S1503|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE SENATE SENATE BILL NO. 1503 BY TRANSPORTATION COMMITTEE 1 AN ACT 2 RELATING TO SPECIAL MOTOR VEHICLE LICENSE PLATES; AMENDING SECTION 49-402, 3 IDAHO CODE, TO PROVIDE A CORRECT REFERENCE AND TO CLARIFY DEPOSIT OF CER- 4 TAIN FEES; AMENDING CHAPTER 4, TITLE 49, IDAHO CODE, BY THE ADDITION OF A 5 NEW SECTION 49-417C, IDAHO CODE, TO ESTABLISH A FAMOUS POTATOES SPECIAL 6 LICENSE PLATE PROGRAM; AND PROVIDING AN EFFECTIVE DATE. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Section 49-402, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 49-402. ANNUAL REGISTRATION. (1) The annual fee for operating each pickup 11 truck and each other motor vehicle having a maximum gross weight not in excess 12 of eight thousand (8,000) pounds shall be: 13 Vehicles one (1) and two (2) years old ............................ $48.00 14 Vehicles three (3) and four (4) years old ......................... $36.00 15 Vehicles five (5) and six (6) years old ........................... $36.00 16 Vehicles seven (7) and eight (8) years old ........................ $24.00 17 Vehicles over eight (8) years old ................................. $24.00 18 There shall be twelve (12) registration periods, starting in January for 19 holders of validation registration stickers numbered 1, and proceeding consec- 20 utively through December for holders of validation registration stickers num- 21 bered 12, each of which shall start on the first day of a calendar month and 22 end on the last day of the twelfth month from the first day of the beginning 23 month. Registration periods shall expire midnight on the last day of the reg- 24 istration period in the year designated by the validation registration 25 sticker. The numeral digit on the validation registration stickers shall, as 26 does the registration card, fix the registration period under the staggered 27 plate system of Idaho for the purpose of reregistration and notice of expira- 28 tion. 29 A vehicle that has once been registered for any of the above designated 30 periods shall, upon reregistration, be registered for the period bearing the 31 same number, and the registration card shall show and be the exclusive proof 32 of the expiration date of registration and licensing. Vehicles may be ini- 33 tially registered for less than a twelve (12) month period, or for more than a 34 twelve (12) month period, and the fee prorated on a monthly basis if the frac- 35 tional registration tends to fulfill the purpose of the monthly series regis- 36 tration system. 37 (2) For all motorcycles and all-terrain vehicles the annual fee shall be 38 nine dollars ($9.00). For operation of an ATV off the public highways, the fee 39 specified in section 67-7122, Idaho Code, shall also be paid. Registration 40 exemptions provided in section 49-426(2), Idaho Code, apply to all-terrain 41 vehicles and motorcycles used for the purposes described in that subsection 42 (2). 43 (3) For all motor homes the fee shall be as specified in subsection (1) 2 1 of this section and shall be in addition to the fees provided for in section 2 49-445, Idaho Code. 3 (4) Registration fees shall not be subject to refund. 4 (5) A financial institution or repossession service contracted to a 5 financial institution repossessing vehicles under the terms of a security 6 agreement shall move the vehicle from the place of repossession to the finan- 7 cial institution's place of business on a repossession plate. The repossession 8 plate shall also be used for demonstrating the vehicle to a prospective pur- 9 chaser for a period not to exceed ninety-six (96) hours. The registration fees 10 for repossession plates shall be as required in subsection (1) of this section 11 for a vehicle one (1) and two (2) years old. All other fees required under 12 chapter 4, title 49, Idaho Code, shall be in addition to the registration fee. 13 The repossession plate shall be issued on an annual basis by the department. 14 (6) In addition to the annual registration fee in this section, there 15 shall be an initial program fee of twenty-five dollars ($25.00) and an annual 16 program fee of fifteen dollars ($15.00) for all special license plate programs 17 for those license plates issued pursuant to sections 49-404A, 49-407, 49-408, 18 49-409, 49-414, 49-416 and 49-418, Idaho Code. For special plates issued pur- 19 suant to sections 49-406 and 49-406A, Idaho Code, there shall be an initial 20 program fee of twenty-five dollars ($25.00) but there shall be no annual 21 renewal fee. For special plates issued pursuant to sections 49-417, 49-417A, 22 49-417B, 49-417C, 49-418A, 49-419, 49-419A and 49-420, Idaho Code, there shall 23 be an initial program fee of thirty-five dollars ($35.00) and an annual pro- 24 gram fee of twenty-five dollars ($25.00).For special plates issued pursuant25to section 49-418A, Idaho Code, the initial program fee and the annual renewal26fee shall be fifty dollars ($50.00).The fees contained in this subsection 27 shall be applicable to all new special plate