ARTS COMMISSION - Amends existing law to provide that the terms of the
members of the Commission on the Arts shall be extended to June 30 of the
year their term expires and when a member's term expires, the governor
shall appoint a member for a four-year term, which shall be from July 1 to
June 30 four calendar years later; and to provide that a vacancy shall be

  1                                        AN ACT
  2    RELATING TO MEMBERS OF THE COMMISSION ON THE ARTS; AMENDING  SECTION  67-5603,
  3        IDAHO  CODE,  TO PROVIDE THE TERMS OF THE MEMBERS OF THE COMMISSION ON THE
  4        ARTS SHALL BE EXTENDED TO JUNE 30 OF THE YEAR THEIR TERM EXPIRES AND  WHEN
  5        A  MEMBER'S  TERM  EXPIRES, THE GOVERNOR SHALL APPOINT A MEMBER FOR A FOUR
  6        YEAR TERM, WHICH SHALL BE FROM JULY 1 TO JUNE 30 FOUR CALENDAR YEARS LATER
  7        AND TO PROVIDE THAT A VACANCY SHALL BE FILLED FOR  THE  REMAINDER  OF  THE
  8        TERM;  DECLARING  AN EMERGENCY AND PROVIDING APPLICATION TO MEMBERS OF THE
  9        COMMISSION ON THE ARTS WHOSE TERM WOULD EXPIRE ON APRIL 1, 2000.
                                                                        
 10    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 11        SECTION 1.  That Section 67-5603, Idaho Code, be, and the same  is  hereby
 12    amended to read as follows:
                                                                        
 13        67-5603.  TERMS  OF  MEMBERS -- APPOINTMENT OF OFFICERS -- SERVICE OF MEM-
 14    BERS -- COMPENSATION. The term of office of each  member  shall  be  four  (4)
 15    years;  provided,  however that of the members appointed during or after June,
 16    1991, the governor may appoint for a term of less than four (4) years so  that
 17    not more than four (4) terms expire in any one (1) year provided that all mem-
 18    bers'  terms  shall  be  extended  to  June 30 of the year their terms expire.
 19    When a member's term expires, the governor shall appoint a member for  a  four
 20    (4)  year  term  which shall be from July 1 to June 30 four (4) calendar years
 21    later. A vacancy shall be filled for the remainder of the term.  The  governor
 22    shall designate a chairman and a vice-chairman from the members of the commis-
 23    sion  to serve as such at the pleasure of the governor. All vacancies shall be
 24    filled for the balance of the unexpired term in the same  manner  as  original
 25    appointments.  The  members of the commission shall be compensated as provided
 26    by section 59-509(b), Idaho Code.
                                                                        
 27        SECTION 2.  An emergency existing  therefor,  which  emergency  is  hereby
 28    declared to exist, this act shall be in full force and effect on and after its
 29    passage  and  approval;  provided  that  members of the Commission on the Arts
 30    whose term would expire on April 1, 2000, may continue to serve until July  1,
 31    2000, and shall be eligible to be reappointed by the Governor.

                STATEMENT OF PURPOSE

     This will change the expiration date of each Commissioner's term to June 30 of
     the year their term would normally expire (which currently is March) .  This
     allows a new governor more time to make the appointments to the Idaho
     Commission on the Arts during his first term in office. 
     
     All future appointments would be from July 1 to June 30 for four (4) years.   
     Vacancies would be filled for the remaining portion of the four-year term.
