MOTOR VEHICLE - ACCIDENTS - Adds to existing law to provide that a towing
firm called to the scene of an accident or disabled vehicle shall remove
the vehicle as directed by an authorized officer or as requested by the
owner or authorized agent; and to prohibit collection of certain fees if
the vehicle is moved other than as so directed or if the towing firm

  1                                        AN ACT
  2    RELATING TO TOWING OF MOTOR VEHICLES; AMENDING CHAPTER  18,  TITLE  49,  IDAHO
  3        CODE,  BY  THE  ADDITION OF A NEW SECTION 49-1807A, IDAHO CODE, TO PROVIDE
  4        THAT A TOWING FIRM CALLED TO THE SCENE OF AN ACCIDENT OR DISABLED  VEHICLE
  5        SHALL  REMOVE  THE  VEHICLE  AS  DIRECTED  BY  AN AUTHORIZED OFFICER OR AS
  6        REQUESTED BY THE OWNER OR AUTHORIZED AGENT, TO PROHIBIT COLLECTION OF CER-
  7        TAIN FEES IF THE VEHICLE IS REMOVED OTHER THAN AS SO DIRECTED  OR  IF  THE
  8        TOWING  FIRM  REFUSES  TO  RELEASE THE VEHICLE TO THE OWNER FOR ANY REASON
  9        OTHER THAN THE OWNER'S REFUSAL TO PAY LAWFUL FEES.
                                                                        
 10    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 11        SECTION 1.  That Chapter 18, Title 49, Idaho Code, be,  and  the  same  is
 12    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 13    ignated as Section 49-1807A, Idaho Code, and to read as follows:
                                                                        
 14        49-1807A.  UNAUTHORIZED REMOVAL OF VEHICLE -- REFUSAL TO RELEASE  VEHICLE.
 15    Any  towing firm, employee or agent thereof called to the scene of an accident
 16    or disabled vehicle by an authorized officer and requested to remove  a  vehi-
 17    cle, shall remove the vehicle and take it to the nearest garage or other place
 18    of  safety as directed by the officer or, except as otherwise provided in this
 19    chapter, shall take the vehicle to such place as the owner or  his  authorized
 20    agent  may reasonably request. The towing firm, employee or agent shall not be
 21    entitled to recover any storage, impound fees or other fees, except the sched-
 22    uled tow fee, if the firm, employee or agent:
 23        (1)  Removes the vehicle to a place other than as directed by the  officer
 24    or as reasonably requested by  the owner or his authorized agent; or
 25        (2)  After  removing  the  vehicle,  refuses to release the vehicle to the
 26    owner or his authorized agent for any reason other than  the  refusal  of  the
 27    owner or authorized agent to pay the fees to which the towing firm is lawfully
 28    entitled.  The  refusal  of  the  owner or his authorized agent to pay fees to
 29    which the towing firm, employee or agent is not entitled pursuant to this sub-
 30    section, shall not be cause for the towing firm, employee or agent  to  refuse
 31    to release the vehicle.

                 STATEMENT OF PURPOSE

     This legislation adds a new section to the Idaho Code relating to the towing of
     motor vehicles, which provides that a towing firm called to the scene of an
     accident or disabled vehicle shall remove the vehicle as directed by an authorized
     officer or as requested by the owner or authorized agent.      The towing company
     shall be prohibited from collecting certain fees if the vehicle is removed other
     than as so directed or if the towing firm refuses to release the vehicle to the owner
     for any reason other than the owner's refusal to pay lawful fees.
