S1554|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE SENATE SENATE BILL NO. 1554 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO CREATION OF COUNTY COMMISSIONERS' DISTRICTS; AMENDING SECTION 3 31-704, IDAHO CODE, TO PROVIDE THAT COMMISSIONERS' DISTRICTS SHALL BE CRE- 4 ATED BY A COMMITTEE ON REDISTRICTING; AND AMENDING CHAPTER 7, TITLE 31, 5 IDAHO CODE, BY THE ADDITION OF A NEW SECTION 31-704A, IDAHO CODE, TO PRO- 6 VIDE APPOINTMENT OF A COMMITTEE ON REDISTRICTING, TO SPECIFY CRITERIA FOR 7 PLANS, AND TO PROVIDE IMPLEMENTATION OF DISTRICTS. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 31-704, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 31-704. COMMISSIONERS' DISTRICTS. At the regular meeting in January, pre-12ceding any general electionof a year ending in 1, the board of commissioners 13mustshall appoint a committee as provided in section 31-704A, Idaho Code, to 14 district their county into three (3) districts, as nearly equal in population15as may be, to be known as county commissioners' districts, numbers one (1),16two (2) and three (3) respectively; provided, that when a new county shall 17 have been created, or the boundary lines of a county shall have been changed, 18 then the board of commissioners of such county may appoint a committee as pro- 19 vided in section 31-704A, Idaho Code, to district their county at any general 20 or special meeting of such board. 21 SECTION 2. That Chapter 7, Title 31, Idaho Code, be, and the same is 22 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 23 ignated as Section 31-704A, Idaho Code, and to read as follows: 24 31-704A. COMMITTEE TO REDISTRICT A COUNTY. In a year ending in 1, at the 25 first regular meeting in January, the board of county commissioners shall pro- 26 vide for a committee to redistrict the county commissioners' districts of the 27 county. The committee to redistrict shall consist of five (5) members, to be 28 appointed as follows: one (1) member shall be appointed by each member of the 29 board of county commissioners, and one (1) member shall be appointed by the 30 county chairman of the two (2) largest political parties of the county as 31 determined by the vote cast for governor in the last gubernatorial election. 32 If an appointing authority shall fail to make an appointment prior to the 33 first day of February, that member shall be appointed by the chairman of the 34 board of county commissioners. 35 The chairman of the board of county commissioners shall convene the com- 36 mittee to redistrict not later than the fifteenth day of February, and the 37 committee shall organize itself and elect a chairman. Thereafter, the commit- 38 tee shall meet at the call of the chairman, and a majority of the members 39 shall constitute a quorum. 40 The plan adopted by the committee shall be governed by the following cri- 41 teria: 2 1 (1) The county population as reported by the U.S. census bureau shall be 2 the exclusive permissible data; 3 (2) To the maximum extent possible, districts shall preserve traditional 4 neighborhoods and local communities of interest; 5 (3) Districts shall be substantially equal in population; 6 (4) No city which constitutes less than one-third (1/3) of the total 7 county population shall be divided between districts; 8 (5) District boundaries should retain, as far as practicable, the local 9 voting precinct boundary lines. 10 Prior to January 1 of a year ending in 2, the committee to redistrict 11 shall submit to the board of county commissioners a division of the county 12 into three (3) districts, as nearly equal in population as may be, to be known 13 as county commissioners' districts, numbers one (1), two (2) and three (3).
STATEMENT OF PURPOSE RS10241 This legislation will create a committee on redistricting in each county every ten years upon completion of the U.S. Census report. This committee will balance out each district based upon population and other criteria. Each county commission shall appoint one member to the committee. The Chairman of the two largest political parties shall each pick one member. FISCAL NOTE No impact on General Fund. Nominal cost at the County level.