programs. The initial program fee 28 and the annual program fee shall be depositedasin the state highway account 29 and shall be used to fund the cost of administration of special license plate 30 programs, unless otherwise specified by law.for each program.31 SECTION 2. That Chapter 4, Title 49, Idaho Code, be, and the same is 32 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 33 ignated as Section 49-417C, Idaho Code, and to read as follows: 34 49-417C. FAMOUS POTATOES LICENSE PLATES. (1) On and after January 1, 35 2001, any person who is the owner of a vehicle registered under the provisions 36 of section 49-402, Idaho Code, or registered under any other section of law 37 for which the purchase of special plates is allowed, may apply for and, upon 38 department approval, receive special famous potatoes license plates in lieu of 39 regular license plates. Availability of famous potatoes license plates for 40 other vehicles shall be subject to the rules, policies and procedures of the 41 department. 42 (2) In addition to the regular registration fee required in chapter 4, 43 title 49, Idaho Code, the applicant shall be charged a fee of thirty-five dol- 44 lars ($35.00) for the initial issuance of plates, and twenty-five dollars 45 ($25.00) upon each succeeding annual registration. Ten dollars ($10.00) of the 46 initial fee and ten dollars ($10.00) of the renewal fee shall be deposited in 47 the state highway account and shall be used to fund the cost of administration 48 of this special license plate program. Twenty-five dollars ($25.00) of each 49 initial fee and fifteen dollars ($15.00) of each renewal fee shall be trans- 50 ferred by the state treasurer to the Idaho potato commission created in chap- 51 ter 12, title 22, Idaho Code, and shall be used exclusively for the purposes 52 described in subsection 14. of section 22-1207, Idaho Code. 53 (3) Whenever title or interest in a vehicle registered under the provi- 3 1 sions of this section is transferred or assigned, the owner may transfer the 2 special plates to another vehicle upon payment of the required transfer fees. 3 The owner may only display the plates on another vehicle upon receipt of the 4 new registration from the department. 5 (4) The famous potatoes license plate shall be of a color and design in 6 accordance with the provisions of section 49-402C, Idaho Code. The distin- 7 guishing feature of the license plate shall be a representation of a prepared 8 Idaho potato with a melting pat of butter. The design and any slogan on the 9 plate shall be acceptable to the Idaho potato commission and shall be approved 10 by the department utilizing a numbering system as determined by the depart- 11 ment. Initial costs of the plate program, including costs of plate design, 12 shall be paid by the Idaho potato commission. 13 (5) Sample famous potatoes license plates may be purchased for a fee of 14 thirty dollars ($30.00), ten dollars ($10.00) of which shall be deposited in 15 the state highway account and twenty dollars ($20.00) of which shall be trans- 16 ferred to the Idaho potato commission. No additional fee shall be charged for 17 personalizing sample plates. 18 SECTION 3. This act shall be in full force and effect on and after Janu- 19 ary 1, 2001.
STATEMENT OF PURPOSE RS10046 Idaho has a long history of creative license plate designs. In fact, we pioneered the concept. In 1928, Idaho became the first state in the nation to feature a graphic design on a license plate by proudly displaying an impressive Idaho potato that filled the entire plate. In 1948 and 1949 the "Famous Potato" was in the form of a decal complete with a pat of butter. This legislation provides for a specialty license plate to recognize the contribution the "Famous Idaho Potato" has made to our great state, as well as the positive impact of the Idaho dairy industry. A potato design will appear on the left side of the plate and the phrase "Famous Potatoes" across the bottom of the plate. Funds from the sale of this license plate will be deposited into the "Idaho Potato Research Account" to carry on research and studies in connection with the raising, production, and marketing of potatoes (Section 22-1207 IC). Upon initial issuance of the license plate, a fee of $35 will be charged in addition to customary fees. Of this amount, $10 will go to the Department of Transportation, and $25 will be transferred to the Idaho Potato Commission. Upon renewal, a charge of $25 will be assessed, of which $10 will go to the Department of Transportation, and $15 will be transferred to the Idaho Potato Commission. FISCAL NOTE The cost of computer programming is estimated in the range of $4,000 to $6,000 based on an estimated 80 hours of programming at $65 an hour, the current contract programming rate. Actual programming and design costs will be paid by the Idaho Potato Commission. The legislature provides that $10 of the program fee will go to the State Highway Account to cover administration costs. The remainder of the program fee will go to Idaho Potato Commission.
