  1                                        AN ACT
  2    RELATING TO MEDICAL ASSISTANCE; AMENDING CHAPTER 2, TITLE 56, IDAHO  CODE,  BY
  3        THE ADDITION OF A NEW SECTION 56-227E, IDAHO CODE, TO PROVIDE A LIMITATION
  4        ON  REIMBURSEMENT  FOR TRANSPORTATION OF MEDICAID CLIENTS WHEN THE VEHICLE
  5        CONTAINS FIVE OR MORE CLIENTS, TO PROVIDE FOR A WAIVER AND TO PROVIDE  FOR
  6        LEGAL PROCESSES; AND DECLARING AN EMERGENCY AND PROVIDING A SUNSET CLAUSE.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION  1.  That  Chapter  2,  Title  56, Idaho Code, be, and the same is
  9    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 10    ignated as Section 56-227E, Idaho Code, and to read as follows:
                                                                        
 11        56-227E.  TRANSPORTATION OF MEDICAID CLIENTS. When five (5) or more medic-
 12    aid  clients  are being transported by a noncommercial transportation provider
 13    in a motor vehicle, reimbursement to the driver or  the  owner  of  the  motor
 14    vehicle  shall be calculated as though the vehicle contained five (5) clients.
 15    If this section creates an undue hardship, the director may,  in  writing  and
 16    signed  by  the director, grant exceptions on a case-by-case basis. Any person
 17    receiving reimbursement beyond the amounts allowed in this  section  shall  be
 18    subject to the provisions of sections 56-227A through 56-227C, Idaho Code, and
 19    the director shall promptly cause such actions to be instituted.
                                                                        
 20        SECTION  2.  An  emergency  existing  therefor,  which emergency is hereby
 21    declared to exist, this act shall be in full force and effect on and after its
 22    passage and approval; provided that the provisions of this act shall be  null,
 23    void and of no force and effect on and after June 30, 2001.

Statement of Purpose / Fiscal Impact


     
     
                 STATEMENT OF PURPOSE
                      RS 10190C1 
                           
     The purpose of this bill is to reduce the actual and potential excessive
     reimbursements to non-commercial providers who transport groups of five (5)
     Medicaid clients or more to receive regular non-emergency medical services.
     Under the current rules, providers are reimbursed for each client in the vehicle,
     which allows claims per mile to exceed $3.70. This law will limit the per mile
     reimbursement to no more than five (5) units, which would currently reimburse
     providers not more than $1.10 per mile. This law gives the Department of Health
     and Welfare the authority to immediately reduce the excessive reimbursements
     while providing sufficient time necessary to amend the complex rules surrounding
     this issue. A sunset clause is included to remove this limitation on June 20,2001,
     which should be more than enough time for the revised rules to be completed. 
     
     
     
                    FISCAL IMPACT 
     
     There is a cost savings of between $400,000 and $1,000,000 in Medicaid program
     costs for FY 2001, of which $120,000 to $300,000 are General Funds.
