SCHOOL DISTRICT - TRUSTEES - Amends existing law to provide that the
boundaries of trustee zones of school districts shall be drawn by the board
or boards of county commissioners in which the district resides so that
each trustee zone is as nearly equal in population as possible to other
trustee zones within the district; and to provide that trustee zones be

  1                                        AN ACT
  2    RELATING TO THE BOARD  OF  TRUSTEES  OF  SCHOOL  DISTRICTS;  AMENDING  SECTION
  3        33-501,  IDAHO CODE, TO PROVIDE THAT THE BOUNDARIES OF TRUSTEE ZONES SHALL
  4        BE DRAWN BY THE BOARD OR BOARDS OF COUNTY COMMISSIONERS IN WHICH THE  DIS-
  5        TRICT  RESIDES  SO THAT EACH TRUSTEE ZONE IS AS NEARLY EQUAL IN POPULATION
  6        AS MAY BE TO OTHER TRUSTEE ZONES WITHIN THE DISTRICT AND TO MAKE A TECHNI-
  7        CAL CORRECTION; AND AMENDING SECTION 33-313, IDAHO CODE, TO  PROVIDE  THAT
  8        TRUSTEE  ZONES SHALL BE REAPPORTIONED AT LEAST ONCE EVERY TEN YEARS AND TO
  9        PROVIDE THAT PROPOSED CHANGES IN THE BOUNDARIES OF TRUSTEE ZONES SHALL  BE
 10        SUBMITTED TO THE BOARD OR BOARDS OF COUNTY COMMISSIONERS.
                                                                        
 11    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 12        SECTION  1.  That  Section  33-501, Idaho Code, be, and the same is hereby
 13    amended to read as follows:
                                                                        
 14        33-501.  BOARD OF TRUSTEES. Each school district shall be  governed  by  a
 15    board  of  trustees.  The board of trustees of each elementary school district
 16    shall consist of three (3) members, and the board of trustees  of  each  other
 17    school district shall consist of five (5) members. Provided, however, that the
 18    board  of  trustees  of  any  district  which has had a change in its district
 19    boundaries subsequent to June 30, 1973, may consist of no fewer than five  (5)
 20    or  more  than  nine (9) members if such provisions are included as part of an
 21    approved proposal to redefine and change trustee zones as provided in  section
 22    33-313,  Idaho  Code.  Except  as otherwise provided by law, a school district
 23    trustee shall be elected for a term of three (3) years  or  until  the  annual
 24    meeting of his district held during the year in which his term expires.
 25        Each trustee shall at the time of his nomination and election, or appoint-
 26    ment,  be  a  school  district  elector  of his district and a resident of the
 27    trustee zone from which nominated and elected, or appointed. The boundaries of
 28    trustee zones shall be drawn by the board or boards of county commissioners in
 29    which the district resides so that each trustee zone is  as  nearly  equal  in
 30    population as may be to other trustee zones within the district.
 31        Each  trustee shall qualify for and assume office at the annual meeting of
 32    his school district next following his election, or, if appointed, at the reg-
 33    ular meeting of the board of trustees next following such appointment. An oath
 34    of office shall be administered to each trustee, whether  elected,  re-elected
 35    reelected  or  appointed.  Said oath may be administered by the clerk, or by a
 36    trustee, of the district, and the records of the district shall show such oath
 37    of office to have been taken, and by whom administered and shall be filed with
 38    the official records of the district.
                                                                        
 39        SECTION 2.  That Section 33-313, Idaho Code, be, and the  same  is  hereby
 40    amended to read as follows:
                                                                        
 41        33-313.  TRUSTEE  ZONES.  Each elementary school district shall be divided

