CHARTER SCHOOLS - Amends existing law to provide that if a school district
requires a charter school to provide additional reports or evaluations
beyond the annual report, such evaluations shall be conducted by an
independent third party designated by written agreement between the
chartering district and the charter school, or, in the absence of such an
agreement, shall be designated by the State Superintendent of Public
Instruction; and to provide that costs associated with additional reporting
and evaluation shall be paid by the district which approved the charter

  1                                        AN ACT
  2    RELATING TO PUBLIC CHARTER SCHOOLS; AMENDING SECTION 33-5206, IDAHO  CODE,  TO
  3        PROVIDE  THAT  IF  REPORTS  OR EVALUATIONS ARE REQUIRED IN ADDITION TO THE
  4        ANNUAL REPORT, SUCH EVALUATIONS SHALL BE CONDUCTED BY AN INDEPENDENT THIRD
  5        PARTY DESIGNATED BY WRITTEN AGREEMENT BETWEEN THE CHARTERING DISTRICT  AND
  6        THE  CHARTER SCHOOL, OR IN THE ABSENCE OF SUCH AN AGREEMENT, SHALL BE DES-
  7        IGNATED BY THE STATE SUPERINTENDENT OF PUBLIC INSTRUCTION AND  TO  PROVIDE
  8        THAT  COSTS  ASSOCIATED  WITH ADDITIONAL REPORTING AND EVALUATION SHALL BE
  9        PAID BY THE DISTRICT WHICH APPROVED THE CHARTER SCHOOL; AND  PROVIDING  AN
 10        EFFECTIVE DATE.
                                                                        
 11    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 12        SECTION  1.  That  Section 33-5206, Idaho Code, be, and the same is hereby
 13    amended to read as follows:
                                                                        
 14        33-5206.  REQUIREMENTS AND PROHIBITIONS UPON APPROVAL OF A CHARTER SCHOOL.
 15    (1) In addition to any other requirements imposed in this chapter,  a  charter
 16    school  shall  be  nonsectarian in its programs, affiliations, admission poli-
 17    cies, employment  practices,  and  all  other  operations,  shall  not  charge
 18    tuition,  levy  taxes  or  issue bonds, and shall not discriminate against any
 19    student on any basis prohibited by the federal or state constitutions  or  any
 20    federal, state or local law. Admission to a charter school shall not be deter-
 21    mined  according to the place of residence of the student, or of the student's
 22    parent or guardian within the district, except that a  charter  school  estab-
 23    lished  under the provisions of this chapter shall adopt and maintain a policy
 24    giving admission preference to students who reside within the attendance  area
 25    of that school.
 26        (2)  No  board  of  trustees shall require any employee of the school dis-
 27    trict to be involuntarily assigned to work in a charter school.
 28        (3)  Certified teachers in a charter school  shall  be  considered  public
 29    school  teachers. Educational experience shall accrue for service in a charter
 30    school and such experience shall be counted by any school  district  to  which
 31    the teacher returns after employment in a charter school.
 32        (4)  No board of trustees shall require any student enrolled in the school
 33    district to attend a charter school.
 34        (5)  Upon  approval  of  the  petition by the board of trustees, the peti-
 35    tioner shall provide written notice of that approval, including a copy of  the
 36    petition, to the state board of education. For the purpose of implementing the
 37    provisions  of  section  33-5203(2),  Idaho Code, the state board of education
 38    shall assign a number to each petition it receives. Petitions  shall  be  num-
 39    bered  based  on the chronological order in which notice of the approved peti-
 40    tion is received by the state board of education.
 41        (6)  Each charter school shall annually submit a report to the local board
 42    of trustees which approved its charter. In the case of a  new  charter  school
 43    whose  charter was granted by the state board of education pursuant to section

  1    33-5207, Idaho Code, the annual report shall be submitted to the  state  board
  2    of education.
  3        (a)  The  report  shall  contain  the audit of the fiscal and programmatic
  4        operations as required in section 33-5205(3)(j), Idaho Code, a  report  on
  5        student  progress  based on the charter school's student educational stan-
  6        dards identified in section 33-5205(3)(b), Idaho Code, and a copy  of  the
  7        charter school's accreditation report.
  8        (b)  If  the  provisions  of  an  approved petition require reporting more
  9        often than annually, or require evaluation of subjects  not  specified  in
 10        paragraph (a) of this subsection (6), costs associated with the additional
 11        requirements  shall  be  paid  by  the  school district which approved the
 12        charter. Such additional evaluations shall be performed by an  independent
 13        third  party. The independent third party shall be designated in a written
 14        agreement between the chartering district and the charter  school,  or  in
 15        the  absence of such an agreement, shall be designated by the state super-
 16        intendent of public instruction.
                                                                        
 17        SECTION 2.  This act shall be in full force and effect on and  after  July
 18    1, 2000.

     This legislation will amend ID Code 33-5206, relating to Charter schools, to
     provide that if any evaluations or re ports are required in addition to the annual
     report, such requirements shall be conducted by an independent third party
     designated in writing by the State Superintendent of Public Instruction and will
     provide the funds associated with the additional 
     requirements.
