LEGISLATIVE ACCOUNT - Amends existing law to provide that the President Pro
Tempore of the Senate and the Speaker of the House of Representatives are
authorized to make expenditures out of the Legislative Account for
necessary expenses of the Legislature; to provide that the signature of the
President Pro Tempore of the Senate or the Speaker of the House of
Representatives on any voucher or claim for payment shall be sufficient
authority for the State Controller to pay; and to provide for delivery of
financial reports to the President Pro Tempore of the Senate and the
Speaker of the House of Representatives.

1 AN ACT
2 RELATING TO THE LEGISLATURE; AMENDING SECTION 67-451, IDAHO CODE, TO PROVIDE
3 THAT THE PRESIDENT PRO TEMPORE OF THE SENATE AND THE SPEAKER OF THE HOUSE
4 OF REPRESENTATIVES ARE AUTHORIZED TO MAKE EXPENDITURES OUT OF THE LEGISLA-
5 TIVE ACCOUNT FOR NECESSARY EXPENSES OF THE LEGISLATURE, TO PROVIDE THAT
6 THE SIGNATURE OF THE PRESIDENT PRO TEMPORE OF THE SENATE OR THE SPEAKER OF
7 THE HOUSE OF REPRESENTATIVES ON ANY VOUCHER OR CLAIM FOR PAYMENT SHALL BE
8 SUFFICIENT AUTHORITY FOR THE STATE CONTROLLER TO PAY, TO PROVIDE FOR
9 DELIVERY OF FINANCIAL REPORTS TO THE PRESIDENT PRO TEMPORE OF THE SENATE
10 AND THE SPEAKER OF THE HOUSE OF REPRESENTATIVES AND TO MAKE A TECHNICAL
11 CORRECTION.
12 Be It Enacted by the Legislature of the State of Idaho:
13 SECTION 1. That Section 67-451, Idaho Code, be, and the same is hereby
14 amended to read as follows:
15 67-451. LEGISLATIVE ACCOUNT CREATED -- DUTIES OF CONTROLLER -- DISBURSE-
16 MENTS FROM ACCOUNT -- REPORT OF DISBURSEMENTS. (1) There is hereby created in
17 the state treasury the legislative account. The legislative account shall con-
18 sist of such moneys as are placed into it by other appropriations, by receipts
19 paid into the legislative account, and the moneys appropriated and transferred
20 into it according to the provisions of this act.
21 (2) There is hereby appropriated out of the general account fund and
22 transferred into the legislative account, and commencing July 1, 1993, the
23 state controller is authorized and directed to make such transfers in the
24 amounts shown on each of the following dates in each year:
25 January 1 $1,175,000
26 March 1 $1,175,000
27 June 1 $925,000
28 September 1 $1,075,000
29 (3) The presiding officers of each house of the legislature president pro
30 tempore of the senate and the speaker of the house of representatives are
31 hereby authorized to make expenditures out of the legislative account for any
32 necessary expenses of the legislature and the legislative account is hereby
33 perpetually appropriated for any necessary expenses of the legislature. Neces-
34 sary expenses of the legislature shall include, but are not necessarily lim-
35 ited to salaries and wages of officers, members, and employees of the legisla-
36 ture, consultants and other expert or professional personnel, travel expenses
37 of officers, members, and employees of the legislature, other current expenses
38 incurred in any operation or function of the legislature, premiums for life,
39 accidental death and dismemberment, hospital, medical, surgical and major med-
40 ical insurance for members of the legislature during their terms of office,
41 and for employees of the legislature during the period of their employment,
42 and capital outlay items necessary for any operation or function of the legis-
43 lature. The signature of a presiding officer the president pro tempore of the

1 senate or the speaker of the house of representatives on any voucher or claim
2 for payment shall be sufficient authority for the state controller to pay the
3 same. Expenses for any interim activity of the legislature or legislators
4 shall be paid in the same manner. Expenses for any interim legislative commit-
5 tees shall be paid in the same manner, if previously authorized by concurrent
6 resolution.
7 (4) The state controller is hereby directed to devise and implement a
8 financial reporting and control system for the purposes of this act that
9 exempts legislative expenditures from any other provision of law, and the leg-
10 islative account shall be specifically exempt from the provisions of chapter
11 35, title 67, Idaho Code, and shall be specifically exempt from the provisions
12 of chapter 36, title 67, Idaho Code. Such system must produce a report as of
13 the end of each calendar month that clearly shows additions to the account,
14 the unexpended balance in the account, the expenditures to date, and the
15 expenditures for the month reported, suitably detailed in such manner as the
16 presiding officers may instruct the state controller. A copy of such report
17 must be delivered to the presiding officer of each house of the legislature
18 president pro tempore of the senate and the speaker of the house of represen-
19 tatives and to the governor by no later than the fifth working day of the fol-
20 lowing month.

This bill would clarify that the President Pro Tempore and the Speaker of the
House of Representatives are the officials who are authorized to make
expenditures out of the legislative account and to sign vouchers or claims for
payment, and that those signatures are sufficient authority for the State Controller
to pay the same.
