                       SENATE BILL NO. 1569, As Amended in the House

  1                                        AN ACT
  2    RELATING TO LOTTERIES; AMENDING SECTION 18-4904, IDAHO CODE, TO  PROVIDE  THAT
  3        ASSISTING  OR  AIDING  IN ADVERTISING AN ILLEGAL LOTTERY IS A MISDEMEANOR;
  4        AND DECLARING AN EMERGENCY.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  That Section 18-4904, Idaho Code, be, and the same  is  hereby
  7    amended to read as follows:
                                                                        
  8        18-4904.  ASSISTING  IN  LOTTERY. Every person who aids or assists, either
  9    by printing, writing, advertising, publishing, or otherwise,  in  setting  up,
 10    managing  or  drawing  any  lottery, or in selling or disposing of any ticket,
 11    chance, or share therein, or in advertising an illegal lottery, is guilty of a
 12    misdemeanor.
                                                                        
 13        SECTION 2.  An emergency existing  therefor,  which  emergency  is  hereby
 14    declared to exist, this act shall be in full force and effect on and after its
 15    passage and approval.

    This bill makes it clear that the criminal prohibition against
    assisting on lotteries applies only to illegal lotteries. 
    While the state has always interpreted the statute to apply
    only to illegal lotteries, if it is interpreted by the courts
    to prohibit assisting, advertising, etc. in legal lotteries,
    the statute would be declared void.