  1    into three (3) trustee zones and each other school district shall  be  divided
  2    into  no  fewer than five (5) or more than nine (9) trustee zones according to
  3    the provisions of section 33-501,  Idaho Code.  Any  proposal  to  define  the
  4    boundaries  of  the  several  trustee zones in each such school district shall
  5    include the determination, where appropriate, of the number of  trustee  zones
  6    in  such  district,  and the date of expiration of the term of office for each
  7    trustee. The boundaries of the several trustee zones in each such school  dis-
  8    trict  shall  be defined and drawn so that, as reasonably as may be, each such
  9    zone shall have approximately the same population and shall be drawn  as  pro-
 10    vided  in section 33-501, Idaho Code, by the board or boards of county commis-
 11    sioners.
 12        Whenever the area of any district has been enlarged by the  annexation  of
 13    all  or  any  part  of another district, or by the correction of errors in the
 14    legal description of school district boundaries, any such additional territory
 15    shall be included in the trustee zone or zones contiguous to  such  additional
 16    territory  until  such time as the trustee zones may be redefined and changed.
 17    Trustee zones may be redefined and changed, but not more than once every  five
 18    (5) years in the manner hereinafter provided.
 19        A  proposal  to  redefine  and change trustee zones of any district may be
 20    initiated by its board of trustees, and submitted to the state board of educa-
 21    tion or board of county commissioners, or by petition signed by not less  than
 22    fifty  (50)  school  electors  residing  in the district, and presented to the
 23    board of trustees of the district. Within one hundred twenty (120)  days  fol-
 24    lowing the receipt of a petition to redefine and change the trustee zones of a
 25    district  the  board  of  trustees shall prepare a proposal for a change which
 26    will equalize the population in each zone in the district and shall submit the
 27    proposal to the state board of education or boards of county commissioners  as
 28    provided  in  section  33-501,  Idaho Code. Any proposal shall include a legal
 29    description of each trustee zone as the same would appear as proposed,  a  map
 30    of  the  district  showing  how  each  trustee zone would then appear, and the
 31    approximate population each would then have, should the proposal to change any
 32    trustee zones become effective.
 33        Within sixty (60) days after it has received the said proposal  the  state
 34    board of education or boards of county commissioners may approve or disapprove
 35    the  proposal  to  redefine  and  change  trustee  zones and shall give notice
 36    thereof in writing to the board of trustees of the district wherein the change
 37    is proposed. Should the state board of education or boards of  county  commis-
 38    sioners  disapprove a proposal that had been initiated at the request of peti-
 39    tioners, the board of trustees shall within  forty-five  (45)  days  submit  a
 40    revised  proposal  to the state board of education or boards of county commis-
 41    sioners. Should the state board of education or boards of county commissioners
 42    approve the proposal, the board of trustees shall within sixty (60) days after
 43    notification of the approval of such proposal submit to  the  school  district
 44    electors  residing  in  the  district, in an election to be held not less than
 45    thirty (30) days prior to the date of the  next  ensuing  annual  election  of
 46    school  district  trustees, the question of approving or disapproving the pro-
 47    posal to change trustee zones. Notice of such election  shall  be  posted  and
 48    published, the election shall be held and conducted and the ballots canvassed,
 49    as  provided  in  chapter 4, title 33, Idaho Code. If a majority of the school
 50    district electors residing in the district, and voting in the election, should
 51    approve the proposal, the trustee zones shall be changed  in  accordance  with
 52    the proposal.
 53        At  the  next  regular  meeting  of  the  board  of trustees following the
 54    approval of the proposal the board shall appoint from its membership a trustee
 55    for each new zone to serve as trustee until that incumbent trustee's three (3)

  1    year term expires. If the current board membership includes two (2)  incumbent
  2    trustees  from  the same new trustee zone, the board will select the incumbent
  3    trustee with the most seniority as a trustee to serve  the  remainder  of  his
  4    three  (3)  year  term.  If  both incumbent trustees have equal seniority, the
  5    board will choose one (1) of the trustees by the drawing of lots. If there  is
  6    a  trustee  vacancy  in  any  of  the   new zones, the board of trustees shall
  7    appoint from the patrons resident in that new trustee zone, a person from that
  8    zone to serve as trustee until the next annual meeting. At the annual election
  9    a trustee shall be elected to serve during the term specified in the  election
 10    for the zone. The elected trustee shall assume office at the annual meeting of
 11    the school district next following the election.

     The purpose of this legislation is to change who draws Trustee Zones from the
     Board of Trustees to the Board of County Commissioners in which the district
     resides. 
     
     Each zone shall be as nearly equal in population as may be to other trustee zones
