELATING TO THE MANAGED CARE REFORM ACT; AMENDING SECTION 41-3931, IDAHO CODE, 3 TO REQUIRE THAT EACH ORGANIZATION OFFERING A MANAGED CARE PLAN FOR WHICH A 4 CERTIFICATE OF AUTHORITY IS REQUIRED BECOME A MEMBER OF A GUARANTY ASSOCI- 5 ATION BY THE YEAR 2002. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 41-3931, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 41-3931. PARTICIPATION IN GUARANTY ASSOCIATION BY THE YEAR 20002. (1) By 10 the conclusion of the year 20002, each organization offering a managed care 11 plan for which a certificate of authority is required under this chapter 12 shall, as a condition of its authority to continue to offer managed care plans 13 in this state, become a member of a guaranty association having as its purpose 14 the protection of all members of the managed care organization in this state 15 against failure by the organization in the performance of its obligations due 16 to impairment or insolvency. 17 (2) The director may take such actions and promulgate such rules as may 18 be necessary to effectuate the provisions of this section.
STATEMENT OF PURPOSE RS 10125 This legislation amends existing law to require that all managed care organizations must belong to a guarantee association by December 31, 2002. The National Association of Insurance Commissioners (NAIC) is currently developing model legislation to address this issue, which the NACI expects to release sometime in 2000. This legislation delays Idaho's implementation date by two years to allow time for the NAIC to develop its model legislation.
