Department of Lands for fiscal year 2001; limits the number of full-time
equivalent positions to 243.61; provides that the State Controller shall
transfer unexpended and unencumbered balances to the General Fund; provides
a contingency for the appropriation for the Forest and Range Fire
Protection Program; and appropriates an additional $500,000 to the
Department of Lands for fiscal year 2000.

2 APPROPRIATING MONEYS TO THE DEPARTMENT OF LANDS FOR FISCAL YEAR 2001; LIMITING
3 THE NUMBER OF AUTHORIZED FULL-TIME EQUIVALENT POSITIONS; TRANSFERRING
4 UNEXPENDED AND UNENCUMBERED BALANCES TO THE GENERAL FUND; PLACING A CON-
5 TINGENCY ON THE APPROPRIATION FOR THE FOREST AND RANGE FIRE PROTECTION
6 PROGRAM; APPROPRIATING ADDITIONAL MONEYS TO THE DEPARTMENT OF LANDS FOR
7 FISCAL YEAR 2000; AND DECLARING AN EMERGENCY FOR SECTION 5 OF THIS ACT.
8 Be It Enacted by the Legislature of the State of Idaho:
9 SECTION 1. There is hereby appropriated to the Department of Lands the
10 following amounts, to be expended for the designated programs according to the
11 designated expense classes from the listed funds for the period July 1, 2000,
12 through June 30, 2001:

34 SECTION 2. In accordance with Section 67-3519, Idaho Code, the Department
35 of Lands is authorized no more than two hundred forty-three and sixty-one hun-
36 dredths (243.61) full-time equivalent positions at any point during the period
37 July 1, 2000, through June 30, 2001, for the programs specified in Section 1
38 of this act, unless specifically authorized by the Governor. The Joint
39 Finance-Appropriations Committee will be notified promptly of any increased
40 positions so authorized.
41 SECTION 3. Upon closing of fiscal year 2000, the State Controller shall
42 transfer to the General Fund any unexpended and unencumbered balance previ-
43 ously appropriated to the Department of Lands from the Hazardous Waste Manage-
44 ment Fund.
45 SECTION 4. Of the amount appropriated in Section 1 of this act from the
46 General Fund for the Forest and Range Fire Protection Program, $125,000 is
47 contingent upon the reimbursement of at least $250,000 to the General Fund
48 from amounts previously appropriated for the Triumph Mine Reclamation project.
49 The reimbursement is in addition to the amount transferred in Section 3 of
50 this act.

1 SECTION 5. In addition to the appropriation made in Section 1, Chapter
2 253, Laws of 1999, there is hereby appropriated to the Idaho Department of
3 Lands the following amount, to be expended for the Land, Range, and Mineral
4 Resource Management Program according to the designated expense class from the
5 listed fund for the period July 1, 1999, through June 30, 2000:

10 SECTION 6. An emergency existing therefor, which emergency is hereby
11 declared to exist, Section 5 of this act shall be in full force and effect on
12 and after its passage and approval.

This is the fiscal year 2001 appropriation to the Department of Lands in the amount of $27,368,100. The bill transfers any unexpended and unencumbered moneys from the Hazardous Waste Management Fund to the General Fund. It also includes a contingent appropriation. Finally, the legislation provides a one-time supplemental appropriation for fiscal year 2000 in the amount of $500,000 from the Land Improvement Fund to renovate endowment properties.
