  1                                        AN ACT
  2    RELATING TO THE DEPARTMENT OF HEALTH AND WELFARE; AMENDING CHAPTER  76,  TITLE
  3        39,  IDAHO  CODE, BY THE CREATION OF A NEW SECTION 39-7606, IDAHO CODE, TO
  4        CREATE THE PUBLIC WATER SYSTEM SUPERVISION FUND IN THE STATE TREASURY,  TO
  5        PROVIDE  FOR MONEYS IN THE FUND, TO PROVIDE FOR INVESTMENT OF IDLE OR SUR-
  6        PLUS MONEYS IN THE FUND, TO PROVIDE FOR THE RETURN OF INTEREST TO THE FUND
  7        AND TO PROVIDE FOR EXPENDITURES FROM THE FUND; AND DECLARING AN EMERGENCY.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION 1.  That Chapter 76, Title 39, Idaho Code, be,  and  the  same  is
 10    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 11    ignated as Section 39-7606, Idaho Code, and to read as follows:
                                                                        
 12        39-7606.  PUBLIC WATER SYSTEM SUPERVISION FUND. (1) There is  hereby  cre-
 13    ated in the state treasury the public water system supervision fund. Moneys in
 14    the fund shall consist of fees assessed pursuant to rules of the department on
 15    regulated  public  drinking water systems, federal funds which are received by
 16    the state to provide for the public water system  supervision  program,  dona-
 17    tions, state appropriations and any other moneys from whatever source.
 18        (2)  Idle  or  surplus  moneys in the public water system supervision fund
 19    established by this section shall be invested by the state  treasurer  in  the
 20    manner  for idle state moneys in the state treasury as provided for in section
 21    67-1210, Idaho Code. Interest received on all such investments shall  be  paid
 22    into the fund. Moneys in the fund may be expended pursuant to appropriation.
                                                                        
 23        SECTION  2.  An  emergency  existing  therefor,  which emergency is hereby
 24    declared to exist, this act shall be in full force and effect on and after its
 25    passage and approval.

                STATEMENT OF PURPOSE

     Most Idaho residents pay a monthly fee attached to their water bill to support the
     state drinking water program which provides oversight for drinking water quality
     and assistance for drinking water systems. With this fee system, the drinking
     water program is not supported by the general fund. With present procedure,
     interest earnings on the balance of drinking water fees go to the general fund. This
     legislation would put the interest, about $50,000 a year, into the drinking water
     program, helping to delay or avoid an increase in drinking water fees. The
     legislation is supported by the Drinking Water Advisory Committee of the 
     Division of Environmental Quality. DEQ has a neutral position. 
     
     
     
                    FISCAL IMPACT 
     
     About $50,000 a year in interest income would be shifted from the general fund to
     the fund that supports the drinking water program.
