SJM106|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE SENATE SENATE JOINT MEMORIAL NO. 106 BY RESOURCES AND ENVIRONMENT COMMITTEE 1 A JOINT MEMORIAL 2 TO THE PRESIDENT OF THE UNITED STATES, THE SENATE AND HOUSE OF REPRESENTATIVES 3 OF THE UNITED STATES IN CONGRESS ASSEMBLED, AND TO THE CONGRESSIONAL DELE- 4 GATION REPRESENTING THE STATE OF IDAHO IN THE CONGRESS OF THE UNITED 5 STATES. 6 We, your Memorialists, the Senate and the House of Representatives of the 7 State of Idaho assembled in the Second Regular Session of the Fifty-fifth 8 Idaho Legislature, do hereby respectfully represent that: 9 WHEREAS, the United States Forest Service (USFS) published in the Federal 10 Register on October 5, 1999, a proposed rule regarding forest service land and 11 resource management planning; and 12 WHEREAS, the Legislature of the State of Idaho advocates improvements to 13 the forest planning regulations; and 14 WHEREAS, the USFS needs to simplify, clarify and otherwise improve the 15 planning process as well as reduce the burdensome and costly procedural 16 requirements, and strengthen collaborative relationships with the public and 17 other governmental entities; and 18 WHEREAS, the USFS organic act calls for multiple use in managing the 19 national forests with meaningful public input; and 20 WHEREAS, the proposed rules are inconsistent with the legislative direc- 21 tion for multiple uses and high-level sustained yield outputs of the renewable 22 timber resource; and 23 WHEREAS, timber production must remain a primary use in the National For- 24 est System; and 25 WHEREAS, the proposed rules would alter the multiple use and sustained 26 yield mandate prescribed by Congress. Moreover, they reverse the multiple use 27 priorities set by Congress by subordinating timber production to achievement 28 of biological diversity and similar ecosystem goals; and 29 WHEREAS, no other law provides authority for the Forest Service to alter 30 the course of management and primary purposes set by Congress for management 31 of the National Forest System; and 32 WHEREAS, the proposed rules lack commitment to carrying out economic mul- 33 tiple uses; and 34 WHEREAS, the proposed rules fail to provide direction on which plan revi- 35 sions and amendments require environmental impact statements. Procedures and 36 standards should be revised for significant plan amendments; and 37 WHEREAS, the proposed rules provide no effective date for the adoption of 38 an amendment or plan revision. 39 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses- 40 sion of the Fifty-fifth Idaho Legislature, the Senate and the House of Repre- 41 sentatives concurring therein, that we request the United States Forest Ser- 42 vice not move forward with final rule based on the October 5, 1999, proposal. 43 Ecological sustainability must start looking at current conditions of the 44 national forests and determining the desired future conditions, which should 2 1 be healthy forests for the American people to use and enjoy. There should be 2 aggressive, active management, rather than passive management, to restore the 3 health of all land identified as being high risk to insect and disease infes- 4 tation and/or catastrophic wildfire. Prohibiting management puts our forests 5 at risk to insects, diseases and fire. These proposed rules will cause greater 6 damage to our forests in the long run. 7 BE IT FURTHER RESOLVED, that the Legislature of the State of Idaho encour- 8 ages the agency to readdress its entire approach to ecosystem management. The 9 agency needs to streamline and clarify the forest planning and decision-making 10 processes, strengthen relationships with the public, ensure long-term 11 sustainability of forest ecosystems, and promote adaptive management. The pro- 12 posed rules cannot accomplish these critical goals in its current form. 13 Ecosystem management and forest planning cannot be successful if the process 14 becomes the goal. Ecosystem management must instead be considered a tool to 15 accomplish the goals which are set in law and through the development of for- 16 est plans. 17 BE IT FURTHER RESOLVED that the Secretary of the Senate be, and she is 18 hereby authorized and directed to forward a copy of this Memorial to the Pres- 19 ident of the United States, President of the Senate and the Speaker of the 20 House of Representatives of Congress, and the congressional delegation repre- 21 senting the State of Idaho in the Congress of the United States.
STATEMENT OF PURPOSE RS 09798 The purpose of this memorial is to ask the U. S. Forest Service not to move forward with a final rule based on the October 5, 1999 proposal and asks the Forest Service to readdress its entire approach to ecosystem management.
