H0430|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 430 BY AGRICULTURAL AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO THE PURE SEED LAW; AMENDING SECTION 22-434, IDAHO CODE, TO CLARIFY 3 THAT LICENSES ARE REQUIRED FOR SEED DEALERS WHO CONDITION OR LABEL OR SELL 4 SEED AND TO PROVIDE THAT ANY PERSON SELLING SEED WHO HAS TOTAL ANNUAL 5 GROSS SEED SALES NOT EXCEEDING FIVE HUNDRED DOLLARS IS EXEMPT; AND PROVID- 6 ING AN EFFECTIVE DATE. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Section 22-434, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 22-434. SEED DEALER'S LICENSE. An in-state seed dealer or an out-of-state 11 seed dealer who conditions,or labelsandor sells, for the use of others any 12 seed, shall obtain a license from the department authorizing him to condition,13 or labelandor sell such seed. A dealer shall not be entitled to a license 14 unless he has an established plant, warehouse or place of business. 15 A separate license shall be required for each place of business from which 16 seed regulated under this chapter is sold. Application for licenses shall be 17 on a form provided by the director. Applications shall be renewed no later 18 than July 1 of each year. 19 Fees so collected shall be paid into the state treasury and credited to 20 the state agricultural inspection account. 21 In-state producers selling their own crop shall be exempt from this sec- 22 tion. Any person selling seed who has total annual gross seed sales not 23 exceeding five hundred dollars ($500) is exempt from this section. 24 The department may suspend, revoke, or refuse to issue or renew the 25 license of any person when it is satisfied that: 26 (1) The applicant or licensee has been guilty of fraud, deception, or 27 misrepresentation in the procurement of a license; and/or 28 (2) The licensee was guilty of violating any of the provisions of this 29 chapter. 30 SECTION 2. This act shall be in full force and effect on and after July 31 1, 2000.
STATEMENT OF PURPOSE RS09376 Amend Title 22, Chapter 4, Section 22-434, Idaho Code, to clarify the intent of the law that licenses are required for seed dealers who condition or label or sell seeds. The current law does not clearly state that a license is required for a dealer who engages in any one of the three activities; namely, conditions, or labels, or sells seed. Amend Title 22, Chapter 4, Section 22-434, Idaho Code, to exempt persons with total annual gross seed sales not exceeding five hundred dollars ($500) from the seed dealers license requirement. FISCAL IMPACT Fiscal impact to Dedicated Fund revenues is an estimated loss of $4,000 in seed dealers license fees for FY 2001. CONTACT Name: Dr. Roger R.
