SCR149|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE SENATE SENATE CONCURRENT RESOLUTION NO. 149 BY AGRICULTURAL AFFAIRS COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND REJECTING A CERTAIN RULE OF THE IDAHO 3 RANGELAND RESOURCES COMMISSION RELATING TO NOMINATIONS TO THE COMMISSION. 4 Be It Resolved by the Legislature of the State of Idaho: 5 WHEREAS, the Legislature is vested with authority to reject executive 6 agency rules under the provisions of Section 67-5291, Idaho Code, in the event 7 that the Legislature finds that the rules are not consistent with legislative 8 intent; and 9 WHEREAS, it is the finding of the Legislature that a certain rule of the 10 Idaho Rangeland Resources Commission relating to nominations to the commission 11 is not consistent with legislative intent and should be rejected. 12 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses- 13 sion of the Fifty-fifth Idaho Legislature, the Senate and the House of Repre- 14 sentatives concurring therein, that IDAPA 56.01.01, Section 100, Subsection 02 15 only, rules of the Idaho Rangeland Resources Commission relating to nomina- 16 tions to the commission, adopted as a pending rule under Docket number 17 56-0101-9901, be, and the same is hereby rejected and declared null, void and 18 of no force and effect.
STATEMENT OF PURPOSE RS 09997 This concurrent resolution would reject a pending rule of the Idaho Rangeland Resources Commission relating to nominations to the commission. The effects of this resolution, if adopted by both houses, would be to prevent the agency rule from going into effect. FISCAL NOTE This resolution has no fiscal impact. CONTACT: Sen.
